Overview
At the November 8, 2000, meeting, the Hopkins City Council authorized the City Engineer to prepare a
feasibility study concerning alley improvements in the 200/300 Block between 19th Avenue North and 20th
A venue North. The report was presented to Council at its April 2, 2002, meeting, and a public hearing was
ordered for May 7, 2002. Hearing notices have been mailed to all affected property owners of record. Two
neighborhood information meetings were hclcl on November 14, 2000, and March 2 L 2002, to discuss and share
general project information and the information in the repOlt with the affected property owners. In accordance
with state statutes, Council needs to conduct the public hearing and determine authorization of the project.
Following the public hearing and potential authorization of the project, Council is then asked to state the City's
intent to sell revenue bonds 10 fund the project through resolution adoption.

. Scope of Improvements:
This project provides for the construction of a concrete pavement surface 10 to 18 ['eet wide and 6 inches
thick, in accordance with the City of Hopkins' concrete alley construction standard. The additional width,
up to 1 8 feet. is needed tor the east-\:vest alley segment for City maintenance and refuse pickup purposes.
Existing grade and erosion issues are proposed to be improved by using a new alley rrofile. 8 inch integral
curb in some areas, riprap. and erosion control blanket on steep slopes. A utility pole that has caused
obstruction problems {or both the n:sidents and the City refuse collectors vvill be moved along \\lith the
project. City staff investigated the possibility' of burying of the Lltility lines in the area and determined this
was not feasible with this project mainly because of cost and conflict issues.
The project IS necessary to correct maintenance problems caused by inadequate alley surfacing.
Maintenance problems include high maintenance costs for adding graveL maintailllng a gravel surt~lce,
controlling erosion. and other problems associated with overall poor drainage.
. Project Funding:
It is proposed that the comTete pavement project be assessed in accordance ,vith the City of Hopkins'
current assessment policy. wllerein 8U% of the cost is assessed to abutting properties and 20% is funded as a
City cost. It is further proposed that the City's portion of the costs be paid entirely from the storm sewer
utility fund. in accordance with City policy. Additional drainage improvements at Hilltop Park at the n011h
. end of the alley dead end \VOldd also be paid ham the storm sewer utility fund.
Because there are such unique circumstances surrounding this project site, including the unusual "L ,- shaped
functional nature of this alley, staff feel s that the fairest method to assess this project is on a per-unit basis
rather than on an abutting linear footage basis as is usually done with alley assessments, and that each
abutting property be assessed the same. as they all have equal eligibility to use the alleyway. This
assessment method is consistent v./ith past assessments tor Hopkins alley projects hy assessing each abutting
property in the same manner even though every property doesn't currently use the alleyway for their primary
driveway access. As mentioned above, each property has the same eligibility to lIse the alley and the
potential for future redevelopment or changes to each of the propeliies means each property should be
assessed in the same manlier. The City stalTis also ofthe opinion tllat the computation for the costs eligible
for assessment should be based otT a I O-foot-vvide alley section for the entire length of the functional
alleyway because the additinnal R-lont width for the east \vest portion is needed to benefit the City for
maintenance and refuse pickup purposes. Preliminary estimated amnunts ror assessments CLlI11putcd in
accordance \vith the per-unit I O-loot alley method outlined above have indicated assessments in the range of
approximately $ 1,993 per unit. This amount is consistent witl] assessment amounts for other recent alley
projects in the City of Hopkins. The costs associated with this additional width would come out of the PIR
Fund. The eIP budget for the proposed project is $50,000.

I Public Input and Project Schedule:

A public information meeting was held for all of the affected property owners on November 14, :2000 and
. March 21. 2002. and a residenl survey questionnaire was sent in the mail. Responses and feedback gathered
at both the public information meeting and through the returned questionnaires have generally been both
constructive and positive. The input received from the meeting and the questionnaires \vil! continue to be
used and addressed throughout the final design process should the project be approved.
Many of the issLles brought up by tbe residents were addressed and planned fin' \vith the feasibility study and
the preliminary project design. These issues included side yarlt drive\vay, and alley drainage, utility pole
obstruction. and erosion concerns. During the informational meetings, it was brought up that perhaps the
residents who have garages that directly use the alley and are dependant on lhe alley for access should pay
more than those who are nol as dependant on the alley for access. It was discLlssed at the meeting that in
accordance with the Hopkins assessment policy and keeping consistent with other alley assessments in
Hopkins, parcels abutting the alleyways are looked at as having equal rights (either on a linear footage or a
per unit basis) and ability to use the alleyway both now and with potential future development of the parcels.

