RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP86-12
WHEREAS , an application for a Conditional Use
Permit entitled CUP86-12 has been made by Midwest Auto Mall
to construet an Auto Mall at the northeast corner of 11th
Avenue South & County Road 3 .
WHEREAS , the procedural history of the application
is as follor+s :
1 . That an application for CUP86-12 was
filed with the City of Hopkins on
October 30 , 1986 .
2 . That the Hopkins Planning Commission
revieWed such application on November
25 , 1986 .
3 . That the Hopkins Planning Commission ,
�� pursuant to published and mailed
notices , held a public hearing on
November 25 , 1986 ; all persons present
at the hearing were given an opportunity
to be heard .
4 . That the written comments and analysis
of the City Staff and the Planning
Commission Were considered .
NOW THEREFORE , BE IT RESOLVED , that the Hopkins
City Council makes the following Findings of Fact in respect
to CUP86-12 :
1 . That the proposed development meets the
requirements for a Conditional Use
Permit .
2 . That the proposed development meets the
minimum requirements for a B-3 Distriet .
3 . That the proposed development dedicates
35 feet on the west side of the property
for the expansion of 11th Avenue South .
BE IT FURTHER RESOLVED , that application Por

to the following Conditions :
1 . That the applicant secure ownership or

PURPOSE: To review and recommend action on a
Conditional Use Permit to construct an Auto Mall .
BACKGROUND •
Name of Applicant : Midwest Auto Mall
Address of Property: Northeast corner of
11th avenue South & County Road 3 .
Present Zoning: B-2
Nature of Request : A Conditional Use Permit
is required for construction over $75 , 000 .
Reason for Request : To construct an Auto
Mall
�� The a licant is
pp proposing to build an Auto Mall on the
northeast corner of County Road 3 and 11th avenue
South . This was the former site of White Motors and
CPT which is currently being demolished . The applicant
is also applying for rezoning and vacation of Second
Street South . The vacation of Second Street is
necessary to provide sufficient parking for the site .
The total building area will consist of 23 , 000 square
feet . The proposed plan shows 7 tenants , each with a
different type of service for a car .

The applicant is proposing considerable more parking
than required because of the nature of the business .
There are four proposed ingress/egress locations shown
on the proposed plan . The ingress/egress on 11th
Avenue has been a concern of the staff because of the
changes that will be occurring at the adjacent
intersection . The proposed plan is showing a right
in/out only at this ingress/egress . This movement
seems to be a logical solution for an ingress/egress at
this location . At the time of construetion however,
this ingress/egress will be a right and left turn until
the completion of the intersection in two to three
years .
Approaches to the site when the intersection of County
Road 3 and 11th Avenue is completed , will be from the
south on 11th Avenue , from the east on County Road 3
or 9th Avenue . A car approaching from the west on
County Road 3 will have access via 11th Avenue and a
car traveling from the north on 11th Avenue will have
to go to 9th Avenue , via First Street for access .
The applicant will have to secure approval from the
� County for the ingress/egress on County Road 3 . The
staff supports the ingress/egress on County Road 3 .
The exterior of the building will consist of a metal
pre-finished roof , stucco and rock-faced concrete bloek
with matching mortar color.
The applicant is required to have 32 trees on the site .
The proposed plan shows 34 trees plus a variety of
shrubs throughout the site .
The proposed plan does not indicate sidewalk around the
site , however , the applicant has indicated that
sidewalk will be constructed along County Road 3 and
9th Avenue during the construction of the development .
The 11th avenue sidewalk will remain intact until the
improvements to 11th avenue , then new sidewalk will be
constructed further to the east .
The Director of En�ineering has reviewed the drainage
plans and found them acceptable . The drainage will
flow in a westerly direction .

The Fire Marshal has reviewed the plans and found that
the proposed hydrants on the west end of the property
will probably have to be looped with the hydrant to the
east to secure proper water pressure .
RECOMMENDATION : I recommend approval of the
Conditional Use Permit . The following are suggested
Findings of Fact and Conditions should the Commission
recommend approval :
1 . That the proposed development meets the
requirements for a Conditional Use Permit .
2. That the proposed development meets the
minimum requirements for a B-3 district .
Conditions:
1 . That the applicant secure ownership or use

2. That the subject property is rezoned from
B-2 to B-3 •

HOPKINS AUTO MALL
PURPOSE: To review and recommend action on a rezoning
request , street vacation request and a Conditional Use
Permit to construct an auto mall .
BACKGROUND : See staff report to Zoning and Planning
Commission . The Commission considered all three items
together . Mr . Krank , Mr . Peterson and Mr . Sweet
representing Midwest Auto Malls presented the proposed
development . Some points that were presented : The
applicants explained that the appearance of the
building would be like a retail center and the design
of the building would be clean and neat . The signage
would be uniform throughout the site . There Will be no
outside overnight storage of cars . The uses are a
�� quick-type auto repair , there will be no major repair
done on site . The type of tenants are a national base
and have a minimum five year lease . The applicants
have secured letters of intent for 2/3 of the space .
The approximate cost for the development is 3 million .
The trash will be contained within all of the
businesses . The proposed hours of operation are 7
a . m. -6 p . m . , Monday thru Saturday . The access to the
site has been a major concern and the four proposed
ingress/egress points satisfy the concerns of the
• staff.
Bob Miller , representing CCDC presented a memo to the
Commission with the concerns of the Economic
Development Committee . He spoke on the points in the
memo . Pir . Miller also stated that the CCDC Board has
not acted on the development formally and would request
that no City action be taken until the CCDC Board can
act formally . He stated the CCDC Would meet on
December 4th and will consider the development . The
next Council meeting will be on December 9th � Which
would allow the CCDC to act .

^ Steve f�endrickson � or+ner of Midas Muffler, appeared
before the Commission . Mr. Hendrickson was concerned
about the parking on the site . He stated he has 30
parking stalls with 6 bays . He felt this Nas not
adequate parking .
The applicant responded to Mr . Hendricksons concerns
stating that they have studied other similar malls and
feel comfortable With the number of spaces . The
applicant also stated that there are 40 inside stalls
which will make 120 total parking spaces on the site .
Jim Lindstrom , owner of Hopkins Car Care Center ,
appeared before the Commission. He asked the
Commission if they were promoting the downtown or
Minneapolis Moline , he also stated that 11th Avenue is
the entrance to the City,
The Commission Was concerned about Light Rail Transit
on 9th Avenue . LRT could close 9th Avenue , thus
limiting the site Nith only tWo aceess points . The
Commission directed staff to study the implications of
LRT on 9th Avenue .
The Commission was interested in uhy the proposed
project moved from the south side of County Road 3 to
^ the north side . The applicants stated that with the
improvements in the adjacent intersection the auto mall
would not physically fit on the site to the south .
RECOMMENDATIONS :

2 • The vacated right-of-way provides the
