APPLICATION FOR CONDITIONAL USE PERMIT CUP87-16
WHEREAS , an applioation for a Conditional Use
Permit CUP87-16 has been made by Super Valu Stores Ine . , 101
JePferson Avenue South , to oonstruct an addition to the
existing Preezer facility.
WHEREAS „ the proQedural history of the
appliaation is as follows ;
1 . That an application Por Conditional Use Permit
CUP87-16 was filed with the City of Hopkins on May
1 , 1987 .
2 . That the Hopkins Planning Commission reviewed such
applioation on May 26 , 1987 ,
3 . That the Hopkins Planning Commission , pursuant to
published and mailed notices , held a publie
hearing on May 26 , 1987 ; all persons present at

CONDITIONAL USE PERMIT - VARIANCE

PUR._ P�SE: To revieW and recommend action on an
application Por a Conditional Use Permit to construQt a
freezer addition and a variance for the height of the
struoture ,
BACKGROUND: See staff report to the Zoning and Planning
Commission . The Commission considered the Conditional
Use Permit and Varianee together. Dave Linner,
representing Super Valu , appeared before the Commission
� and presented the plans for the addition . He noted
that the present offices are higher than the proposed
freezer.
An ad�acent property oHner appeared before the
Commission . His main coneern was the noise ereated at
the site.
The staff stated that the sound wall that is to be
built should take care of most of the noise problems .
This wall will be started this summer.
RECOMMENDATION: The Commission recommended unanimously
to approve the Conditional Use Permit with the
following Findings of Fact :
1 . That the proposed addition meets the
requirements for an I-2 Distriet .
2 . That the proposed addition meets the
requirements for a Conditional Use Permit .
The Commission recommended unanimously to approve the
height varianee with the following Findings of Fact and
Conditions :

PLANNING COMMISSION
REPORT N0: CUP87-16 MAY 14 , 1987
PURPOSE: To review and recommend aetion on an
application for a Conditional Use Permit to eonstruet a
freezer addition.
BACKGROUND•
Name of Applicant: Super Valu Stores Ine .
Address of Property: 101 Jefferson Avenue
South
Present Zoning: I-2
Reason for Request : Super Valu needs more
freezer space
— Nature of Request: Ordinance requires
construction over 475 ,000 to obtain a
Conditional Use Permit .
The applicant is proposing a 50 ,384 .5 square foot
freezer addition . In order to construet this freezer
existing buildings will be demolished and the new
freezer will be added to the west side of the existing
freezer.
Ordinance 525 • 13 �e) requires a Conditional Use Permit
whenever:
"the building permit requested is for new
construction or for the enlargement ,
remodeling or repair of the exterior of any
existing building including structures
accessory thereto , at a cost of at least
$75 ,000 except one through four family
structures° .
ANALYSIS: The new freezer will oecupy space currently
used by a tractor storage and general merchandise area ,
located in the northwest corner of their main complex.
These uses will be relocated to another site .

The setbacks and parking requirements will not be
affected . The applicant will have more parking with
the new freezer because of the demolition of the
existing buildings .
The existing freezer has loading docks along the south
wall . These loading docks will be extended to the new
freezer. The new freezer will have eight loading
docks .
The height of the new freezer is 38 feet . A maximum
height in an I-2 district is 35 feet . The applicant
has applied for a variance .
The floor area ratio to the site will be reduced from
.55 to .52 . The maximum requirement for an I-2
Distriet is .60 .
This new freezer will have little affeet on the
surrounding residential areas to the east and south.
The easterly residential area is separated and buffered
^ by the existing buildings . The residential district to
the south will be separated farther because the new
freezer is further north than the existing building . A
sound wall of 20-25 feet will also be built as agreed
to by Super Valu along the south lot line . The subject
site is surrounded by an industrial district to the
west and north.
Drainage will be unaltered from what presently exists .
The Director of Engineering has reviewed the drainage
plan and found it aeceptable .
The Fire Marshal and Building Inspector have reviewed
the plans and noted the following:
- the addition must meet the requirements of
the Building Code
- because of the additions elose proximity to
the truck maintence garage it may require a
fire wall
- a possible deficiency of exits
- the addition is to be totally sprinkled
All of the above items will be reviewed during the
building permit stage .

The walls will be constructed of an insulated material
with an exterior of inetal . The exterior will be the
same type as the existing freezer. This type of
building was approved recently for Merehants
Refrigeration .
The freezer motor will be located on the north side of
the building next to the existing freezer motor. This
location will provide the greatest distanee from the
residential areas .
The new freezer addition will have little impact on the
Super Valu site . The site density will actually be
reduced and parking will be inereased . The setbacks
are not affeeted . There should be no impact on the
residential areas , since there presently exists a
building on the area where the freezer will be built .
ALTERNATIVES•
1 . Approve . the Conditional Use Permit
2 . Deny the Conditional Use Permit
3 . Continue for additional information
RECOMMENDATION: I recommend Alternative #1 . The
� following are suggested Findings of Faet should the
Commission recommend approval :
1 . That the proposed addition meets the
requirements for an I-2 District .
