CR 07-044 Environmental Clean-Up Grant Apps-Excelsior CrossingsApril 12, 2007 CITY OF NOPKINS Council Report 2007-044 ENVIRONMENTAL CLEAN-UP GRANT APPLICATIONS - EXCEL510R CROSSINGS Propo ed Action Staff recommends adoption of the following motion: Move to approve Resolution 2007-31 authorizing the submittal of environmental cleanup ` rq ant applications to Minnesota Department of Employment and Economic Development and Metropolitan Council in conjunction with the proposed Opus Corporation's Excelsior Crossings redevelopment rp oject. Overview In 2006 the City applied for and received environmental clean-up grant funds on behalf of Opus Northwest for the environmental remediation of the former SUPERVALU North Annex property. Additional soil contamination was discovered under the structure and throughout the site which was not anticipated and as a result, Opus Northwest has asked the City to support supplemental grant applications to DEED and the Met Council. Applicants for the respective grant funds must be municipalities or other such agencies. Therefore, the City of Hopkins would act as the official sponsor and applicant for these programs. All costs associated with the development of the applications will be paid by Opus Corporation including any local match required. The approximate total amount of the grant requests is $954,000 with Opus contributing $354,000. Primary Issues to Consider Opus Northwest has agreed to assume all costs associated with this grant application. As a result, staff recommends authorizing its submittal. Supporting Information Resolution 2007-31 Ke~ten erum Housin Developme t Coordinator Financial Impact: $_0 Budgeted: Y/N Source: Related Documents (CIP, ERP, etc.): Notes: CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2007-31 RESOLUTION AUTHORIZING APPLICATION TO THE METROPOLITAN LIVABLE COMMUNITIES TAX BASE REVITALIZATION ACCOUNT AND THE DEED CONTAMINATION CLEANUP PROGRAMS WHEREAS, the City has identified aclean-up project within the City located at 9300 Excelsior Boulevard for redevelopment by Opus Corporation that meets the purposes and criteria of these programs; and WHEREAS, the City of Hopkins is a participant in the Livable Communities Act's Housing Incentive Program for 2007 as determined by the Metropolitan Council, and is therefore eligible to make application for funds under the Tax Base Revitalization Account; and WHEREAS, that the City of Hopkins has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate project administration, and WHEREAS, that the sources and amounts of local match identified in the applications are committed to the project, and WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the contract agreements; and WHEREAS, the City of Hopkins has not violated any federal, state, or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. THEREFORE, BE IT RESOLVED, that the City of Hopkins supports the environmental financial grant applications to the Department of Employment and Economic Development and Metropolitan Council, and agrees to act as legal sponsor for the project contained in the applications submitted on May 1, 2007. BE IT FURTHER RESOLVED that upon approval of its applications, the City of Hopkins may enter into an agreement with the State of Minnesota and the Metropolitan Council for the above referenced project.
