RESOLIITION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL= USE PERMIT CUP87-7
WHEREAS , an application for Conditional Qse Permit
CUP87-7 has been made by Super Valu Stores , Inc . , 101
Jefferson Avenue South , to construct an addition to the
present facility.
WHEREAS , the procedural history of the application
is as follows:
1 . That an application for Conditional Use Permit
CUP87-7 Was filed on March 6 , 1987 •
2 . That the Hopkins Planning Commission revieWed suah
application on Maroh 31 , 1987 •
3 . That the Hopkins Planning Commission , pursuant to
published and mailed notices , held a public
hearing on March 31 , 1987 ; all persons present at
the hearing Were given an opportunity to be heard .
4 . That the Written comments and analysis of the City
'� Staff and the Planning Commission were considered .
NOW THEREFORE BE IT RESOLVED , that the Hopkins
City Council makes the folloWing Findings of Fact in respect
to CUP87-7 :
1 . That the proposed addition meets the requirements
of an I-2 District .
2 . That the proposed addition meets the requirements
of a Conditional Use Permit .
BE IT FURTHER RESOLYED , that application for

SUBJECT: Conditional IIse Permit for Super Valu
- - - - - - - - - - - - - - - - - - - - - - - - - - - - - -
At the last City Council meeting , several surrounding
neighbors to the Super Valu property complained about the
noise generated at the site . On April 22 , 1987 , Super Valu
^ met with the surrounding neighbors and presented them a plan
which provides a sound Wall and landseaping along the
southern property line . The sound aall starts approximately
at the new addition and continues West to the end of the
Super Valu property. The wall Kill be 20-25 feet in height
and made of treated Wood . Landscaping rrill be provided
along the wall .
The surrounding residents at the meeting Were in favor of
the sound wall .

PURPOSE: To review and recommend action on an
application for a Conditional Use Permit to construct
an addition to the existing facility.
BACKGROUND: See staff report to Zoning and Planning
Commission . Dave Linner , representing Super Valu �
revieWed the proposed addition . Mr. Linner noted there
is a 12 foot grade change between the Super Valu
property and the abutting residential district at the
south side of the site . Super Valu did meet r+ith the
^ surrounding neighbors . Mr. Paul Janke of Monroe Avenue
spoke in favor of the project . The Commission was
concerned r+ith landscaping around the site . Mr. Linner
stated that the south and east sides of the property
that abutt residential distriets are landscaped .
RECOMMENDATION: The Commission approved the Conditional
Use Permit unanimously with the folloxing Findings of
Faet and Conditions :
1 . That the proposed addition meets the
requirements of an I-2 District .
2 . That the proposed addition meets the • I

CONDITIONAL USE PERMIT - SOPER VALU
PLANNING COMMISSION
REPORT N0: CUP87-7 MARCH 24 , 1987
PURPOSE: To review and recommend action on an
application for a Conditional Use Permit to construct
an addition to the existing Super Valu Building .
BACRGROUND•
Name of Applicant: Super Valu Stores Inc .
Address of Property: 101 Jefferson Avenue
South
Present Zoning: I-2 �
Reason for Request: Needed expansion space
Nature of Request : Ordinance requires
— eonstruetion over $75 ,000 to obtain a
Conditional Use Permit .
The applicant is proposing to construct a 9000 square
foot addition with six loading docks to the south side
of the existing dry goods loading area ad�acent to
Third Street South. Ordinance 525 • 13 requires a
Conditional Use Permit whenever a building permit
requested is for new construction or for the
enlargement , remodeling repair of the exterior of any
existing building including structures aecessory
thereto , at a eost of at least $75 ,000 , except one
through four family structures .
ANALYSIS: The sub�ect property abutts a residential
distriet along Monroe Avenue and Third Street South.
Because of this situation the ordinance requires a u0
foot rear yard setbaek and loading docks to have a 50
foot setback . The proposed addition is not parallel to
the lot line . The loading dock area will have
approximately a 52 foot setback , Which then tapers to .
approximately 43 feet at the easterly end .
The plan as proposed Will have a 15 foot concrete block
wall screening the loading area Prom the residential

district along Third Street South. The Wall will be
painted to match the existing building. The addition is
at a loWer elevation than the abutting residential
distriet . With the Wall , differenae in elevation and
the existing fenee � noise and visual impact should be
minimal to the homes along Third Street South.
A 20 foot Wide aecess road Will be maintained between
the proposed building and the lot line . This road will
provide access to the parking lot east of the addition .
The Floor Area Ratio is .55 • The maximum requirement
for an I-2 District is .60 . The site is close to
maximum development .
A 12" watermain Will have to be relocated because of
the proposed building. The applicant �ill move the
watermain to the south side of the addition for which
the City will require a 15 ' easement . The City
Engineer has reviewed these plans and found them
acceptable . The applicant will have to petition to
vacate the existing utility easement on Second Street
South.
The exterior of the building Will be painted concrete
block to mateh the existing building . The addition
will also have a canopy to match the existing building .
The addition will require five more parking spaces ,
which the applicant will provide . Any future additions
will require the applicant provide additional spaees .
The applicant may seek a parking varianee for future
additions .
The Fire Marshal has revieWed the preliminary plans ,
but was out of town during the writing of this report.
Any approval should be contingent upon his approval .
The Director of Engineering has reviewed the plans and
found them aeeeptable .
The applicant requires additional space for their
business . The proposed addition complies with the
requirements for an I-2 distriet and a conditional use

permit . The addition should have a minimum impact on
the abutting residential distriet the the south beeause
of the wall screening the loading area and the
elevation difference.
ALTERNATIVES•
1 . Approve the Conditional Use Permit .
2 . Deny the Conditional Use Permit .
3 . Continue for additional information .
RECOMMENDATION: I recommend Alternative #1 . The
folloWing are Findings of Facts and Conditions should
the Commission recommend approval .

requirements of a Conditional Use Permit .
