Approve Compensation Amounts for Easement Acquisition -
Excelsior Boulevard Reconstruction, Phase"
Proposed Action.
Staff recommends adoption of the following motion: Move that Council approve
compensation amounts, as presented bV staff, for acquisition of temporary and
permanent easements required for the Excelsior Boulevard Reconstruction, Phase II
project.
Overview.
In January 2002, City Council authorized acquisition of required right of way and
easements for the Excelsior Boulevard, Phase 1/ project. Fair compensation for
permanent and temporary property acquisition has been determined based on County
and City Assessor data. City Council is now being asked to approve these
. compensation amounts before the City submits formal offers to property owners. These
acquisitions are those required due to construction of the new Excelsior Blvd/Milwaukee
StlJackson Avenue intersection. Hennepin County Real Estate Office will complete all
other necessary acquisitions. The affected parcels are those shown on the attached
drawings. Evergreen Land Services Co. staff will be available at the City Council
meeting to answer questions on how the various land values/proposed compensation
were determined.

. What happens if a property owner rejects an offer?
Evergreen Land Services personnel will attempt to negotiate a settlement near the
proposed amount. If agreement cannot be reached, then the property would have to be
acquired through the condemnation process.
