08-31-1976 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday,

August 31, 1976 at 7:30 P.M. in the Council Chambers of the City Hall.
Present were Chairman Arnold, members Moll, Morrill, Gaskell and Hance. Also present
were Zoning Administrator Kohnen, City Manager Cotton and City Enaineer Strojan who
sat in with the commission as an ex-officio non-voting member.
Item: Approve and sign minutes of June 29, 1976 regular meeting, minutes of special
meeting July 12, 1976 and the regular meeting of July 27, 1976.
Action: Continued to September 28, 1976 meeting.
Item: Discussion of old and new business by commission members only.
Action: Mrs. Moll moved and Mrs. Morrill seconded a motion that Zoning and Planning
Commission adopt a resolution requesting the City Council for a recording
secretary for Zoning and Planning meeting. Motion carried.
Item: Correspondence from Minnetonka regarding changing the name of llth Street South
to Smetana Road, continued from July 27, 1976 meeting.
Mr. Don Asmus from Minnetonka Public Works Department e�lained the reasons

for the name change.
Action:Mr. Gaskell moved and Mrs. Moll seconded a motion to recommend to the City Council
approval of name change providing we keep our numbering system and the change is
approved by the Hopkins Postmaster. Motion carried.
Mr. Arnold requested his vote be recorded in the minutes as "yes".
Case No: 76-16 Hearing on an application by Red Owl Stores Inc. for the vacation of
Adams Avenue and First Street North from Excelsior Avenue to the Burlington
Northern right-of-way.
Action: Mr. Gaskell moved and Mrs. Moll seconded a motion to continue this item to
the meeting September 28, 1976 so a Red Owl representative may present the
request and answer Zoning and Planning Commission questions. Motion carried.
Case No: 76-17 Hearing on an application by the Church of St. Joseph located at
1310 Excelsior Avenue West to rezone from B-3b (General Business District) to
R-5 (Multiple Family Residential) for the purpose of leasing the convent building
to the Childrens Home Society of Minnesota for unwed mothers.

Action: Mrs. Morrill moved and Mr. Arnold seconded a motion to recommend to the City
Council approval of the zone change from B-3b to R-5.
Motion f_ailed. Tie vote: Morrill and Arnold yea; Gaskell and Moll nay.
Mr. Gaskell moved to am.end the proposed motion to make the rezoning contingent
on the use as proposed _qoing ahead. Died for lack of second.
Mr. Arnold made a motion to reconsider the original motion, seconded by Hance.
Mr. Arnold moved and Mr. Hance seconded a motion to recommend to the City Council
approval of this zonina change and amend the proposed ordinance to include this
change. P�otion carried. Mrs. Moll voted no.
Item: Proposed By-Laws for the Planning Commission.
Action: Al1 comments are to be submitted to Mr. Gaskell before the 15th of September
so they can be included in the By-Laws for review at the September 28, 1976
meeting.

Action: Mr. Arnold moved and Mr. Hance seconded a motion that the meeting be adjourned.
Motion carried.

WHEREAS, the Zoning and Planning Commission of the City of Hopkins
has ordered a hearing on an application from the Church of St. Joseph to
rezone from B-3b (General Business District) to R-5 (Multiple Family
Residential) the following described property
Parcel 5000 in Section 24, Township 117, Range 22
also known as 1310-1320 Excelsior Avenue West
for the purpose of leasing the convent building to the Childrens Home
Society of Minnesota for unwed mothers.
�, NOW, THEREFORE, it is hereby ordered that the Zoning and Planning
Commission of the City of Hopkins will hold a hearing on said rezoning
in the Council Chambers of the City Hall of the City of Hopkins on
August 31, 1976 at 7:30 o'clock P.M.

ordered a hearing to consider vacating Adams Avenue from the northerly right-
of way line of Excelsior Avenue to the easterly right-of-way line of the Great
Northern Railroad (now Burlington Northern) . Also that part of First Street
North which lies west of Adams Avenue and easterly of the easterly right-of-way
line of the Great Northern Railroad (now Burlington Northern) . Legal descri�tion
of premises adjacent, Tract A, Registered Land Survey No. 505,
NOW, THEREFORE, it is hereby ordered that the Zoning and Planning Commission
