10-29-1974 A regular meeting of the Hopkins Zoning and Planning Commission was held on ` ' Tuesday, October 29, 1974, at 7:30 p.m. .in the Council Chambers of the City Hall. Present were Chairman Shirley, members Hance, Milbert, Moll and Gaskell. Also present were City Manager Cotton, City Planner Bergly, City Engineer Strojan and Zoning Administrator Kohnen. Item: Public Hearing to consider a proposed Flood Plain Zoning Ordinance, pursuant to Minn. Statutes C. 104 (Flood Plain Management Act) . Action: Mr. Bergly explained the proposed ordinance and answered questions from the audience and commission. Mr. Milbert moved and Mrs. Moll seconded a motion to continue this item until November 26, 1974 meeting. Mr. Bergly was instructed to get the St. Louis Park and Edina Flood Plain Ordinances for the commission to study and have a representative from the Flood Plain Committee at the November 26th meeting to answer questions. Motion carried. Item: Preliminary review of plans for Mr. Donut Shop to be located just south of Excelsior Avenue on 6th Avenue. Action: Mrs. Moll moved and Mr. Hance seconded a motion to recommend to the City Council approval of the Donut Shop building plans with the condition that � they work with Mr. Bergly and Mr. Strojan to design a better parking plan. Motion carried. Case No. 74-06 Hearing on an application for a sign variance setback of 15 feet instead of the required 30 feet for Cambridge Towers apartment located at 1301 Cambridge Street N.E. Action: Mr. Gaskell moved and Mrs. Moll seconded a motion to recommend to the City Council denial of the sign variance setback of 15 feet instead of the required 30 feet. Motion carried. Case No. 74-07 Hearing on an application for a Conditional Use Permit to fill low land with clean fill, compact it and improve the grade at 116-126 Blake Road North. Action: Mr. Gaskell moved and Mr. Hance seconded a motion to recommend to the City Council approval of the Conditional Use Permit to fill low land at 116-126 Blake Road North with the provision that the owner submit to the Zoning Administrator a drainage plan and a soil test report. Motion carried. Case No. 74-08 Hearing on an application for a variance in the side yard requirement �" of 10 feet to 4 feet for addition to a garage located at 106 Ridgewood Drive. Action: Mr. Gaskell moved and Mr. Hance seconded a motion to recommend to the City Council approval of the side yard variance to allow Mr. Wirkkula to put an addition on the rear of his present garage. The Commission requested that Mr. Wirkkula have his neighbor to the south sign a letter that he has no objection to this variance. Motion carried. Item: Review of plans to enclose the loading dock at National Foods. Action: Mr. Gaskell moved and Mrs. Moll seconded a motion to recommend to the City Council approval of the enclosure to the loading dock at National Foods. Motion carried. Action: Mr. Milbert moved and Mr. Gaskell seconded a motion that the meeting be adjourned. Motion carried. Jamd Shirley, Chairman CITY OF HOPKINS MINNESOTA ` NOTICE OF HEARING BY ZONING & PLANNING COMMISSION ON PROPOSED FLOOD PLAIN ZONING ORDINANCE Notice is hereby given that a Public Hearing will be held by the Hopkins Zoning and Planning Commission in the Council Chambers in the Hopkins City Hall at 1010 First Street South, Hopkins , Mn. , Tuesday, October 29, 1974 commencing at 7:30 P.M. to consider a proposed Flood Plain Zoning Ordinance, pursuant to Minn. Statutes, C. 104 (Flood Plain Management Act) . Changes or amendments may be added as a result of the Public Hearing. Said Public Hearing may be continued from time to time upon motion duly carried without further published, mailed, served or other public notice thereof. The following outline summarizes the key points of the ordinance. For specific information, a copy of said proposed Flood Plain Zoning Ordinance and accompanying flood plain maps as recommended for adoption are available for inspection in the office of the Zoning Administrator or City Manager at Hopkins City Hall. A. Within the Flood Plain the existing Zoning Ordinance shall determine allowable � uses, which uses are further limited as follows : 1. Within the flood plain: a. No land use or obstruction shall be changed, constructed, erected, added to, altered, placed or done; No utilities shall be installed; No road shall be placed on the land, without being in full compliance with all applicable ordinances of the city or without first obtaining a conditional use permit therefore, pursuant to the Flood Plain Ordinance. 2. No conditional use permit shall be issued for any use or obst�uction to be placed in the flood plain unless the following provision is met: All of the land within 100 feet of the centerline on all sides of the water course contiguous to the land for which a conditional use permit is being considered shall be dedicated to the city or shall be retained in permanent easement in favor of the city for the purpose of widening, deepening, sloping, improving or protecting the beds and banks of the creek and the flood plain for hydraulic efficiency. B. No conditional use permit shall be issued for a use or obstruction which: 1. Will or may raise the level of the flood plain more than 2 foot within the reach of the obstruction or use. "Reach" is the longitudinal segment of a stream influenced by natural or manmade obstructions such as culverts, bridges, etc. � 2. Will or may restrict the right of public access and use of beds, banks and water of the stream. 3. Will or may adversely affect surface and ground water supplies. 4. Will or may be incompatible with the natural areas. 5. Will or may interfere with natural ponding of surface water. 6. Has not had the approval of all governmental bodies having jurisdiction. C. No conditional use permit shall be issued for: 1. Fill which will not have beneficial purpose 2. Garbage or waste disposal sites or systems. D. Public utilities, roads , railroads, and bridges shall be designed to minimize increases in flood elevations. E. Devices and measures for flood control 1. If such device will raise flood elevation the C.U.P. must reflect such increase. 2. If such device will lower flood elevation it cannot be used to calculate elevations for C.U.P. until device is operative. F. Elevations of structures, sites and site features 1. Structures - finished floor must be above regulatory flood protection elevation 2. Finished fill elevation - at least 15 feet beyond limits of structure � must not be lower than 2 feet below regulation flood protection elevation 3. Yards, parking lots, etc. may be lower than the regulatory flood protection elevation as specified in C.U.P. � 4. Storage or processing of materials that may be buoyant, flammable, explosive or injurious to human, animal or plant life is prohibited G. Variances permitted only in undue hardship cases. H. Non-conforming existing uses allowed to continue after obtaining all required C.U.P. permits and variances . - discontinuance of such non-conforming use for 12 consecutive months or damage of over 50% will thereafter require conformance.