2. A public infoTIllation meeting be held prior to the public improvement hearing. Notice of
this meeting should be provided to affected property owners.
3. The project be assessed in accordance with the City's Assessment Policy.
Introduction
For a number of years the City of Hopkins has identified concrete alley paving projects to
improve the function, drainage, and maintenance of many problematic City alleyways. The
2000-2004 Capital Improvement Plan (CIP) first identified an alley paving project for the alley
west of 19lh A venuc North, north of 3 rd Street North for the year 2002. Subsequent Capital
Improvement Plans (2001-2005 and 2002~2006) have continued the identification of this alley
for reconstruction in 2002 due to its designation as poor on the alley condition survey. On
November 8, 2000, the Hopkins City Council adopted a resolution ordering the preparation of a
feasibility report for this project. At the time, consideration was being made to possibly
construct the project in 2001 rather than 2002. It was determined that the alley required
upgrades with concrete paving due to the poor drainage ancl deteriorated condition of the alley.
When one of the properties on the alley decided to remove and replace their garage in 2001, it
...... was detcrmined by staff that reconstruction of the alley should not take place until 2002 as
originally planned in the CJP.

Background
. The alley under consideration is the only roadway access to two properties located between
Hilltop Park and 19th Avenue North in the #300 block. The alley connects with a short improved
section of 3rd Street North and thence to 19 A venue North. The existing alley is constructed with
a gravel! bituminous millings surface that is considerably deteriorated. Maintenance is an on-
going issue because of an increasing need for filling in and patching various areas due to erosion,
sluffing, and rutting. Issues of drainage arise in att<:mpting to channel storm runoff into 3rd Street
or to an established low area adjacent to Hilltop Park. There are also issues of vehicle maneuvers
for trash collection and snow removal. The combination of a poor surface section and inherent
drainage problems has led to the increased rate of deterioration of the alley. The result is that
levels of maintenance have grown larger.
Proposed Improvements
The proposed alley improvement projects are presented on the attached plan sheet The project
provides for the construction of a concrete pavement surface 10 to 18 feet wide and 6 inches
thick, in accordance with the City of Hopkins' concrete alley construction standard. The
additional width, up to J 8 feet, is needed for the east-west alley segment for City maintenance
and refuse pickup purposes. Existing grade and erosion issues are proposed to be improved by
using a new alley profile and 8 inch integral curb in some areas.
. The existing bituminous driveways will be sawcut and restored with bituminous driveway
pavement upon completion of the concrete alley paving. Existing gravel driveways will be
replaced with similar gravel materials of equal or greater depth than existed previous to the alley
reconstruction. There will be no sod restoration within the limits of this project. Any turf
restoration required by the project win be accomplished with black dirt and seed. An erosion
control blanket will be used to help establish vegetation on existing steep slopes while preventing
eroSIOn.
The concrete alley paving will consist 0 f an inverted crown section, which is slightly depressed
in the center to allow storm runoff within the alley sectiun versus ponding in the adjacent
properties. The pavement grade wi II be establ ishcd to direct the runoff to the respective Hilltop
Park and 19th Avenue North.
A utility pole, located withiil the north~south right of way is proposed to be relocated in
conjunction with the project to allow for bettcr access to driveways off the alley and remove a
potential obstruction.
It is anticipated that all new alley construction will be limited to the existing 12 foot north-south
and 60 foot east-west respective right-of-ways; however, driveway restoration will extend up to
five feet beyond the limits of the existing public right of way where it is only 12 feet wide
(north-south). Temporary construction easements may be needed to help better facilitate
construction activities. The 60 foot east-west right-of-way segment is an extension of the 3nJ
. Street N011h right-of-way but functions as and will remain an alley segment due to grade and
right-of-way issues. As mentioned above, an 18 foot alley segment will be installed in this
section for City maintenance and refuse collection purposes. The construction will also require a
concrete apron at the intersection with 191h A venue North.

