VAIDANCE-FRONTYARDSETBACK
Proposed Action.
Staff recommends the following motion: Move to approve Resolution RZ01-19,
recommending denial for a 4.5-foo1. front yard variance at 101 Interlachen Road.
Overview.
The Planning Commission at their October meeting first heard this variance request.
The variance was continued because the Planning Commission is considering amending
the Zoning Ordinance. The Commission is still reviewing an amendment. Staff would
still recommend denial of the variance.
The applicants are requesting a variance for 4.5 feet to allow the construction of a front
porch. The zoning ordinance requires a 20-foot front yard setback for front porches in
residential districts. The home is situated on the corner of lnterlachen Road and Boyce
Road. The Zoning Ordinance defines the front yard of a corner lot to be the side of the
lot with the shortest frontage. In this case, lnterlachen Road is the front yard and Boyce
. Road is the side yard.

The applicant has requested a variance of 4. 5 feet to allow a 15. 5-foot front yard setback.

The Zoning Ordinance states the following: a variance is a modification or variation
from the provisions of this code granted by the board and applied to a specific parcel of
property because of undue hardship due to circumstances peculiar and unique to such
. parcel. The Zoning Ordinance also states the following: that the Commission must find
that the literal enforcement of the provision of the Zoning Ordinance would cause an
undue hardship because of circumstances unique to the individual property under
consideration and that the granting of a variance to the extent necessary to compensate
for said hardship is in keeping with the intent oftrus code.
The applicants stated in their application the following: Strict enforcement of the
ordinance does not cause undo hardship or reasonable use of the property.
The applicZll1ts stated that they do not have a hardship for the granting of a variance. The
subject site is not unique. lfthe variance is granted the home will have a 15.5- foot front
yard setback. The zoning ordinance was amended a few years ago to allow a lesser
setback for front porches. Before the ordinance was amended, this zoning district would
have required a front porch or any other addition in the front to have a 3D-foot front yard
setback. The home as it exists today does not have the required front yard setback.
Alternatives.
1. Recommend approval of the variance. By recommending approval of the variance,
the City Council will consider a recommendation of approval. If the Planning
Commission considers this alternative, findings of fact will have to be stated that
sUPP0l1 this recommendation.
. 2. Recommend denial of the variance. By recommending denial of the variance, the
City Council will consider a recommendation of denial.
3. Continue for further information. If the Planning Commission indicates that further
information is needed, the item should be continued.
