Approve Driveway Easement - 265 Holly Road
Proposed Action.
Staff recommends adoption of the following motion: Move that Council authorize
the Mayor and City~ger~gn a driveway easement for the property at 265
Holly Road and approve this easement with the condition that the property seller
or buyer pay all associated City Attorney fees.

This is a perpetual driveway easement that will allow ingress and egress from the
property at 265 Holly Road. Many years ago, Holly Road was extended south
beyond the public right-of-way and into City of Hopkins property called "Outlot C".
This outlot parcel was part of the property turned over to the city when the trolley
car property was vacated. As a result, the residential properties that were
developed at the very south end of Holly Road abut this city property and do not
abut a public right-of-way, as is normally the case. Therefore, an easement is
needed in order for the title to be clear regarding access for the property at 265
Holly Road. This property title issue came to light as the property is being sold.
The City Attorney has been working with the seller and buyer and has drafted the
proposed easement and examined the accompanying legal description and
survey.
Staff recommends that City Council approve this easement.

DECLARATION OF EASEMENT
This Declaration of Easement (this ADeclaration~) is made this day of
2007, by the City of Hopkins, a Municipal Corporation under the
laws of the State of Minnesota (ADeclarantC).
RECITALS
A. Declarant is the fee Owner of Real Property in Hennepin County, Minnesota, legally
described as:
Outlots B and C, The Blake School, as contained within Certificate of Title No. 1163918 (the
AReal Property@).
B. Declarant desires to impose upon, subject and burden the Real Property with the
easement established by this Declaration and is executing this Declaration for that purpose.
NOW, THEREFORE, in consideration of the foregoing Recitals and the terms, covenants and
conditions of this Declaration, Declarant declares as follows:
1. DECLARATION OF EASEMENT. Declarant hereby grants, declares, imposes
upon and burdens the Real Property with anon-exclusive, perpetual driveway easement for ingress
and egress (the AEasement@) over and across that part of the Real Property legally described as:

The East 15.0 feet of the North 39.0 feet of the South 44.0 feet of said Outlot C, The Blake
School, Hennepin County, Minnesota, according to the recorded plat thereof (the AEasement
Area@).
The Easement shall run with the title to the Real Property and bind all persons who now or hereafter
have any right, title or interest in the Real Property, their successors, assigns and mortgagees. This
Easement is subject to all other easements recorded against the Real Property. The construction of
any driveway in the Easement Area is subject to all applicable statutes, ordinances, building codes,
or zoning codes.
2. INTERPRETATION. This Declaration is intended to be interpreted in accordance
with Minnesota law, represents the entire agreement and declaration of Declarant with respect to the
Easement and shall run with the title to the Real Property and be binding upon Declarant and its
successors, assigns and mortgagees to the extent herein provided.
