PRELIMINARY/FINAL PLAT -FORMER SURGE PROPERTY
Proposed Action.
Staff recommends the following motion: Move to approve Resolution 07-09, approving a
preliminary/final plat for the former Surge Property.
At the Zoning and Planning meeting Ms. Flynn moved and Mr. Skiermont seconded a motion
to approve Resolution RZ07-2, recommending approval of a preliminary/final plat for the
former Surge Property. The motion was approved unanimously.
Overview.
The Excelsior Boulevard reconstruction between Highway 169 and Blake Road was finished
in 2005. Excelsior Boulevard was upgraded, and this upgrading process moved the road to
the south. Hennepin County purchased the properties on the south side of Excelsior
Boulevard and created a landscaped buffer between the road and the abutting residential
neighborhood.
The former Surge property was one of the parcels purchased by the County. The only part of
the property purchased by the County south of the east-west alley was property formerly
owned by Surge. The County transferred the property south of the east-west alley to the
City. Last year the east-west alley was vacated to add to the new lots. This plat that was
prepared for the City will re-plat the two lots south of the east-west alley and include the
vacated alley.

Primary Issues to Consider.
• What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is B-3, General Business. The Comprehensive Plan has
designated the site as Low Density Residential. The property will be rezoned for single
family homes to be constructed on these sites.
Do the lots meet the minimum lot requirements?
The minimum lot size in an R-1-A zoning district is 6,000 square feet; the new lots will be
approximately 6,500 square feet.
What are the specifics of the plat?
The new plat will be two buildable lots and the green area to the north will be an outlot. An
outlot is unbuildable.
Does the proposed plat meet the subdivision requirements?
The proposed subdivision meets the subdivision requirements.
Will a park dedication fee be required?
A park dedication fee is required but because the City owns the property staff is
recommending that the park dedication fee is waived. The City Council has the discretion to
waive the fee. The park dedication fee is $1000.00 per unit.
What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the plat. Ms. Anderson also reviewed ~ the procedure to sell the
property and that restrictive covenants would be placed on the property when it was sold. No
one appeared at the public hearing.
Alternatives.
1. Approve the preliminary/final plat. By approving the preliminary/final plat, the lots will
be replatted.
2. Deny the preliminary/final plat. By denying the preliminary/final plat, the lots will not be
replatted. If the City Council considers this alternative, findings will have to be identified
that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION NO: 07-09
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APRELIMINARY/FINAL
PLAT FOR HARRISON AVENUE PROPERTIES
WHEREAS, an application for apreliminary/final plat SUBD07-1 has been initiated by The City of
Hopkins;
WHEREAS, the procedural history of the application is as follows:
1. That an application for preliminary/final plat was initiated by The City of Hopkins;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published
notice, held a public hearing on the application and reviewed such application on January
30, 2007: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
NOW, THEREFORE, BE IT RESOLVED that the application for apreliminary/final plat
SUBD07-1 is hereby approved based on the following Findings of Fact:
1. That the preliminary/final plat meets the subdivision requirements.
2. That the preliminary/final plat meets the zoning requirements.
BE IT FURTHER RESOLVED that application for preliminary/final plat SUBD07-1 is hereby
approved based on the following conditions:
1. That property is rezoned.
2. That the park dedication fee is waived.
