05-14-1974 A special meeting of the Hopkins Zoning and Planning Commission was held on
Tuesday, May 14, 1974 at 7:30 P.M. in the Council Chambers of the City Hall.
Present were Chairman Shirley, members Arnold, Gaskell, Hance, Moll, Sidla
and Vassar. Also present were Acting City Manager Richardson, City Engineer
� Strojan, Zoning Administrator Kohnen and City Planner Bergly.
Item: Public hearing on proposed Comprehensive Plan and Zoning Ordinance
amendments continued from April 30, 1974.
A. Rewording Concerns :
1. Page 10: add "a", "b", and "c" under "dwelling units not occupying
first floor as secondary use"
a. subject to regulations in the R-4 District (C.U.P. in B-1 District)
b. subject to regulations in the R-5 District (C.U.P. in B-3 & B-4 District)
c. not subject to special regulations . (C.U.P. in B-2 District)
ACTION: Mr. Arnold moved and Mrs. Moll seconded a motion that the proposed
rewording be accepted. Motion carried.
2. Section 269.24, 25, 26, 27: add clause requiring posting of a sign on
all property proposed for an appeal, variance, conditional use permit,
zoning amendment or site plan review under 2-stage review section. Also
add to subdivision regulations . Also add that it is the owner or his
agent's responsibility to post these signs.

ACTION: Mr. Arnold moved and Mrs. Moll seconded a motion to accept this
change. Motion carried.
3. Section 269.28: 2 Stage Review - should have flow chart indicating review
timing and procedure (should be in Administrative Guidelines instead of
Zoning Ordinance) .
ACTION: Mr. Arnold moved and Mr. Hance seconded a motion to accept this
rewording. Motion carried.
4. Pages 6 and 16 : Frontyard setbacks : could add clause to require greater
or lessor setbacks for development in substantially developed areas that
have established setbacks different than ordinance requirements.
ACTION: No action on this. Already covered.
B. Basic Areas of Concern Expressed in 2 recent Public Hearings :
1. Area west of Poppin' Fresh Pies (Proposed as B-4, now I-2; suggested at
discussion meeting to recommend all this B-4 area back to I-2) .

ACTION: Mrs. Moll moved and Mr. Vassar seconded a motion to recommend this
B-4 area back to I-2. Motion carried. Mr. Arnold abstained.
2. Up to 4 attached S .F. units in R-2 District.
ACTION: Mrs. Moll moved and Mr. Sidla seconded a motion to leave R-2 as is.
Motion carried.
3. Eliminate Conditional Use Permit in R-1 for 2 to 4 units .
ACTION: Mrs . Moll moved and Mr. Vassar seconded a motion to accept this
change. Motion carried.
4. West Excelsior - 14th to 21st (proposed B-3b to B-1; discussed in staff
report) .
ACTION: Mr. Arnold moved and Mr. Sidla seconded a motion to make this area
B-4. Motion defeated. Arnold, Sidla and Vassar; Yea. Hance, Moll,
Shirley and Gaskell; Nay.
� Mr. Hance moved and Mr. Sidla seconded a motion to make this area
B-3.Motion passed. Arnold Nay. Rest of Commission voted yes.
Zoning minutes of May 14, 1974 continued.
Mr. Gaskell moved and Mr. Arnold seconded a motion to make 14th to
15th B-4 and 17th to 19th B-4 and the minimum lot size in B-4 40 feet
instead of 45 feet and the rest of the area to remain as is.
Motion carried. Moll and Hance voting no.
�" 5. Non-Conforming Density - financial nroblems. No action taken.
6. Higher R-4, R-5, R-6 densities , no height limitations. No action taken.
7. SW corner Co. Rd. 18 (5th Avenue) and Highway 7 (proposed as R-3, now R-4) .
Compromise d ensity approved during "moratorium" in R-4 district. City
committment should probably stand.
ACTION: Mr. Sidla moved that this area remain R-4. Motion died for lack of a
second.
Mr. Gaskell moved and Mr. Arnold seconded a motion that this item be
removed from the table and be left as proposed. Motion carried.
Sidla voting no.
8. Zakariasen - does not like restricted densities and uses (discussed in
staff report; proposed as R-4, now B-1) .
ACTION: Mrs . Moll moved and Mr. Hance seconded a motion to leave this area
B-1. Motion carried.

