BACKGROUND• Name of Applicant : Raren Disrud Address of Property: 1315 Oxford Street Present Zoning: R-2 Nature of Request : Ordinanee requires a Conditional Use Permit for 6-11 children . Reason for Request : To permit day care for 6-11 children. ^ The applieant is proposing to have a day care for children in her home for 11 children. The sub�ect home is a duplex . A day care within an R-2 district is a conditional use . 427 • 33 � 2) �k) states Within "R-2" , ^R-3" , "R-4" , "R-5" , and "R-6" Distriets , day care for more thari five and less than eleven children is allowed provided sueh premises are licensed therefor by the State of Minnesota . ANALYSIS• The applieant lives within the correct zoning distriet to allow up to 11 ehildren with a Conditional Use Permit . The only other stipulation in the Zoning Ordinance is that the applicant is to be licensed by the State . A problem that mightoccur with this number of children is that the children may tend to play throughout the neighborhood . If this becomes a problem, the Commission may want a Condition on the Conditional Use Permit that the yard be fenced . RECOMMENDATION: ^ I recommend approval of the Conditional Use Permit . I BACKGROUND: See staff report ot the Zoning and Planning Commission . The applieant and owner of the home appeared before the Commission . The applicant stated that she was not licensed by the State as yet . Two neighbors and a homeowner appeared before the Commission to voice opposition to the Conditional Use Permit . Their points of opposition ineluded the number of children in the neighborhood , --� ehildren playing in the street , the house was small for day care , parking and traffic in the neighborhood . There was also a concern that if this permit was granted , others in the bloek will apply for a permit for a day care. The applicant stated her ehildren do not play in the street and there is not a parking problem With the drop-off and pieking up of the ehildren . Staff reported that this is only the second request for a permit since the requirement for a permit was placed in the ordinance . The Zoning & Planning Commission approved the Conditional Use Permit unanimously , with the folloWing eonditions : 1 . That the applicant is licensed by the State of Minnesota . 2 .
