05-30-1972 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday,
May 30, 1972, at 7:30 P.M. , in the Council Chambers of the City Hall.
Present were Chairman Lohmann, members Knickerbocker, Lund, Sidla and Shirley. Also
p resent were Building Inspector Kohnen, City Engineer Strojan, City Manager Novak and
�' City Planner Hawks.
Case No. 72-03 Hearing to consider amending Ordinance No. 269 in regard to density of
nursing homes.
Action: Mr. Lund moved and Mr. Shirley seconded a motion to recommend to the
Council approval of the following amendments to Ordinance No. 269 :
269. 36 (9) Nursing Homes
(a) The site shall contain 600 square feet of land per person,
based on the design occupancy when the structure is
1 through 3 stories in height;
500 square feet of land per person based on the design
occupancy when the structure is 4 through 6 stories in
height and 400 square feet of land per person based on
design occupancy when the structure is 7 or more stories
in height.
(b) The site shall not be over 900 feet from a public transportation
stop area.
` (c) The building and parking area shall not occupy more than 2 the
area of the lot.
(d) A landscape plan for the site prepared by a landscape
architect be submitted which will accommodate outside living
areas.
Motion carried.
Case No. 72-06 Hearing on a request to change the name of Monk Avenue to Blake Road
from Excelsior Avenue north to State Highway No. 7.
Actions Mr. Sidla moved that the request be denied. Motion lost for lack of a
second.
Action: Mr. Lund moved and Mr. Knickerbocker seconded a motion to recommend to
the Council approval of the name change and that the managers of the
three apartment buildings on Monk Avenue be notified of the Council meeting
on June 6, 1972, by phone, so that they may inform their tenants.
Motion carried.
Case No. 72-09 Hearing on an application by Mr. James Marvy, DBA Marvy Advertising
� Photography for a Conditional Use Permit to operate a photographic
illustrations studio on Lot 24, Block 70, West Minneapolis Second
Division also known as 41 12th Avenue North.
Action: Chairman Lohmann ordered case tabled.
Action: Chairman Lohmann ordered a hearing to amend Ordinance 269.37 Subd. 2.
Conditional Uses in the R-5 District.
Case No. 72-12 Hearing on an application by R. J. Walser for a Conditional Use Permit
for an off street parking lot to be used for new car storage on a
temporary lease with Hennepin County on the old American Legion property
located at 17 West Excelsior Avenue.
Action: Mr. Sidla moved and Mr. Lund seconded a motion to recommend to the
Council approval of the permit with the condition that a fence 6 feet
high be constructed 3 feet from the rear lot line of the R-1 zone and
6 foot fence around remainder of the area. Motion carried.
Mr. Shirley took over as chairman for the next case.
Case No. 72-08 Hearing on an application by G. F. Lohmann to rezone from B-1 (Limited
Business District) and from R-4 (Multiple Family District) to B-3b
part of Lot 68 Auditors Subdivision No. 239 for the purpose of
operating a movie theatre.
Action: Mr. Sidla moved and Mr. Lund seconded a motion that this request be
denied. Motion carried.
Zoning and Planning minutes of May 30, 1972 continued.
Mr. Lohmann resumed the chair at this time.
r Case No. 72-10 Hearing to consider adoption of an Official Map for the City of Hopkins.
Action: Chairman Lohmann ordered this case continued to the meeting of June 27,
19 72.
Case No. 72-11 Hearing to consider amendments to the sign section of the Zoning
Ordinance.
Action: Mr. Shirley moved and Mr. Knickerbocker seconded a motion recommending
to the Council that the following amendment to 269.50 Signs, Advertising
Lights and Devices be approved:
1. Add the following:
269.50 (Subd. 1 (p)) Lot for the purpose of calculating advertising
sign space shall exclude private roads approved as a part of a
Planned Unit Development or Community Unit Plan, pipe line or power
line easements, r�ilroad right-of-way and publicly held land.
2. Repeal Section 269.50 (Subd. 5 (a) and (c) and adopt in lieu thereof
the following:

269.50(a) The aggregate square footage of sign space per lot shall
not exceed the sum of four (4) square feet per front foot of property
plus one (1) square foot per foot of lot fronting on a side street
having a public right-of-way fifty (50) feet or more in width.
(c) Change "parking" to read "abuts a parking lot for public use. "
3.Repeal Section 269.50 (Subd. 6 (a) (b) and (c)) and adopt in lieu
thereof the following:
(a) Within the "B-3" and "I" use district any portion of the
aggregate square footage of permitted sign space may be allocated to
advertising signs (billboards) but no single sign surface shall
exceed two tiundred fifty (250)square feet and no billboard shall be
less than twenty (20) feet from the front lot line.
(b) Change ten (10) to read eight (8) .
(c) Billboards shall be subject to all yard requirements within the
"B" and "I" district, except as amended within this section.
4. Repeal Section 269.50 (Subd. 1 (m)) and adopt in lieu thereof the
following:
269.50 (Subd. 1 (m) Signs existing on the effective date of this
ordinance or amendment to this ordinance which do not conform to all
the regulations herein stated are a non-conforming use or structure and
as such shall be under the regulations set forth in Section 269.06 (7) .
5. Repeal Section 269.06 (7) and adopt in lieu thereof the following:
269.06 (7) Any lawful non-conforming use of land not involving a
structure, and any non-conforming use involving a structure with an
assessed value upon the effective date of this ordinance or effective
date of amendment to this ordinance of one thousand five hundred
($1,500)dollars or less, may continue for a period of thirty-six (36)
months after the effective date of this ordinance or effective date of
amendment to this ordinance, whereupon such non-conforming use shall
cease, unless brought into conformity.
Motion carried.
Case No. 72-11 Hearing to consider an amendment to the B-3 District of the Zoning
Ordinance.
Action: Mr. Lund moved and Mr. Shirley seconded a motion recommending to the
— Council that the following amendment to the B-3 section of the Zoning
Ordinance be approved as follows :
Repeal 269.42 Subd. 2 (2) and adopt in lieu thereof the following:
Subd. 2 (2) Dwelling units in the B-3b District subject to Section 269.36
and as regulated therein. Dwelling units in the B-3a District subject to
Section 269.37 and a regulated therein.
Motion carried.

� Action: Mr. Shirley moved and Mr. Lund seconded a motion to recommend to the
Council to save trees on llth Avenue North if possible when upgrading
streets. Motion carried.

meeting be adjourned. Motion carried.
