ZONING ORDINANCE AMENDMENTS -JUNK CARS
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 07-29, adopting Ordinance
07-986, reg_ulatin~ the parking of junk vehicles for first reading.
At the Zoning and Planning Commission meeting Mr. Aarness moved and Mr. Skiermont
seconded a motion to adopt Resolution RZ07-8, recommending adoption of Ordinance 07-986,
regulating the parking of junk vehicles. The motion was approved unanimously.
Overview.
For the past several months the Commission has been reviewing proposed language on the
parking of junk cars in the business and industrial districts. The problem that is occurring is an
auto repair business or auto body business that has vehicles waiting to be worked on and has
left them parked on a site for a long time because the vehicle is waiting for parts.
Attached is proposed language for the parking of vehicles in the business and industrial districts
that are considered junk vehicles. Junk vehicles will be allowed to remain for 30 days on a site
unless the vehicle is being processed for a sheriff sale. The City Attorney reviewed the
language. Currently junk vehicles are not allowed to be on any property for any amount of
time.

Primary Issues to Consider.
What is the proposed amendment?
Junk vehicles. The parking of junk vehicles, as defined in Section 515.07 Subd. 93, for more
than 30 days within any business district (B-1, B-2, B-3, or B-4), or industrial district (I-1 or I-
2) is prohibited, including the parking of vehicles awaiting repair. An additional 150-day
extension may be obtained for vehicles awaiting Sheriff's sale upon application to the City
Planner and presentation of evidence sufficient to the Planner of intent to sell the vehicle at the
Sheriff's sale.
What is the staff recommendation?
Staff is recommending approval of the proposed ordinance.
What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed amendment. Ms. Anderson noted that the Commission
had reviewed the proposed language at the previous meetings.
Greg Smith, the owner of 2011 Mainstreet, appeared before the Commission. Mr. Smith asked
if the Commission would consider a longer time period than 30 days. Alexandra and Max
Teplitski of 525 Mainstreet appeared before the Commission. Mr. Teplitski also asked for a
longer time period than 30 days.
Alternatives.
1. Approve the amendment to the zoning ordinance. By approving the amendment to the
zoning ordinance, the parking of junk cars in the business and industrial districts will be
limited to a period of 30 days.
2. Deny the amendment to the zoning ordinance. By denying the amendment to the zoning
ordinance, the parking of junk cars in the business and industrial districts is not allowed. If
the City Council considers this alternative, findings will have to be identified that support
this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION NO: 07-29
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING AN ORDINANCE AMENDMENT REGULATING THE PARKING OF JUNK CARS
WHEREAS, an application for Zoning Amendment ZN07-3 has been initiated by the City of
Hopkins;
WHEREAS, the procedural history of the application is as follows:
1. That an application for zoning amendment was initiated by the City of Hopkins;
2. That the Hopkins Zoning and Planning Commission published notice, held a
public hearing on the application and reviewed such application on March 27,
2007: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered.
NOW, THEREFORE, BE IT RESOLVED that the application for Zoning Amendment ZN07-3
is hereby approved based on the following Findings of Fact:
1. That the proposed amendment protects the health, safety, and welfare of the
community.

THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS FOLLOWS:
That Sections 550 of Hopkins Code of Ordinances be, and the same and are hereby amended by
amending and adding the following section:
Section 550 -Zoning: off-street parking
Subd. 10. Junk vehicles. The parking of junk vehicles, as defined in Section 515.07 Subd. 93,
for more than 30 days within any business district (B-1, B-2, B-3, or B-4), or industrial district
~I-1 or I-2 is prohibited, including the parking of vehicles awaiting repair. An additional 150-
day extension may be obtained for vehicles awaiting Sheriff's sale upon application to the CitX
Planner and presentation of evidence sufficient to the Planner of intent to sell the vehicle at the
Sheriff's sale. '