and 20% is funded as a City cost. It is further proposed that the City's portion of the costs be
paid entirely from the storm sewer utility fund, in accordance with City policy. Additional
drainage improvements at Hilltop Park at the north end of the alley dead end would also be paid
from the storm sewer utility fund.
Because there are such unique circumstances sUlTounding this project site, including the unusual
"L" shaped functional nature of this alley, staff feels that the fairest method to assess this project
is on a per unit basis rather than on an abutting linear footage basis as is usually done with alley
assessments, and that each abutting prope11y be assessed the same as they all have equal

for assessments computed in accordance with the per unit 10 foot alley method outlined above
have indicated assessments in the range of approximately $1,993 per unit. This amount is
consistent with assessment amounts for other recent alley projects in the City of Hopkins. The
custs associated with this additional width would come out of the PIR Fund.

Recommendations and Conclusions
The project is necessary to con-ect maintenance problems caused by inadequate alley surfacing.
Maintenance problems include high maintenance costs for adding gravel, maintaining a gravel
surface, controlling erosion, and other problems associated with overall poor drainage. The
project is feasible, cost effective, necessary, and it is part of the City's annual alley paving
program. The City plans for necessary capital improvements annually to coordinate other work
ancI ensure that necessary improvements are provided in a timely and cost-effective mamler. The
concrete alley paving project is teclmically feasible from an engineering standpoint and it is
reC0I1U11ended that the City Council accept the project engineer's feasibility report as outlined
. herein, and order the improvement made, subsequent to holding a public hearing. Addended to
the end of this report is a summary of the estimated construction costs and a preliminary project
schedule for the City Council's consideration.

RESOLUTION ORDERING IMPROVEMENT AFTER PUBLIC HEARING
2002 ALLEY RECONSTRUCTION PROJECT
CITY PROJECT 00-12
WHEREAS, a resolution of the City Council adopted the 2nd day of April 2002
fixed a date for a Council Hearing on the proposed improvement of alley reconstruction
in the 300 Block between 19th Avenue North and Hilltop Park, including concrete
pavement and curb installation, drainage and erosion control improvements, and all
necessary appurtenances, and
WHEREAS, the Council deems it appropriate and expedient to make such
improvements, and
WHEREAS, ten days mailed notice and two weeks published notice of the
hearing was given, and the hearing was held thereon the 7th day of May 2002, at which
all persons desiring to be heard were given an opportunity to be heard thereon,
. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Hopkins, Minnesota:
1. Such improvement is hereby ordered as proposed in the Council
resolution adopted the 2nd day of April 2002.
2. The City Engineer is hereby designated to prepare plans and
specifications for the making of such improvement.

RESOLUTION NO. 2002-39
DECLARING THE OFFICIAL INTENT OF THE CITY OF HOPKINS
TO REIMBURSE CERTAIN EXPENDITURES FROM
GENERAL OBLIGATION IMPROVEMENT BOND PROCEEDS
TO BE ISSUED BY THE CITY OF HOPKINS
WHEREAS, the Internal Revenue Service has issued Treas. Reg. #1.150-2
providing that proceeds of tax-exempt bonds used to reimburse prior expenditures shall
not be deemed spent unless certain requirements are met; and
I WHEREAS, the City expects to incur certain expenditures, which may be
financed temporarily from sources other than bonds and reimbursed from the bond
proceeds;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
. OF HOPKINS, MINNESOTA (THE CITY) AS FOLLOWS:
1. The City intends to incur expenditures for the project described in Council Report
2002-72, for City Project 00-12 (the "Project") and intends to reimburse itself for
such expenditures from the bond proceeds to be issued by the City in the
maximum principal amount described in the "project".
2. The City Manager is authorized to designate additions to Project 00-12 in
circumstances where time is of the essence, and any such designation shall be
reported to the Council at the earliest practicable date and shall be filed with the
official books and records of the City.
3. This resolution is intended to constitute a declaration of official intent for the
purpose of Treas. Reg. #1.150-2 and any successor law, regulation, ruling or
amendment pertaining thereto.
Adopted by the City Council of the City of Hopkins, Minnesota, this ih day of May 2002.
