its property on the south side of Excelsior Boulevard west of
Blak;e Road and its property on the west side of Blake Road south
of Excelsior Boul,evax.d� yye ask that this property be re-zoned
for commerisl use. We hope thai; this reauest will be acted upon
at your ne�t meeting on June 19.
I believe that Mr. James Thorpe has discussed the mati�er
informally with the City Manager.
� We have no definite immediate plans to alter the present
use of this progerty� but it is possible that we shall be able to
derive some extra income by using a part of it commercially. If
you are v�rilling to re-zone it, as the property around it is now
zoned commercially� we shall then have full freedom of action.

such facilities by the issuance of bonds or the imposition of
special assessments against benefited property, �nd to make ch�u ges
for the use of such facilities; amending Minnesota Statutes 1945,
Section 459.I4.
Be it enacted by the Legisl.ature of the State of Minnesota:
SECTIOi�': 1. Minnesota Statutes 1945, Section 459.14, is amended to read as
as follo��rs:
459.14. Subdivision 1. A�y city of the second. third, or fourth class, how-
ever organized, and ar�y village or borough may acquire by gift , purchase, or condem-
natioz�proceedings, construct, or otherwise provide, e quip.� maintain ana ol�erate
automobile parking f acilities and may expend municipal funds for these -y�u.rposes.
The term ��automobile parking facilities�� as used in this act includes lots, garages,
or other structures and accessories; such facilities may be surface facilities or
facilities above or under the ground. Provided that no product or service other
than the parki:� of vehicles a,nd the delivery thereof sh�.11 be dispensed or furnish-
� ed �.t or in connection with az�y such parkiag fa.cility.
Subd. 2. An�y auch municipa.lity may pay for any portion of the cost of �ro-
viding automobile parking facilities by levying specia.l assessments ���.inst bene-
fited property. In such ca�se the procedure for such an improvement and assessmen�
and for the issuance of certificates of indebtedness shall be that provided for
street improvements in fourth class cities and villages by Minnesota, 5tatutes,
Sections 434.14 to 434.27 with the exceptiona contained in this Section. Proceed-
ings shall be initiated by a petition for the improvement defining the axe�, pro-
posed to be included in the assessment district and signed by the oumers of real
esta,te in the district equal to at least 50 per cent of the area in square feet oi'
all real estate in the district. The petition shall have the same effect as t he
petition provided for in Section 434.14, If in the opinion of the council, after �,
hearing a.s provided in Section 434.16, the district proposed by the petition in-
�ludes either more or less territory than would be benefited by the improvement ,
�che council sr.�,ll by resolution direct the return of the petition to the petitioners
anci fix the boundaries of the proposed a.ssessment aistrict. The petitioners may
:;l�.�n a.mend the petition. obtain signatures to the amended petition and re-submit it
��� the council. The coSts of providing parking facilities may be a.ssessed upon �11
ui•operty �:�ithin the a.ssessment area., but not in excess of the benefit to the propert�
'"` Subd. 3. Any municipality to which this act �.pplies may issue bonds for the
acquisition, construction or improvement of automobile parking f�cilities. Any
such bonds shall be authorized and issued and solci in the manner prescribed b�r the
la�as of the state or the ch�rter of the municipality for the issuance a,nd authoriza-
tion of bonds thereof for public purposes generally. The amount of all bonds issued
b�t any municipality under this act shall not be included in the net indebtedness of
the municipality or in a.ny comput�.tion of the outstanding indebtedness of the munici-
pality for the purpose of determining the limits of its net indebtedness.
Subd. 4. The governing body of ar�y municipality providing automobile paxking
facilities under this a.ct m�y ch�.rge reasonable fees or rentals for their use and
make such other provision for their operation and m�nagement as it may deem necess���
