RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP87-10
WHEREAS, an appliaation Por a Conditional Use
Permit entitled CUP87-10 has been made by Rnox Lumber
Company, 250 Fifth Avenue South , to oonstruat a warehouse
and remodel the exiting building.
WHEREAS , the prooedural history of the application
is as follows:
1 . That an application for Conditional Use
Permit CUP87-10 was filed with the City of
Hopkins on April 3 , 1987 •
2 . That the Hopkins Planning Commission reviewed
suah application on April 28 , 1987 .
` 3 . That the Hopkins Planning Commission ,
pursuant to published and mailed notices ,
� held a public hearing on April 28 , 1987 ; all
persons present at the hearing were given an
opportunity to be heard .
4 . That the written comments and analysis of the
City Staff and the Planning Commission were
aonsidered .
NOW THEREFORE , BE IT RESOLVED , that the Hopkins
City Counail makes the Pollowing Findings of Faat in respeet
to CUP87-10 :
1 . That a warehouse is a permitted use in an I-2
Distriat .
2. That the proposed warehouse meets the requirements
for an I-2 Distriot .
3 . That the proposed warehouse meets the requirements
for a Conditional Use Permit .
BE IT FURTHER RESOLVED , that application for

CONDITIONAL USE PERMIT - RNOX LUMBER
250 - 5th Avenue South
PURPOSE: To review and recommend action on a
Conditional Use Permit to construet a warehouse .
BACKGROUND: See staff report to Zoning and Planning
Commission. Last month the applicant proposed a
warehouse with a metal exterior. This exterior Was not
looked upon favorably by the Commission . The item was
eontinued to allow the applicant to appear before CCDC
and to bring in a sample of the exterior. Sinee last
month the applicant has decided to ehange the exterior
of the building to precast concrete panels . The owner
of the property , R. L. Johnson , recommended the
^ applicant use precast conerete panels .
Mr. Joe Jameson , representing Knox, appeared before the
Commission . He stated that the proposed building has
been reduced in size and the exterior has been changed
from metal to precast eoncrete . The warehouse will
match the existing building .
Dave Constable , representing the oWner of the property ,
stated that the new exterior was more aeceptable .
RECOMMENDATION: The Zoning and Planning Commission
voted unanimously to approve the Conditional Use Permit
with the following Findings of Faet and Conditions:
1 . That a Warehouse is a permitted use in an I-2
District .
2 . That the proposed warehouse meets the
requirements for an I-2 District .
3 . That the proposed Warehouse meets the
requirements for a Conditional Use Permit . �

SUBJECT: Exterior of the proposed Knox Warehouse

The enelosed site plan is the new plan submitted by Knox
Lumber Company. The plan remains essentially the same as
the plan submitted last month. The buildin� has been rnade
smaller . The dimensions are now 120 x 220 for a total size
of 26 ,�00 sq . ft . . The height has been lowered to 24 feet .
It appears everything else is the same .
The abutting property owner ( R. L. Johnson) has recommended a
screened fence and landscaping on the north and west side .
The site plan shows landscaping on the north side . The
staff would concur with the reeommendations of R . L. Johnson
^ and recommend that the southerly lot line be landscaped and
screened . We are concerned with the visual looks of the
property from the south. The staff is recommending that the
applicant be required to put landscaping and a screened
fence on the west and south lot lines .
ALTERNATIVES:
1 . Approve the Conditional Use Permit
2 . Deny the Conditional Use Permit
3 . Continue for further information
RECOMMENDATION: I recommend Alternative ��1 . The following
are suggested Findings of Fact and Conditions should the
Commission recommend approval :
1 . That a warehouse is a permitted use in an I-2
District .
2 . That the proposed warehouse meets the requirements

3 . That the proposed warehouse meets the requirements

SUBJECT: Exterior of the Knox Warehouse

The enclosed renderings show the new exterior as proposed by
the applicant . Pre-cast concrete panels will be used . This
exterior material is the same as the existing building. A
flat roof is now proposed with a height of 24 Feet .
The new warehouse will be the same color as the existing
--� building and also will have the same wood band around the
building.
The site plan will remain the same , except the building will
be 120 x 220 instead of 102 x 280 . The applicant will be
submitting a new site plan .

