02-24-1976 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, February 24, 1976, at 7:30 p.m. in the Council Chambers of the City Hall. � Present were Chairman Arnold, members Gaskell, Moll, Morrill, Slaton and Stefan. Also present were City Manager Cotton, City Engineer Strojan and City Planner Hawks. Item: Approve and sign minutes of January 24, 1976 meeting. Action: Mr. Gaskell moved and Mr. Stefan seconded a motion to approve the minutes of January 24, 1976 except to delete the word "pathways" in the recommendation to the Council on the Blake Road Public Hearing and insert the words "study of pathways" in lieu thereof. Motion carried. Item: Preliminary review of plans for an apartment complex to be located on the south- west corner of 7th Street and 9th Avenue South. Action: Mrs. Moll moved and Mr. Stefan seconded a motion to continue this item to March 30, 1976 for further information on the following points: l. leaal opinion on status of previously issued Conditional Use Permit 2. adherence to pending flood plain ordinance 3. soil information 4. conformance to proposed zoning ordinance Motion carried. �. Case No: 76-01 Request for a variance to the sign ordinance to permit a sign to extend more than 6 feet above the roof of a building and to exceed the square footage allowed. Action: Mrs. Moll moved and Dr. Slaton seconded a motion to continue the request f_or a variance until March 30, 1976 to enable staff to clarify legal status of existing sign. Motion carried. Case No: 76-02 Application by Mr. Rudy Luther for a Conditional Use Permit to operate an open sales lot in the B-3a District. Action: Mr. Gaskell moved and Mrs. Moll seconded a motion to recommend to the City Council approval of a Conditional Use Permit to operate an open sales lot subject to applicant complying with the following: a. that the surface drainage and plan is approved by the City Engineer b. that a physical barrier be constructed along the property line to protect the pedestrianway according to design described as follows - c. that no trucks over 9000 lbs. g.w. shall be parked next to public walk d. that all lights shall be mounted and directed such that the direct source shall not be visable from the right-of-way. �- Motion carried. Stefan voting no. Note: At this point in the meeting, Mr. Arnold left the meeting and Mr. Gaskell assumed the chairmanship. Case No: 76-03 Request by Mr. Blomquist for Waiver of Platting procedures to permit division of a legally platted lot into two parcels. Item: Dr. Slaton moved and Mrs. Morrill seconded a motion to recommend to the City Council that a waiver of the platting requirements be granted. Motion carried. Case No: 76-04 Request by Mr. Bentley for P7aiver of Platting procedures to permit division of a legally platted lot. Action: Mr. Stefan moved and Mrs. Morrill seconded a motion to recommend to the City Council that a waiver of the platting requirements be granted with the condition that the applicant assume the responsibility and cost of vacating the public utility easements along the side lot line and make provision for re-spreading of any existing assessments. Motion carried. Item: Annexation of property located at Shady Oak Road and County Road #3. � Action: Mrs. Morrill moved and Mr. Stefan seconded a motion to recor.unend to the City Council that the property be annexed. Motion carried. Zoning & Planning minutes of February 24, 1976 continued. � Action: Dr. Slaton moved and Mrs. Morrill seconded a motion that the meeting be adjourned. Motion carried.