9. Dr. Olson - resolved, wishes to leave proposed B-1 zoning. Area neighbor
wants R-2, not some of B-1 Conditional Uses.
ACTION: Mrs. Moll moved and Mr. Hance seconded a motion to leave as proposed
B-1. Motion carried. Arnold voting no.
10. Rear Yard setback in B-4 abutting residential - wants 25 foot setback from
district boundary, not lot line.
ACTION: Mr. Gaskell moved and Mr. Vassar seconded a motion that rear yard
setback in B-4 abutting residential wants 25 foot setback front
district boundary, not lot line. Motion carried. Arnold and Moll
voting no.
11. Use setback that has been established for existing developed areas whether
more or less than ordinance provisions. No action taken.
12. SE Highway 7 and 5th Avenue - wants R-2 or R-3, not R-1; realtor wants
business zoning for neighborhood convenience store.
� ACTION: Mr. Gaskell moved and Mr. Vassar seconded a motion that no action
be taken. Motion carried.
13. NE Excelsior Boulevard and Blake Road (proposed to remain in R-4 District)
owner wants B-1. No action taken.
14. Property owner west of NW Bank wants R-6 or Hi-Rise zoning, not R-5.
No action taken.
15. Hiawatha Avenue Group wants strip of R-3 changed to R-2, wants neighborhood
input opportunity during site planning stages.
a. The development plan, apparently reviewed along with the Ramsgate
Apartments , indicated this strip for Townhouse Development as a future
use of the land. Subsequent site plan approval for a specific town-
house proposal established the number of units allowed and the
arrangement of buildings on the site.
b. This strip of land is a very attractive amenity in the neighborhood and
serves as a buffer between the single family homes and the apartment
complex. The slope of the land and the mature trees as well as the
� underbrush provide a visual as well as a physical separation between
two dissimilar densities.
c. Ideally, the land should remain as a buffer, but with previous city
committments , the value would undoubtedly be prohibitively high for
City acquisition or just to be left vacant in the present ownership.

d. At the initial point of Ramsgate approval, 20 to 25 additional
apartment units in the apartment complex may have allowed this

strip to remain as permanent open-space.
e. R-2 development would very likely be most appropriate with the
units facing Hiawatha Avenue instead of the Ramsgate garages. This
orientation would perhaps not be acceptable to the Hiawatha residents
either.
f. As indicated by both the public and the Planning Commission through
the public hearings , previous city committments must weigh heavily
on rezoning decisions. The comprehensive plan is really a general
committment to guide development.Man� other more specific committments
are made through negotiations in the development of a City. No 1 above
still must bear considerable weight in this zoning decision.
ACTION: Mrs . Moll moved and Mr. Arnold seconded a motion to make this strip of
land R-2. Motion carried.
C. Rewording needed in new ordinance due to hearings and previous discussion.
1. 269.07 (4) change to conform with table in Residential regulations on
page 6.
� (4) special clause for attached buildings - must meet principal
building setbacks.
ACTION: Mr. Gaskell moved and Mr. Arnold seconded a motion to accept this
re-wording. Motion carried.
2.after 269.32 page 3: add 3 & 4 family attached dwellings as permitted in
R-2 and R-3 conditional use in R-4, 5 and 6.
page 4: re-define certain allowable use terminology
page 5 : add signs and off street parking as accessory uses.
page 6: front yard R-6 3/4 bldg. ht. but not less than 20 feet
nor more than 35 feet.
page 7: change side yards to conform with 269.07 above
"common" instead of "usable" open space as in definition
ACTION: Mr. Arnold moved and Mrs. Moll seconded a motion to scratch page
3 rewording, pages 4, 5, 6 and 7 to be accepted. Motion carried.

3. 269.60 add paragraph (9) , copy 269.42, paragraph 12 from old ordinance
relatzng to drive-in establishment.
add clause for minimum frontage in R-5 and R-6 districts relating
to left over parcels that are too narrow to meet minimum width
requirements.
numerous definition changes as per meeting with attorney and other
incidental corrections to aid in interpretation and readability.
ACTION: Mr. Arnold moved and Mrs . Moll seconded a motion to accept the rewording
on. 269.60. Motion carried.
D. Ordinance changes.
ACTION: Mr. Sidla moved and Mr. Gaskell seconded a motion to send this
amended ordinance on to the City Council. Motion carried.
ACTIC!N: Mr. Arnold moved and Mr. Gaskell seconded a motion that the meeting
be adjourned. Motion carried.
