Proposed Action
Staff recommends adoption of the following motion: "Move that Council adopt Resolution 2002-
77, resolution authorizinl2. the Mayor and City Manager to sign and execute an agreement with
Canadian Pacific Railroad for the l:Onstruction of permanent concrete railroad crossing on 5tll
Street South at a cost not to exceed $150,000."
Overview
In recent-years, the rubberized and asphalt rai Iroad crossing at 5th Avenue South has been rapidly
deteriorating. The City's current annual Capital1mprovcmcnt Plan (eIP) identifies this segment
of 5th A venue South for reconstruction in 2003. Improvements for this crossing \vere identified in
the project feasibility report as a part of that 5,h Avenue South project. While going through the
planning stages for that project, the City was contacted by Canadian Pacific (C.P.) Railroad about
needing to close 5th Avenue South down for a couple of days before November 2002 to perform
maintenance repairs on the rail in the crossing location. City staff inquired about the possibility
of installing a new permanent concrete crossing at the same time to maximize efficiency and to
help minimize the time the roadway would be closed during the project. C.P. Railroad
generously expressed their willingness to rearrange their fall schedule to construct the permanent
concrete crossing this year, if the City would be able to commit to paying for the construction
improvements. The crossing improvements are estimated to cost $150.000 and are estimated to
require the roadway to be closed for about a week. Closure at this time will allow us to avoid
. another longer closure with the 5(/1 Avenue project. A detour route will need to be set up (for
SuperValu Trucks, etc.) during the closure period. Staff has d iscllssed the potential detour routes
and we feel that using 2"d Avenue South to get traffic to and from Hwy ] 69 would be the most
direct and cause the least disruption possible. We fully expect to notify all potentially affected
residents (especially along the 2"d A venue neighborhood) and businesses at least one week prior
to closure and will install netollr and advance notice signage.
Primary Isslles to Consider
· Cost, Funding, City Benefit, and Recommendation:
Since the railroad crossing improvement costs are not assessable per the City's
assessment policy, the City would need to pay 100% of the improvements. Staff has
identified two potential funding sources (PIR and TIF) to pay for these improvements.
At this time, staff is proposing to stay consistent \vith the feasibility report and fund the
crussing improvements with rIR funds. Staff will continue to research the potential of
llsing TIF funding and will repOlt back at a later time if TIP turns out to be a viable
revenue source in light of the North Annex redevelopment. With either fund or a
combination of the two, staff feels that it is in the best interest of the City to give formal
approval to construction of these improvements in 2002 and recommends approval of this
agreement at a cost not to exceed $150,000.

RESOLUTION 2002-77
Resolution authorizing the Mayor and City Manager to sign and execute an
agreement with Canadian Pacific Railroad for the construction of permanent
concrete railroad crossing on 5th Street South at a cost not to exceed $150,000
WHEREAS, the current rubberized and asphalt railroad crossing at 5th A venue South has
deteriorated to the point where it is in need of upgrading improvements through the
reconstruction of the roadway crossing by installing a new permanent concrete railroad crossing;
and
WHEREAS, the railroad crossing at 5th Avenue South is controlled by the Canadian
Pacific Railroad; and
WHEREAS, the Canadian Pacific Railroad is needing to perform temporary maintenance
. measures on the raitway before November 2002, which would necessitate the closing of 5th
A venue South; and
WHEREAS, City staff is requesting that the railroad crossing be upgraded to a
permanent concrete railroad crossing using any combination of PIR or TIF funding that may be
available, as these improvements are not assessable under the City's assessment policy; and
WHEREAS, the estimated cost for installation of this permanent concrete railroad
crossing is $150,000.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of tile City of Hopkins,
Minnesota, that the Mayor and City Manager are hereby authorized to sign and execute an
agreement with Canadian Pacific Railroad for the construction of permanent concrete railroad
crossing on 5lh Street South at a cost not to exceed $150,000.
