09-24-1974 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, September 24, 1974, at 7:30 P.M. in the Council Chambers of the City `,,, Hal l. Present were Chairman Shirley, members Hance, Milbert, Moll, and Sidla. Also present were City Manager Cotton, City Planner Bergly, City Engineer Strojan, City Clerk Richardson, City Attorney Vesely, Mayor Pokorny, Councilman McDonald, Vassar and Zoning Administrator Kohnen. Case No. 74-04: Public Hearing on an application by Peterson-Hede Plastering Contractors Inc. to re-zone from R-3 (One Family Townhouse) to I-1 (Industrial Limited) the following described property: Lots 5, 6, 7 & 8, Block 1, West Minneapolis Third Division also known as 314 17th Avenue North. Action: Mr. Sidla moved and Mrs. Moll seconded a motion to recommend to the City Council denial of the zoning change request for the following reasons: 1. The non-conforming provision is specifically intended for this type of operation. The use was legally existing at the time the ordinance was adopted, however, as times change the appropriate method of development also changes. It has been determined that the RR provides a reasonable definition and separation of dissimilar use districts (Business and Residential) . As long as the existing use remains at ~ its present or lessor size and intensity it is allowed to remain as a "non-conforming" use. Long range city plans are that someday the use will be residential, and further expansion which would be allowed in the I-1 District would not be in the best interests of the City. 2. The proposed rezoning would result in the smallest zoning district in Hopkins and would very likely be interpretted to constitute "spot" zoning. 3. The I-1 District will permit a wide variety of uses that would be far more incompatible than the existing use. A zoning district is for a general use category (i.e. Business , Industrial etc.) and is not intended to offer the City a means of allowing only one individual a specific type of use within a broad use category. 4. Both the existing and proposed comprehensive plans indicate a Multiple Family Residential use for the property. Motion carried. Item: Request by Mr. Randall for a rear yard variance for the property located at 153 Oakwood Road to build a second floor above his attached garage and part of hishouse which encroaches the rear yard setback. His rear yard setback is 132 feet and the ordinance reads 30 feet for this location. � Action: Mr. Sidla moved and Mr. Hance seconded a motion to recommend to the City Council approval of the rear yard variance with the stipulation that Mr. Randall bring in a petition with the signatures of all property owners within 350 feet of his property that they do not object to this variance and present it to the City Council when he appears for his variance. Motion carried. Action: Mr. Sidla moved and Mr. Milbert seconded a motion that the Zoning and Planning meeting be adjourned. Motion carried. Item: Joint meeting with City Council and Zoning and Planning Commission on a discussion of Planning Philosophy as it relates to the proposed ordinance: 1. General philosophy of Zoning by Mr. Joseph Vesely, City Attorney 2. History and reasons behind the reviewing of the old zoning ordinance by Chairman James Shirley. 3. Discussion on contradictions between the stated philosophy and and the new zoning ordinance by John Bergly. 4. Open discussion 5. Comments from audience 6. Possible future action Action: Council is to set up meeting to follow through on new zoning ordinance in October. Action: Mr. Milbert moved and Mr. Hance seconded a motion that the meeting be adjourned. Motion carried.
