Adopt Resolution Amending Legislative Policy #8-B, Roadway Improvements

Proposed Action.
Staff recommends adoption of the following motion: Move that Counci! adopt
Resolution 2004-032, resolution amending Legislative Policy #8-B, Roadway
Improvements to limit the number of special assessments to residential property
owners.
Overview.
There is a need to amend the current assessment policy to protect residential property
owners from excessive multiple assessments for street and alley improvements. Partly
as a result of discussions with residents regarding the 2003 5th Avenue improvement
project, City Council decided to consider such a policy revision. At the February 24,
2004 council Worksession, City staff presented for discussion several options for
limiting property exposure to multiple assessments. It was agreed that the mast
equitable, straightforward, easily tracked method, for both city staff and residents, would
be to limit the number of assessments. The proposed resolution authorizes amending
the legislative policy language to effect this assessment policy change.

Primary Issues to Consider.
• Details of proposed revision
The special assessment limit of two would apply to residential properties only. If
residents petitioned for a street or alley improvement, the resulting assessment would
not apply toward the cap. Similarly, if City Council determined that there was an
emergency situation requiring street or alley improvements, that potential resulting
assessment would not apply toward the cap.
• Impact to street ar alley improvement programs
Staff has determined that this assessment policy change want negatively affect the
city's ability to fund our future street improvements. Staff will be able to plan our future
street improvements in such a way as to not exceed two assessments in any project
area. The at#ached city map shows parcels that have had assessments placed against
them since 1991 and also shows parcels with the potential of two assessments
• considering the current street capital improvement plan.

BE IT RESOLVED BY THE CITY COUNCIL OF HOPKiNS, MINNESOTA,
WHEREAS, City Council does not want residential property ov~mers to be financially burdened
by multiple assessment payments for street or alley improvements; and
WHEREAS, City Council desires to continue adequate maintenance of the city's pavements
infrastructure; and
WHEREAS, the current legislative policy #SB should be updated to reflect the current
designated state aid streets; and
WHEREAS, the current legislative policy #8B should be amended to Iimit the application of an
assessment rate cap to residential properties only;
NOW, THEREFORE BE 1T RESOLVED, that the City of Hopkins hereby amends Legislative
Policy #S-B, Roadway Improverr~ents as shown on the attached revised policy document.

6. MUNICIPAL STATE AID STREETS
6.01 Recent regulations allow a municipality to designate up to 20% of its existing street
mileage, excluding coL~nty state aid highways and state trunk highways as MSA streets.
The City of Hopkins currently has approximately 9.0 miles designated as MSA streets.
The City receives MSA funds on an annual basis and are allotted for maintenance and
construction of MSA streets. This money is part of the gasoline tax collected in
Minnesota and is apportioned to the comm~u~ity according to state guidelines based on
population and road needs. Maintenance fLU1ds are sent automatically to the City each
year while the construction funds are held in an account by the state until the time
construction contracts are awarded.

11.04 Assessment Caps
1. Maximum er foot assesstntnt: The maximum per foot assessment amount to

120% of the average per foot assessment on the previous three similar street
reconstruction projects. This cap applies only to total street reconstruction
costs {public improvements} and the associated assessments._ It does not apply
to partial reconstruction, i.e. curb replacement and asphalt overlay or frill-depth
milling/overlay or other assessable roadway improvements. The cast of special
neighborhood requests which are non-standard construction items are excluded
when comparing the current project assessment to the assessment cap amount.
The project feasibility report will include the per foot assessment cap amount.

11.05 In certain unusual cases assessments may be determined by a "fair" comparison to other
assessed property. This will be determined by the Engineering Division of Public Works
and can be appealed to the City Council.
