CONDITIONAL USE PERMIT REQUEST - 20th & MAINSTREET
PLANNING COMMISSION
REPORT N0. CUP86-3
PURPOSE: To review and recommend action on an application for a Conditional Use
Permit to construct a building on the northwest corner of 20th Avenue
North and Mainstreet.
BACKGROUND:
Name of Applicant: Brian Zubert
Address of Property: Northwest corner of 20th Avenue & Mainstreet
Present Zoning: B-3
Nature of Request: Ordinance requires a Conditional Use Permit for
construction over $75,000.
Reason for Request: To construct an auto retail/repair building
The applicant is proposing to construct a building on the northwest
'� corner of 20th Avenue North and Mainstreet. Ordinance 427.26(c) re-
quires a Conditional Use Permit for construction over $75,000.
The proposed tennant will be Crown Auto, who will be moving from their
present location at 5th & Mainstreet.

The proposed building will be 6500 square feet and have four service bays
facing Mainstreet. An interior loading access will be utilized in one of
the bays.
Access to the site will be from 20th Avenue North.
The trash container is located on the north side of the building. The con-
^ tainer will be enclosed with a 6 foot wood screen wall .

The ordinance requires seven trees on the site. The applicant has pro-
vided 3 trees, however the applicant has stated he will comply with the
requirements of the ordinance. The applicant is proposing grass in the
front and rear setback areas. Along the alley the applicant is proposing
crushed rock since grass may not grow well with the sand and salt in the
winter. If the Commission desires grass in this area, the applicant will
put grass here.
The exterior of the building will be painted concrete block.
The Building Inspector has reviewed the proposed building. His memo con-
cerning the building is enclosed.
The City Engineer has received the plans, however no report has been re-
ceived as of the time of this report. Any approval should be contingent
upon approval of the City Engineer.
The Pines Trailer Court is located to the south, a home to the north, the
Auto Doctor to the west and an empty lot to the east. The home to the
east is setback quite a distance from the alley.
'� ANALYSIS:
The proposed building meets the requirements of the ordinance except for
the number of trees. The applicant has stated more trees will be planted.
This building will provide a current business in Hopkins a new location to
continue their business.
RECOMMENDATION:
I recommend approval of the Conditional Use Permit.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP86-3
WHEREAS, an application for a Conditional Use Permit entitled CUP86-3
has been made by Brian Zubert to construct a 6500 square foot retail building
at the northwest corner of 20th Avenue & Mainstreet.
WNEREAS, the procedural history of the application is as follows:
1. That an application for Conditional Use Permit CUP86-3 was filed
with the City of Hopkins on April 11, 1986.
Z. That the Hopkins Planning Commission reviewed such application on
April 29, 1986.
3. That the Hopkins Planning Comnission, pursuant to mailed notices,
held a public hearing on April 29, 1986; all persons present at
the hearing were given an opportunity to be heard.
4. That the written canments and analysis of the City Staff and the
Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
^ following Findings of Fact in respect to CUP86-3:
1. That the proposed_ development meets all the requirements of the
ordinance.
BE IT FURTHER RESOLVED, that application for Conditional Use Permit
CUP86-3 is hereby approved subject to the following conditions:
1. That the applicant meet with the Mainstreet Design Corrmittee and
plan a design acceptable to that committee.
2. That the applicant work with the City Engineer to plan an accept-
able ingress and egress.
3. That the storage area for refuse be screened so as not to be visible.
4. Compliance with the landscape ordinance.
5. Applicant provide City Engineer with a complete drainage plan.
6. City Engineer approval of all plans.
7. Curb to be 3 feet back of property line.
' B. Parking be on site for employees and customers.
9. Sidewalk be installed on Mainstreet and 20th Avenue per City
requirements.
