COMPREHENSIVE PLAl\' AMENDMENT - OAK RIDGE PLACE II
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 05-70 approving a
Comprehensive Plan amendment from Institutional to High Densitv Multiple Familv for the
site northeast of the Eisenhower Communitv Center.
At the Zoning and Planning meeting Mr. Paul moved and Mr. Aamess seconded a motion to
adopt Resolution RZ05-22, recommending approval of a Comprehensive Plan amendment
from Institutional to High Density Multiple Family for the site northeast of the Eisenhower
Community Center. The motion was approved unanimously.
Overview.
Mike Halley, the applicant, is proposing to construct a 14-16 unit condo building on the
property just west of the condo building Mr. Halley is constructing north of the United
Methodist Church. The proposed building will be located on property that was owned by the
Schoo] District on the northeast side of the Eisenhower Community Site. The proposed
building would be four stories and ha,e underground and surface parking
The Comprehensive Plan has designated this site as Institutional. The School District
property will remain Institutional.

Primarv Issues to Consider.
. How has the Comprehensive Plan designated the subject site?
The Comprehensive Plan has designated the site as Institutional. There is a requirement that
the Comprehensive Plan and zoning be consistent. With the proposed zoning change, the
zoning and the Comprehensive Plan designation will be consistent.
. What is the difference between the Institutional and High Density Residential
designations'?
An Institutional zoning allows single-family homes and two-family homes as permitted uses.
Schools and religious institutions are allowed as conditional uses. The High Density
Residential designation allows high density mulliple family buildings.
. Should the site northeast of the Eisenhower Community Center designation be
changed?
In looking at the area, the only logical change would be to amend the Comprehensive Plan to
a multiple family designation. The site would not be a commercial, industrial or a single-
family area. The area to the east is condos, to the north is the golf course, the south and west
property is owned by the School Distnct.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson stated that the Comprehensive Plan will have to be amended so that the
zoning is consistent with the Comprehensive Plan. No one appeared at the public hearing
regarding this item.
Alternatives.
I. Approve the Comprehensive Plan amendment. By approving the Comprehensive Plan
amendment, the applicant will be able to constlUct the condos as proposed.
2. Deny the Comprehensive Plan amendment. By denying the Comprehensive Plan
amendment, the applicant will not be able to constlUct the condos as proposed. If the
City Council considers this altcrnative, findings will have to be identified that support
this alternativc
3. Continue for further information. If the City Council indicates that further
information is needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF A COMPREHENSIVE PLAN AMENDMENT
FOR OAK RIDGE PLACE II
WHEREAS, an application for Zoning Amendment ZN05-8 has been made by Mike
Halley;
WHEREAS, the procedural history of the application is as follows:
I. That an application for a comprehensive plan amendment was made by Mike
Halley on June 24,2005;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on July 26,2005: all persons present were given an opportunity to be
heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the subject property is as follows:
All ofthe following described tract lines north of the centerline of Highway No 7:
That part of the west 247.5 feet of the west Yz of the northeast quarter and that part of the
Northeast Quarter of the Northwest Quarter of Section 24, Township 117, Range 22 lying
north of the centerline of Minnetonka Mills Avenue as shown on the plat of "West
Minneapolis Second Division."
The north 40 feet of the east 85 feet of the westerly 247.5 feet of the Northeast Quarter of
Section 24, Township, 117 Range 22 (said distance being measured along the north line
of said Northeast Quarter). Together with an easement for ingress and egress purposed
over, across and upon that part of the east 33 feet of the west 247.5 feet of said Northeast
Quarter of the said Section 24 lying north of State Highway No.7.
NOW, THEREFORE, BE IT RESOLVED that the application for Comprehensive Plan
Amendment ZN05-8 is hereby approved based on the following Findings of Fact:
1. That the amendment to the Comprehensive Plan will make the zoning and the
land use plan consistent.
BE IT FURTHER RESOLVED that application for Comprehensive Plan Amendment ZN05-8 is
hereby approved based on the following conditions:
I. That the Metropolitan Council approves the proposed amendment.
