CONDITIONAL USE PERMIT -DAY CARE
Prouosed Action.
Staff recommends the following motion: Move to adopt Resolution 07-11, approving a
conditional use permit to allow a Day Care at 1420 Mainstreet.
At the Zoning and Planning meeting Mr. Skiermont moved and Mr. Aarness seconded a
motion to adopt Resolution RZ07-4, recommending approval of a conditional use permit to
allow a Day Care at 1420 Mainstreet. The motion was approved unanimously.

Jennifer Halberg is proposing to start a new business with three programs for children. The
three programs are school age child care, a tutoring program, and a supervised visitation and
exchange program. Ms. Halberg is proposing to operate these programs at 1420 Mainstreet.
1420 is located in Central Park Square and is zoned B-3. A conditional use permit is
required for a day nursery in a B-3 district.
Drop N Go Kids Kare will operate a child care program for school age children, kindergarten
through 12 years, with a license capacity of 30 children. The second component will be a
tutoring program with a 30-child capacity and operate during the child care hours. The last
component will be a supervised visitation and exchange program that will be an onsite family
visitation and exchange program with a capacity for two families. The initial hours of
operation are Monday through Friday 6:00 a.m. to 6:30 p.m. The hours may be expanded in
the future depending on the market. Noah's Ark is located in the same location, but serves
infant through preschool children. The programs can utilize Central Park for their outside
play area.

Primary Issues to Consider.
What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property along Mainstreet is B-3, General Business. The Comprehensive
Plan has designated this Commercial. The proposed use is allowed with a conditional use
permit.
What are the conditions for a day care?
The condition for a Day Care Facility is that said operation shall be licensed.
What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the conditions for a conditional use permit for a day care. Jennifer
Halberg, the applicant, appeared before the Commission. Mr. Halberg reviewed the three
programs she is proposing. The Commission indicated that it was a good location for this
type of use. No one appeared at the public hearing regarding this item.
Alternatives.
1. Approve the conditional use permit to allow a day care in the B-3 zoning district. By
approving the conditional use permit the applicant will be able to operate a day care at
1420 Mainstreet.
2. Deny the conditional use permit to allow a day care in the B-3 zoning district. By
denying the conditional use permit the applicant will not be able to operate a day care at
1420 Mainstreet. If the City Council considers this alternative, findings will have to be
identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

This letter addresses proposed business by Drop N Go Kids Kare LLC as a tenant using
3,472 square feet in the Central Park Square facility. Business will be conducted at
1420 Mainstreet, Hopkins, Minnesota, 55343, with plans to begin operation in January
2007.
Drop N Go Kids Kare LLC is owned and operated by Jennifer M. Halberg. Ms. Halberg
is the Chief Manager of all programming, supervising a s#aff team of approximately 12
total members planned by full operation. Scheduled staff will be present during all hours
of programs' operations.
Drop N Go Kids Kare LLC plans operation of the following programs:
o School Age Child Care - Drop N Go will operate a child care program for school
age children ages Kindergarten through 12 years. Drop N Go is applying for
licensure as a Rule 3 Child Care Center through the Minnesota Department of
Human Services. Licensed capacity will be 30 children present on site at any
given time. Planned initial hours of operation are Monday through Friday, 6:00
am through 6:30 pm, with the potential of extended hours through midnight
when market needs call for such scheduling. Terms of license will be amended
with the MN DHS when necessary.
o Tutoring Program - Drop N Go wi{I have tutors available on site to assist school
age children that enroll in additional tutoring. This service capacity will be
included in the 30 person capacity limit and operational hours of the child care.
o Supervised Visitation and Exchange Program - Drop N Go wi[I operate an on-
site family visitation and exchange program. Capacity will allow for two families
to be served at any given time, in the designated visitation rooms. This
program plans to operate Tuesday through Sunday, by appointment only.
Hours will vary due to market needs and to accommodate family schedules.
The facility is currently undergoing preparation for operation and includes a main
classroom, visitation rooms, tutoring area, and office/workroom spaces. Drop N Go's
programs will utilize Central Park's recreational equipment; therefore, no outdoor
playground area or improvements are required. Drop N Go continues planning in
coordination with Landlord to ensure the site's construction and use is appropriate and
within applicable codes and regulations.

RESOLUTION MAKING FINDINGS OF FACT APPROVING A CONDITIONAL USE PERMIT
FOR A DAY CARE AT 1420 MAINSTREET.
WHEREAS, an application for Conditional Use Permit CUP07-1 has been made by Drop N Go
Kids Kare L.L.C.;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit was made by Drop N Go Kids
Kare L.L.C.
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on January 30, 2007: all persons present were given an opportunity to
be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the subject property is as follows:
Beginning on the south line of Excelsior Avenue in the Village of West
Minneapolis, at a point 389 feet west of the east line of the Southwest
Quarter of the Southwest Quarter of Section 24, Township, 117, Range 22;
thence west along the south line of said Excelsior Avenue 239.4 feet;
thence south parallel with the east line of said Southwest Quarter of the
Southwest Quarter of said Section, 350 feet; thence east parallel with said
Excelsior Avenue 239.4 feet; thence north 350 feet to the point of
beginning.
That part of the Southwest Quarter of the Southwest Quarter of Section
24, Township 117, Range 22, described as follows: Beginning on the
south line of Excelsior Avenue in the Village of West Minneapolis, at a
