WHEREAS , an application for a Conditional Use Permit
CUP87-3 has been made by Debra Packard , 83 Renaissance
Court � to alloa Day Care .
WHEREAS , the procedural history of the application is
as follows :
1 . That an application for Conditional Use Permit
CUP87-3 was Piled With the City of Hopkins on
January 2 , 1987 .
2 . That the Hopkins Planning Commission reviewed
such application on January 27 , 1987 .
3 - That the Hopkins Planning Commission , pursuant
to published and mailed notices , held a public
hearing on January 27 , 1987 ; all persons
present at the hearing were given an

4 . That the Written comments and analysis of the
City Staff and the Planning Commission were
considered .

PLANNING COMMISSION
REPORTS N0: CUP87-3 January 12 , 1987
PURPOSE: To review and recommend action on a
Conditional Use Permit for allow Day Care .
BACKGROUND •
Name of Applicant : Debra Packard
Address of Property: 83 Renaissance Court
Present Zoning : R-3
Nature of Request : Statute allows the City to
require a Conditional Use Permit in
multiple residential distriets .
Reason for Request : To allow Day Care in a
� multiple residential district .
The applicant is applying for a Day Care license which
requires her to get a Conditional Use Permit before
obtaining a license .
The State Statute states a township , municipality or
county zoning authority may require a Conditional Use
Permit or Special Use Permit in order to assure proper
maintenance and operation of a facility , provided that
no conditions shall be imposed on the homes which are
more restrictive than those imposed on other
conditional uses or special uses of residential
property in the same zones , unless such additional
conditions are necessary to protect the health and
safety of the residents of the family .
The applicant lives within a townhouse development
which does not allow a great amount of room for the
children to play, however, there is a common play area
for the children .
The applicant has contacted the manager of the
townhouses and received written approval which is
enclosed .

ANALYSIS: The State Statute alloWs Day Care in a multi-
family residential area as long as it is licensed. The
only control the City has is a reviewing process
through a Conditional Use Permit to assure proper
maintenance and operation of a facility .
RECOMMENDATION: I recommend approval of the Conditional
use Permit . the following are suggested Findings of
Faet and Conditions should the Commission recommend
approval :

Debra Packard - 83 Renaissance Court
PURPOSE: To revieW and recommend action on a
Conditional Use Permit to operate a Day Care .
BACKGROUND: See staff report to Zoning and Planning
Commission . The applicant � Debra Packard , appeared
before the Commission . The applicant stated that she
is licensed for up to 11 children , but she does not
plan on having 11 children . The Commission was
concerned about the play area for the children . Ms .
Packard stated that her backyard is fenced along the
road and there is also a common play area . The ;
applicant stated that there is a need for home day care �
because of the high cost of Day Care Centers .
^ RECOMMENDATION: The Commission approved the Conditional
Use Permit for Day Care unanimously With the following
Findings of Fact :
1 . That the applicant meets the
conditions for a Conditional Use
Permit .
and with the Conditions :
1 . That the applicant is licensed by
the State of Minnesota.
2 . That the residence is inspected by
the City Inspectors .

siblitv for any liability that may arise between Ms. Packard
and her day-care children/parents, etc. iTe will not he
responsible for any reciuirements she must meet to c?ual-
ify to preform said day-care in her home.
