PRELIMINARY PLAT-OAK RIDGE PLACE II
Proposed Action.
Staff recommends the following motion: Move to approve Resolution 05-71. approving a
preliminary plat for the Eisenhower Community Center property.
At thc Zoning and Planning meeting Ms. Aristy moved and Mr. Paul seconded a motion to
approve Resolution RZ05-24, recommending approval of a preliminary plat for the
Eisenhower Community Center propeliy. The motion was approved unanimously.
Overview.
Mike Halley, the applicant, is proposing to construct a 14-16 unit condo building on the
property just west of the condo building Mr. Halley is constructing north of the United
Methodist Church. The proposed building will be located on property that was owned by the
School District on the northeast side of the Eisenhower Community Site. The proposed
building would be five stories and have underground and surface parking.
In order for the condos to be constructed on the northeast side of the lot, the lot needs to be
divided into two lots. The applicant has also applied for a rezoning, Comprehensive Plan
amendment, variance for a lot with no frontage on a public right-of-way and a site pla.n
review to construct the building.

Primarv Issues to Consider.
. What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is Institutional. The Comprehensive Plan has designated the site
as Institutional. The applicant has applied for a rezoning and Comprehensive Plan
amendment.
. Do the lots meet the zoning requ!rements?
The minimum lot size in an R-5 zoning district is 24,000 square feet; the new lot will be
51,896 square feet. The minimum lot size for an institutional zoning district is 20,000 square
feet; the lot on which the school will be located is welI over 20,000 square feet.
The school will have the minimum setbacks on the northeast side when the lot is divided.
. What are the specifics of the plat?
The lot will be divided into two lots. The new lot will be an approximate triangle lot with a
47 40-square- foot outlot access to the frontage road to be used in the future if a road is
needed. The City property on the north side of the lot will also be platted as an outlot.
. Docs the proposed plat meet the subdivision requirements?
The proposed plat meets the subdivision requirements with the exception of frontage on a
right-of-way. The applicant has requested a variance.
. Will a park dedication fee be required?
A park dedication fee will be required. The fee is $800 per unit.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson stated that this was onl y the preliminary plat and they will be back for a final
plat. No one appeared at the public hearing regarding this item.
Alternatives.
I. Approve the preliminary plat. By approving the preliminary plat, the applicant will be to
divide as proposed.
2. Deny the preliminary plat. By denying the preliminary plat, the applicant will not be able
to divide the property as proposed. If the City Council considers this alternative, findings
will have to be identified that support this alternative.

3. Continue for fUliher information. If the City Council indicates that further infonnation is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A PRELIMINARY PLAT FOR
OAK RIDGE PLACE 11
WHEREAS, an application for a preliminary/final plat SUBD05-4 has been made by Mike Halley; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for a preliminary/final plat was made by Mike Halley, on June 24,
2005;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published
notice, held a public hearing on the application and reviewed such application on July
26,2005: all persons present 'Nere given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
NOW, THEREFORE, BE IT RESOLVED that the application for a preliminary plat SUBD05-4
is hereby approved based on the following Findings of Fact:
I. That the preliminary plat meets the subdivision requirements.
2. That the preliminary plat meets the zoning requirements.
Adopted this 3rd day of August 2005.
