05-31-1977 A regular meeting of the Hopkins Zoning and Planning Comrnission was held on `, Tuesday, May 3I, 1977, at 7:30 p.m. in the Council Chambers of the City Hall. Present were Chairman Gaskell, members Hance, Loberq, Marker and Stefan. Dr. Slaton came at 9:00 after a joint meeting of the Council and Park Board. A1so present were City Manager Craig, City Engineer Strojan, Zoning Administrator Kohnen and City Planner Hawks. Item: Mr. Hance moved and Mr. Marker seconded a motion that the minutes of Apri1 26, 1977 be approved and signed. Motion carried. Item: Mr. Hance was elected Vice-chairman due to the resignation of Susan Morrill. Item: A joint communication from the Interlachen Park Association and 5t. Johns Church states that the parking problems have been resolved. The commission feels that they should review the situation again in a few months to make sure everything is working out as expected. Item: Memo from City Planner regarding the Rollin Chi1d Tile Company and their desire to build up to the sidewalk. The commission instructed staff to have Mr. ChiZd appear at the next meeting ` to review his request and discuss the problems. Case No: 77-04 Hearing on an application by r�r. G. A. Duda for a variance to the side yard requirements of 15 feet in the R-3 District to Z1 feet on one side, variance to the front yard requirement of 35 feet to 30 feet, and also Iot area requirement. Said variances are for the construction of a single family residence on Lot 2, B1ock 58, West Minneapolis, also known as 606 lOth Avenue South. Mr. Duda stated his desire to build a single family residence on the lot and stated that the majority of the homes in the area are built on 40 and 50 foot lots. Action: Mr. Stefan moved and Mr. Loberg seconded a motion to table the item to the meeting of June 28, 1977 to correct or redirect the thrust of the difficulty of the 40 and 50 foot lots as they exist in the city now. Motion carried. Mr. h7arker voting no. Case No: 77-05 Hearing to consider vacating the 33 foot east-west roadway easement on the south part of Parcel 8800, Section 23, Township 1I7, Range 22, also known as 300 21st Avenue North. � Mr. Wille explained the location of the easement and his desire to build a single family residence on that portion of the lot. A4r. Carl Bjorklund of 11701 Highway No. 7, said property located in the City of Minnetonka and abutting the west boundary of the Wille property, expressed concern over Iosing access to 21st Avenue North if the easement were vacated. Mr. Kovar of 250 21st Avenue North expressed concern over not being able to Zocate his property stakes. Action: Mr. Stefan moved and Dr. Slaton seconded a motion to get clarification from the City Attorney as to our Iega1 obligation to the City of Minnetonka to retain the easement as a result of the annexation; if the proper description of and definition of the property lines does in any way change Mr. Willes survey as shown, does he remain in conforrnance; an opinion from Mr. Hawks as to what our obligations are outside of Hopkins for the meeting of June 28, 1977. Motion carried. Case No: 77-06 Hearing on an application by Mr. Dave Vanek for variances to build a double bungalow on the South half of Lot 3, Block 2, Stevens Oakwood Park, ` also known as 217 Jackson Avenue North. Action: Mr. Stefan moved and Mr. Loberg seconded a motion to deny the request of variances to build the double bungalow. Motion carried. Planning Commission minutes of May 31, 1977, continued. `, Case No: 77-07 Hearing to consider vacating alleys in Block 69, West Minneapolis Second Division. Action: Dr. Slaton moved and Mr. Hance seconded a motion to recommend approval of the vacation of the alleys in B1ock 69, West MinneapoZis Second Division. Motion carried. Case No: 77-08 Hearing on an application by Mr. Dennis Roof for a variance to the Iot area requirement of 7000 sq. ft. in the R-1-A District to 6569 sq. ft. to use the existing dwelling as a double residence located on Lot 14, Block 80, West Minneapolis Second Division also known as 105 9th Avenue North. Mr. Roof told the commission of his desire to continue renting the dwelling at 105 9th Avenue North as a duplex and his plans to upgrade the property both inside and outside. Mr. Klugman expressed his desire to see the property revert back to a single family residence because of the problems they have had in the neighborhood and that if the residence is continued as a duplex the desire for restrictions to be placed at the time of granting a variance. He presented petitions against the dupZex and for restrictions if granted. � Mr. Nathan Warner, property owner across the a11ey expressed the same concerns. Action: Mr. Hance moved and Mr. Loberg seconded a motion to deny the request for a variance for an illegal duplex because there was no true hardship. Motion lost. Mr. Marker moved and Dr. Slaton seconded a motion to table the item until June 28, I977 to determine a plan agreeable with the property owner and neighbors. Motion carried. Mr. Stefan and Mr. Hance voting no. Item: Mr. Frank Ze11e of Ryan Construction presented more detailed plans for the Taits Super Va1u store showing the fire exit, truck loading and shredder that was requested by the commission at the last meeting. Action: Dr. Slaton moved and Mr. Hance seconded a motion to approve the Stage I review, Stage II is to have a landscape plan and more complete details about the shredder. Motion carried. Item: Mr. Rod Hillstrom presented plans for the construction of a truck storage garage for the Super Valu Warehouse. .� Action: Dr. Slaton moved and Mr. Marker seconded a motion to approve the Stage I and Stage II review of the plans for a truck storage garage for the Super Valu Warehouse if the plan does not exceed the 60� ratio. Motion carried. Item: Romens Construction Company presented a proposal for the propert� located at 1605 Excelsior Avenue West to be used as an Interior Design Consulting Service. Action: The commission was favorable with the proposed use of the property. Item: Proposal by Dominon Construction Company for the Schober property located on Tyler Avenue North. No one was present at the meeting to present plans. Item: Mr. Craig explained the Open Space Grant for South Hopkins. Mr. Russell Lindquist, attorney for Minneapolis Floral, wanted to know what density they could expect on the 15 acres if the property were to be sold for some other use. The commission suggested that Minneapolis Floral come back to the next meeting with some plans for a Planned Unit Development. `.
