06-27-1972 A regular meeting of the Zoning and Planning Commission was held on June 27, 1972 at
7 :30 P.M. in the Council Chambers of the City Hall.
Present were Chairman Lohmann, members Knickerbocker, Malerich and Slaton. Also present
�` were City Manager Novak, Zoning Administrator Kohnen and City Planner Hawks.
At the opening of the meeting, Councilman Mr. McDonald gave a speech on his opinions on
how the nursing home request has been handled and suggested more cooperation between land
owners and developers.
Case No. 72-14 Hearing on an application by Mr. Jack Walser for a Conditional Use Permit
for a Special Purpose fence, chain link, 6 feet high with an inward
extension having three strands of twisted cable, 3 feet inside of property
line. Said fence to be erected on the following described property:
Parcel 3000 in Section 24 and part of Lot 11, Block 6, Parkridge,
also known as the old American Legion site.
Action: Mr. Knickerbocker moved and Mr. Malerich seconded a motion to recommend
approval to the council of the special fence permit. Motion carried.
Case No. 72-13 Hearing to consider amending Ordinance No. 269 by adding the following
as an additional provision to Section 269.37, Subdivision 2 (6)
"Photographic Illustration Studios"
Action: Dr. Malerich moved and Mr. Knickerbocker seconded a motion to recommend to
the Council approval of the amendment to the ordinance. Motion carried.
Case No. 72-09 Hearing on an application by Mr. James Marvy, DBA Marvy Advertising
Photography for a Conditional Use Permit to operate a photographic
illustration studio on Lot 24, Block 70, West Minneapolis Second Division
also known as 41 12th Avenue North.
Action: Mr. Knickerbocker moved and Dr. Slaton seconded a motion to recommend to
the Council approval of the Conditional Use Permit for P�arvy Advertising
Photography to operate a photographic illustration studio at 41 12th Avenue
North. Motion carried.
Case No. 72-16 Hearing on an application by Mr. James Ault for a variance to the side
yard requirements of ten feet in the R-1 District to one foot in the side
yard requirement at the rear of his garage addition to two feet at the
front of the addition. Said project to be constructed on the following
described property: Lot 3, Block 1, Campbells Addition also known as
353 Althea Lane.
Action: Dr. Malerich moved and Dr. Slaton seconded a motion to carry the case to
the July 11, 1972 meeting of the Zoning and Planning Commission so members
will have time to look at the property. Motion carried.
Case No. 72-15 Hearing to consider amending Ordinance No. 269 by adding the following
provision: 269.60 (9) Special Set Back Provisions.
Action: Dr. Malerich moved and Mr. Lohmann seconded a motion to recommend that the
proposed ordinance read 100 feet and be returned to the Council for
approval. Motion carried.
Case No. 72-03 Hearing to consider amending Ordinance No. 269 in regard to density for
nursing homes referred back to Zoning and Planning for further study of
changes recommended by Council.
Action: Mr. Knickerbocker moved and Dr. Malerich seconded the motion to recommend
that the proposed ordinance require 400 square feet of land area per person
for structures six stories in height. Both case numbers 72-15 and 72-03 to
be heard at the July 5, 1972 Council meeting. Motion carried.
Case No. 72-08 Re-hearing on a request for re-zoning of the G. F. Lohmann property on
Cambridge Street referred back from the Council for further study.

Action: Dr. Slaton moved and Dr. Malerich seconded the motion to carry over to the
July 11, 1972 Zoning and Planning meeting and all property owners and all
petition signers be notified by mail of this meeting. Motion carried.
Item: Hearing to consider adoption of an Official Map for the City of Hopkins.
Action: Mr. Knickerbocker moved and Dr. Malerich seconded the motion to send the
official map to the Council. Motion carried.
Zoning and Planning minutes of June 27, 1972 continued.
Item: Planning consultant review continued from June 13, 1972.
Action: Dr. Malerich moved and Mr. Slaton seconded a motion that letters be
sent to planning firms to get applications for a new planner.
Motion carried.
Item: Apartment security ordinance continued from June 13, 1972.
Action: Mr. Knickerbocker moved and Dr. Malerich seconded a motion to return item
to City Council to wait on Mr. Veselys opinion and ordinance. Motion
carried.
Action: Mr. Knickerbocker moved and Dr. Slaton seconded a motion that the meeting
be adjourned.

i NOTICE OF HEARING
WHEREAS, the Zoning and Planning Commission has ordered a hearing
to consider the following amendment to Ordinance No. 269:
Amend ordinance 269.36 Subd. 2 by deleting paragraph (9) and in
lieu thereof; (9) Nursing Homes and Board and Care Homes which are
certified for skilled and/or itermediate patient care by the State
provided:
(a) The site shall contain 600 square feet of land per person, based
on the design occupancy when the structure is 1 thru 3 stories in
height; 500 square feet of land per person based on the design
occupancy when the structure is 4 thru 5 stories in height and
350 square feet of land per person based on design occupancy when
— the structure is 6 or more stories in height.
(b) Z`he site shall not be over 900 feet from a public transportation
stop area.
(c) The building and parking area shall not occupy more than 1/2 the
area of the lot.
(d) A landscape plan for the site prepared by a landscape architect
be submitted which will accommodate outside living areas.
NOW, THEREFORE, it is hereby ordered that the Zoning and Planning
Commission of the City of Hopkins will hold a hearing on said amendment in
the Council Chambers in the City Hall of the City of Hopkins on June 27, 1972,
at 7:30 o'clock P.M. and that the Zoning Administrator shall give ten days
