Adopt Resolution Setting City Policy on Street Load Restrictions
Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt
Resolution 2002-24, Resolution SettinQ City Policy on Street Load Restrictions.
Overview.
Each year the City restricts heavy trucks from driving on local streets during the spring
thawing time period. It is during this time that streets are most vulnerable to structural
damage due to weak underlying gravel layers and subgrade soils. The Minnesota
Department of Transportation provides information on load restriction dates based on a
formula using current and forecasted temperatures. The city uses the same dates in
establishing and removing local road restrictions. The spring load limit on local streets
is 4 tons per axle. The proposed policy would allow a 5 ton/axle limit depending on the
travel route. The proposed resolution states the need for load restrictions, the authority
to impose them and a permit process to allow and control, on a case-by-case basis,
. trucks to exceed the load limits as approved by the City Engineer. If approved, staff
would create a new Legislative Policy 81, City Street Load Restrictions.
Primary Issues to Consider.
. Specifics of permit process
If a hauler requests to exceed the load limits, they will be directed to complete the
permit form. This will provide details on the company, the requested route, and dates.
Typically, the street superintendent and city engineer will discuss the request, including
the road conditions along the requested route and dates requested. They will then
make any changes to the route and decide on a deposit amount based on the length of
travel and condition and type of street/s to be used. This is similar to what has been
done in the past with the exception of the permit form and deposit.

be determined by the City Engineer. such amount to be based upon the
anticipated potential damage which could be occasioned by such hauling, (City Engineer)

WHEREAS, for the public safety and welfare, it is necessary to protect and preserve the public's
investment in the streets and roads of the City of Hopkins from premature deterioration
and break-up occasioned by the alternate thawing and freezing cycle experienced in the
late winter and early spring, and
WHEREAS, in order to minimize the aforementioned damage to our streets and roads, and
pursuant to the authority contained in Section 169.87, the City posts load limits on
certain of its streets and roads, and
WHEREAS, in order to facilitate the movement of goods and materials, particularly those
delivered to construction sites, it may be necessary to permit overweight vehicles on
certain streets and roads.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Hopkins
that it is the policy of the City of Hopkins that load limits shall be established at such
times and on such streets and roads throughout the City of Hopkins as shall be
determined by the City Engineer and Street Superintendent.
. BE IT FURTHER RESOLVED that in the event private parties desire to exceed these load
limits, they shall obtain a permit from the City Engineer, and they shall be required to
submit to the City cash or a certified check in an amount to be determined by the City
Engineer, such amount to be based upon the anticipated potential damage which could
be occasioned by such hauling, and
BE IT FURTHER RESOL YED that the City Engineer shall be authorized to revoke any such
overweight permits when, in his judgment, substantial damage is being caused to the
street or road, and
BE IT FURTHER RESOL YED that the City Engineer shall be authorized to deduct from paid
cash deposit, any sums necessary to restore the street to its design standards in the event
of damage, following the expiration or revocation of an overload permit, or the lifting of
load limits, and
BE IT FURTHER RESOL YED that it shall be the policy of the City of Hopkins to presume that
any damages occurring on any street or road over which vehicles have permission to
travel overweight, shall have been caused by said vehicles.
