CR 07-047 Contamination Investigation Apps-City Center Ventures• G~TY OF April 12, 2007 N O P K I N S Council Report 2007-047 CONTAMINATION INVESTIGATION APPLICATIONS -CITY CENTER VENTURES Proposed Action: Staff recommends adoption of the following motion: Move to approve Resolution 2007- 34 authorizing submittal of contamination investigation grant applications to Minnesota Department of Employment and Economic Development (DEED) and Hennepin County in conjunction with the proposed former Dodge site redevelopment. Overview As part of the proposed redevelopment of the former Dodge dealership on Highway 7 by City Center Ventures, LLC, staff has been asked to support and submit a grant application for environmental contamination investigation to DEED and Hennepin County. Various forms of soil contamination and asbestos appear to exist on the site and must be addressed before any development can occur. Grant funds will be used for additional contamination investigation and Response Action Plan development. Applicants for the grant funds must be municipalities or other such agencies. Therefore, Hopkins would act as the official sponsor and applicant. The developer will be responsible for all costs associated with the application including any local match required. The total amount of the grant request is approximately $67,000. It is anticipated that additional grant funds from DEED, the Met Council and/or Hennepin County will be sought to offset the costs of environmental contamination clean-up once the investigation work is complete. Primary Issues to Consider Existing site contamination must be addressed in order for this property to be redeveloped. The developer will be responsible for assuming all costs associated with this grant application. As a result, staff recommends authorizing the submittal of this application. Supporting Information Resol 'on 7-34 ho ' 'ng Application to DEED and Hennepin County erste Elverum Hou ng & Development Coordinator Financial Impact: $ 0 Budgeted: Y/N Source: Related Documents (CIP, ERP, etc.): Notes: CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2007-34 RESOLUTION AUTHORIZING APPLICATION TO THE DEED CONTAMINATION CLEANUP AND HENNEPIN COUNTY ENVIRONMENTAL RESPONSE FUND PROGRAMS WHEREAS, the City has identified an investigation project within the City located at 1710 Highway 7 for redevelopment by City Center Ventures, LLC that meets the purposes and criteria of these programs; and WHEREAS, that the City of Hopkins has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate project administration, and WHEREAS, that the sources and amounts of local match identified in the applications are committed to the project, and WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the contract agreements; and WHEREAS, the City of Hopkins has not violated any federal, state, or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. THEREFORE, BE IT RESOLVED, that the City of Hopkins supports the environmental financial grant applications to the Department of Employment and Economic Development and Hennepin County Department of Environmental Services and agrees to act as legal sponsor for the project contained in the applications submitted on May 1, 2007. BE IT FURTHER RESOLVED that upon approval of its applications, the City of Hopkins may enter into an agreement with the State of Minnesota and Hennepin County for the above referenced project.