PURPOSE: To review and recommend aetion on a
Conditional Use Permit to remodel the existing Knox
building and to construct a warehouse west of the
existing Knox building.

Nature of Request : Ordinance requires a

$75 ,000 .
Reason for Request: To construet a 27 ,744
square foot warehouse and to remodel the
existing Knox Store .
The applicant is proposing to construct a 27 ,744 square
foot warehouse adjacent to the existing Knox store .
The applicant has leased this 3 acre parcel from R. L.
Johnson . The existing Knox store will also be
remodeled . The present store entranee facing east will
be relocated to the north side of the building and the
interior of the building will be changed to aecommodate
the new entrance . Thirty more parking stalls will be
added . The garden center at the southeast side of the
site will also be remodeled .
The proposed warehouse will consist of 20 ,664 square
feet which will be enclosed and 7 ,080 square feet will
be a canopy covered warehouse . With this warehouse
addition , the applicant will be able to remove the �
semi- trucks parked on the property. These trucks
presently contain the contents of the new warehouse .

The following is a listing of how the proposed project
meets the minimum requirements for the district :

The north side of the site will be landscaped with a
variety of plantings . These plantings will meet the
landscaping requirements .
The rest of the site will be fenced with chain link .
The staff is concerned with the appearance of the site
from the south and west because it will abutt the R. L.
Johnson property. We would recommend the applicant
submit a plan which shows landscaping with a sereen
fenced on the west and south lot lines .
The new entranee on the north side of the existing
^ building will provide an access to the retail area and
the yard entrance . Traffic to the yard entranee will
be the abutting railroad . The cars will then have
access to the proposed warehouse and the yard . They
will then be able to exit from the checkout parking
area.
The exterior of the proposed building will be metal and
gray in color.
The site is required a total of 179 parking spaces .
The site plan shows 246 parking spaces .
Any new signage will have to comply with 570 .53 •
Currently the site is at the maximum square footage
allowed . Signage moved within the site will not
require a sign permit , but the applicant will be
required to inform the sign inspector for an
installation inspection .
ANALYSIS: The applicant is proposing a gray metal
building. The staff is coneerned about the appearanee

of the proposed warehouse building abutting County Road
��3 . The major concern the staff has with this proposal
relates to the material to be used in construeting the
warehouse . Because of its ' size , width-length-height ,
it will be very visible from County Road �3 . Because
this is one of the main entry ways into the City , the
long-range �oal is to clean up this area. For the
former White Motors property , the developer will be
required to adhere to some fairly strict design
standards . A pole type metal building projeets a
temporary warehousing image . The City has the ability
to regulate eonstruction and material through 525 • 13
Subd . 10 of the zoning ordinance concerning eonditional
uses :
"The requirements are in connection with the
application for a Conditional Use Permit are
deemed necessary by the Council because a
substantial depreciation of values in the
neighborhood where such construction is
proposed as well as in and to the City at
large , occurs or may oceur to the detriment
of the general public welfare if such
construetion or alteration contains exterior
� facing materials which are either temporary
or are not of a permanent nature or have a
tendency to deteriorate rapidly or may be
easily disfigured , marred or damaged , or
which for any reason may rapidly become
unsightly in appearance ; examples of which
materials being , but not limited to the
following: conerete masonry units , common
clay tile , tar paper or other similar
building composition sheet materials , either
corrugated or plain and exposed unfinished
concrete unless some or all of such materials
are constructed and used in a special
arrangement or eombination with other
materials of a permanent nature with sound
arehitectural design . "
The staff is recommending to require the proposed
warehouse to have exterior materials the same or
similar construetion to the existing strueture or
brick .

The applicant , as of the date of this report , has not
presented the project to CCDC . The staff has advised
him that it is recommended that CCDC have a chanee to
review his proposed project .
ALTERNATIVES•
1 . Approve the Conditional Use Permit as
presented .
2 . Approve the Conditional Use Permit with
revision to the plan .
3 . Deny the Conditional Use Permit .
4 . Continue for a month.
RECOMMENDATION: I recommend Alternative �4 . The
applicant work with staff and submit new plans that
address the coneerns of the staff. It is also
recommended the applicant meet with CCDC.
