WAIVER OF PLAT - MAINSTREET
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 02-98, approving a waiver
of plat at 1009-11 Mainstreet.
At the Zoning and Planning meeting ML Bartz moved and Ms. Allen seconded a motion to adopt
Resolution RZ02-24, recommending approval for a waiver of plat at 1009-11 Mainstreet. The
motion "vas approved unanimously.
Overview.
When the City removed the building and constructed a parking lot behind Boston Garden, the
building to the east was left with an exposed wall. It was also determined that a part of this
building is on City property. This area is .83 feet. This .83 feet needs to be conveyed to the
parcel to the east of the City parking lot. The action will complete the parking lot project.

The zoning of the property is B-2, Central Business. There is no minimum lot size in the
B-2 zoning district.
. Do the new lots meet the subdivision requirements?
The new lots as proposed meet the subdivision requirements.
. Is a park dedication fee required?
A park dedication fee is not required because a new lot is not created.
. What was the discussion at the Zoning and Planning Commission?
Ms. Anderson reviewed the reason for the waiver of plat and stated that it is really a
housekeeping action. No one appeared before the Commission regarding this item.

. 1. Approve the waiver of plat. By approving the waiver of plat, the property will be able to
be split.
2. Deny the waiver of plat. By denying the waiver of plat, the property will not be able to
be split and a small portion of a building will be located on the City property. If the City
Council considers this alternative, findings will have to be identified that support this
alternati ve.
3. Continue for further infoilllation. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION NO: 02-98
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A WAIVER OF PLAT
WHEREAS, an application for Waiver of Plat WVR02-1 has been made by The
City of Hopkins; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Waiver of Plat WVR02-1 was made by The
City of Hopkins on October 8, 2002;
2. That the Hopkins Zoning and Planning Commission, pursuant to
mailed notice, held a meeting on the application and reviewed such
application on October32 29, 2002: all persons present were given
an opportunity to be heard;
. 3. That the written comments and analysis of the City staff were
considered; and
4. Legal descriptions of the parcels are as follows:
City parcel
That part of Lots 13, 14, and 15, Block 69, West Minneapolis Second
Division according to the recorded plat thereof, which lies northerly of the
southerly 62.00 feet of said Lots 13, 14, and 15, except the east .83 feet of
the north 35 feet of Lot 13, Block 69, West Minneapolis Second Division.

Lot 12, Block 69, and the east .83 feet of the north 35 feet of Lot 13, Block
69, West Minneapolis Second Division, according to the recorded plat
thereof.
NOW, THEREFORE, BE IT RESOLVED that application for Waiver of Plat
WVR02-1 is hereby approved, based on the following Findings of Fact:
. 1. That the lots meet the reg uirements for a waiver of plat.
BE IT FURTHER RESOLVED that application for Waiver of Plat
