REZONING - HARRISON AVENUE
Prouosed Action.
Staff recommends the following motion: Move to adopt Resolution 07-08 approving
Ordinance 07-983, rezoning the two lots north of 17 Harrison Avenue South from B-3 to R-
1-A for first reading.
At the Zoning and Planning meeting Mr. Hatlestad moved and Mr. Aarness seconded a
motion to adopt Resolution RZ07-3, recommending approval of Ordinance 07-983, rezoning
the two lots north of 17 Harrison Avenue South from B-3 to R-1-A. The motion was
approved unanimously.
Overview.
The Excelsior Boulevard reconstruction between Highway 169 and Blake Road was finished
in 2005. Excelsior Boulevard was upgraded and this upgrading process moved the road to
the south. Hennepin County purchased the properties on the south side of Excelsior
Boulevard and created a landscaped buffer between the road and the abutting residential
neighborhood.
The former Surge property was one of the parcels purchased by the County and zoned B-3,
General Business. The County transferred the property south of the east-west alley to the
City. Last year the east-west alley was vacated to add to the new lots. As part of the
redevelopment of these lots, the lots are also being replatted.
Following the rezoning and replatting of the property the City Council will have to declare
the property as surplus and then the property will be sold by a bidding process. The staff will
be recommending placing restrictions on the sale of the property.

Primary Issues to Consider.
What is the Comprehensive Plan designation, and what is the zoning of the
subject site?
The Comprehensive Plan has designated the site as Low Density Residential. The site is
zoned B-3, General Business. The Comprehensive Plan designation will not have to be
amended for the new zoning of R-1-A.
What does the R-1-A zoning allow?
The R-1-A zoning allows single and two family homes. The new lots are approximately
6500 square feet. Atwo-family home requires a lot of 7000 square feet. The only use for
these lots will be a single family home.
Should the site be rezoned from B-3 to R-1-A?
The R-1-A zoning is the zoning of the neighborhood to the south and west side. Before the
site was rezoned to B-3 for Surge, it was zoned R-1-A. Single family homes will be
constructed on the two lots.
What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the rezoning. Ms. Anderson also reviewed the procedure to sell the
property and that restrictive covenants would be placed on the property when it was sold. No
one appeared at the public hearing.
Alternatives.
1. Approve the rezoning. By approving the rezoning, the lots will be rezoned from B-3 to R-
1-A.
2. Deny the rezoning. By denying the rezoning, the lots will remain zoned B-3. If the City
Council considers this alternative, findings will have to be identified that support this
alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN
ORDINANCE REZONING HARRISON AVENUE PROPERTIES FROM B-3 TO R-1-A
WHEREAS, an application for Zoning Amendment ZN07-1 has been initiated by The City of
Hopkins;
WHEREAS, the procedural history of the application is as follows:
1. That an application for zoning amendment was initiated by The City of Hopkins;
2. That the Hopkins Zoning and Planning Commission published notice, held a
public hearing on the application and reviewed such application on January 30,
2007: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered.
4. The legal description of the property is as follows:

Lots 1 and 2, Block 1, East Hopkins Addition
NOW, THEREFORE, BE IT RESOLVED that the application for Zoning Amendment ZN07-1
is hereby approved based on the following Findings of Fact:
1. That the rezoning is necessary for future redevelopment of the site.

THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS
FOLLOWS:
That the present zoning classification of B-3, General Business, upon the following described
premises is hereby repealed, and in lieu thereof, the said premises are hereby zoned as R-1-A,
Single and Two Family.
