2007-050CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 07-50 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN TO CONSTRUCT AN L.A. FITNESS HEALTH CLUB WHEREAS, an application for Site Plan Review SPR07-2 has been made by City Center Ventures, LLC; WHEREAS, the procedural history of the application is as follows: 1. That an application for a Site Plan was made by City Center Ventures, LLC, on June 29, 2007; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on July 31, 2007: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: That part of the Northeast Quarter of the Northeast Quarter of Section 23, Township 117, Range 22, lying South of the center line of State Highway No. 7 and Northeasterly of the northeasterly line of the Minneapolis and St. Louis Railway Company's right-of--way, Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED that the application for Site Plan Review SPR07-2 is hereby approved based on the following Findings of Fact: 1. That the proposed use meets the requirements for site plan review. BE IT FURTHER RESOLVED that application for Site Plan Review SPR07-2 is hereby approved subject to the following conditions: 1. That the watershed district approves the proposed development. 2. That the public works department approves the final drainage, utility and grading plans. 3. That a new landscape plan is submitted with 45 plantings of the required size. 4. That the updated recommendations of the Wenck traffic study, figure 5 are deemed necessary. The Developer shall complete the improvements at its expense. 5. In the future, a traffic signal to the benefit of the developer will not be installed at 17th Avenue North unless the entrance to the facility is aligned with 4th Street North. Any access agreements needed to achieve this alignment will be between the owners of the affected parcels. Adopted this 6th day of August 2007. ATTEST: _4 .~, ,,.
