Staff recommends the following motion: Move to approve Resolution 02-66. approving a preliminary/final plat for the lots on 1 ih A venue South At the Zoning and Planning meeting, Me Bartz moved and Mr. Thompson seconded a motion to approve Resolution RZ02-16, recommending approval of a preliminary/final plat for the lots on lih Avenue South. The motion was approved unanimously. Overview. The applicant, Metro Water Conditioning, Inc., is proposing to construct a building on two vacant lots on 12th Avenue South. This was the former site ofa caT storage lot. Metro Water Conditioning is currently located at 740-11 th A venue South. The building will be used for an office and warehouse. The applicant is proposing to construct a 60' x 80' building on what is two vacant lots on lih Avenue South. The two vacant lots are 50'x 130' and will become one 100' x 130 lot. In order for the applicant to construct the building, the lots will have to be re-platted to combine the lots into one. The building code will not allow a lot line to run . through a building. CR02-113 Page 2 . Primary Issues to Consider. . 'Vhat is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The zoning of the property is 1-1. The Comprehensive Plan has designated the site as Industrial. The zoning and the land use comply with the proposed uses. . Do the lots meet the zoning requirements? The minimum lot size in an 1-1 district is 10,000 square feet. The proposed lot is 13,000 square feet. The lot as proposed meets the zoning requirements. . What are the specifics of the plat? The lots will be combined into one lot. . Does the proposed plat meet the subdivision requirements? The proposed plat meets the subdivision requirements. . . WiIJ a park dedication fee be required? A park dedication fee will be required when the building permit is issued. . What was the discussion at the Zoning and Planning meeting? This item was discussed with the conditional use permit request. Alternatives. 1. Approve the preliminary/final plat. By approving of the preliminary/final plat, the lots will be combined into one lot. 2. Deny the preliminary/final plat. By denying the preliminary/final plat, the lots will remain as two lots. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. WHEREAS, an application for a preliminary/final plat SUBD02-3 has been made by Metro Water Conditioning, Inc; WHEREAS, the procedural history of the application is as follows: 1. That an application for a preliminary/final plat was made by Metro Water Conditioning, Inc., on April 23, 2002; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published I notice, held a public hearing on the application and reviewed such application on May 28, 2002, and June 26: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and . 4. A legal description of the subject property is as follows: Lot 1 Block 1 Downey Addition NOW, THEREFORE, BE IT RESOLVED that the application for a preliminary/final plat SUBD02-3 is hereby approved based on the following Findings of Fact: 1. That the preliminarylfinal plat meets the subdivision requirements. BE IT FURTHER RESOLVED that application for a preliminary/final plat SUBD02-3 is hereby approved subject to the following conditions: 1. That the park dedication fee is paid.
