10-25-1977 A reguZar meeting of the Hopkins Zoning and PZanning Commission was held on
Tuesday, October 25, 1977, at 7:30 p.m. , in the Council Chambers of the City

Present were Chairman Gaskell, members Hance, Loberg, Marker and Slaton. Also
present were City Manager Craig, City Engineer Strojan, Zoning Administrator
Kohnen and City Planner Hawks.
Item: Mr. Hance moved and Dr. Slaton seconded a motion that the minutes of
September 27, 1977 be approved and signed. Motion carried.
Item: Discussion on proposed changes to the Zoning Ordinance.
The commission discussed the proposed changes in the F1ood Plain section
of the ordinance and decided to have Mr. Hawks contact the D.N.R. to have
a representative at the next meeting to explain the proposed changes.
The commission was in agreement with Items 9 and IO of the proposed changes
and accepted them as prepared. Items 1 and 2 are to be rewritten for the
next meeting.
Item: Mr. Hagen and Mr. Sandy Ritter, architect, presented plans for the City
owned disposition parcel at the northeast corner of ZOth Avenue and First
`, Street South for a four story building consisting of offices on the first
floor and three fZoors of apartments above and to include parking.
Mr. Hance asked that Mr. Hawks summarize the various concepts proposed to
date and have ready for the next meeting.
Dr. Slaton moved and Mr. Loberg seconded a motion that the matter be continued
to the next meeting. Motion carried.
Case No: 77-19 Hearing to consider an application by Mr. Laurel of 313 Farmdale
Road to waive the pZatting requirements to a11ow division of Lot 2, B1ock 10,
Hobby Acres Lohmann Aarhus Division.
Residents of the area spoke both in favor and against the division of the Iot.
Mr. Marker moved and Dr. Slaton seconded a motion recommending denial of the
request for waiver of the platting requirezr�ents and variance of the Zot size
in the R-1-D zone. After discussion Mr. Marker withdrew his motion.
Nlr. Marker moved and Mr. Hance seconded a motion recommending denial of the
request for waiver of the platting requirements. Motion carried.

Dr. SZaton moved and Mr. Loberg seconded a motion that the record show that
the Zoning and Planning Commission does not recognize the 1972 waiver of the
platting requirements on this lot. Motion carried.
Case No: 77-20 etc. Hearing to consider an application by Mr. Rudy Luther for the
foZlowing:
1. Conditional Use Permit to construct a PUD (Planned Unit Development)
consisting of a nursing home and convenience center at the northeast
corner of Blake Road and ExceZsior.
2. Rear yard variance from 25 feet to 21 feet for the nursing home relative
to the PUD project.
3. Height variance from four stories to six stories for the nursing home.
4. Lot area variance of 600 square feet to 356 square feet for each person
to be accomodated in the nursing home.
5. Waiving the plafting requirements to a11ow division of the property into
two parcels.
Mr. Perbix, attorney, presented the request to the commission. Also appearing
in behalf of Mr. Luther were ldr. Treberg, architect, Mr. Thayer, consultant
.r and builder, and Mr. Harvey, partner of Mr. Perbix.
Residents of the area expressed the following concerns:
. additional right-of-way needed for the Blake-Excelsior interchange
. the height of the nursing home
Planning Commission minutes of October 25, 1977 continued.
. exterior appearance of the nursing home
�. . parking for the apartment complex
. fewer beds or a Zower building for the nursing home
. green space sufficient
. are there areas where the people can be outside
. uses in the convenience center
The commission expressed the following concerns:
. height of nursing home
. total plan approval at one time to assure construction of the convenience
cen ter
. building closer to residentiaZ area than required 300 feet
Mr. Hance moved and Mr. Marker seconded a motion recomir�ending to the City
Council the granting of a Conditional Use Permit to construct a PUD Development
consisting of a nursing home and convenience center on the northeast corner of
Blake Road and Excelsior Avenue with a rear yard Variance from 25 feet to 21 feet,
a height Conditional Use Permit from four stories to six stories, a Variance
from 300 feet to 152 feet of setback from a residential area to permit a
structure in excess of four stories, a Iot area variance of 600 square feet to
356 square feet for each person to be accomodated in the nursing home and
waiving the platting requirements to divide the property into two parcels.
Dr. Slaton moved and Mr. Marker seconded a motion to amend the original motion
to include having the City Attorney draw up a contract to hold the developer
to the construction of the convenience center. Motion carried. Mr. Loberg
voting no.
Chairman Gaskell calZed for a vote on the original motion as amended. After
considerable discussion Mr. Loberg moved and Dr. Slaton seconded a motion
to continue the hearing to the next reguZar meeting. Mr. Hance and Mr. Marker
voting no. Chairman Gaskell voted yea. Motion carried.
Item: Concept approval of a project to be constructed on the northeast corner of
7th Street and llth Avenue South.
Mr. Marker moved and Mr. Hance seconded a motion to have the staff study
the project and report back at the next meeting. Motion carried.
Item: Request from Hennepin County for approval of a Registered Land Survey on the
property owned by Red Owl at the northeast corner of County Road 18 and
Excelsior Avenue.
` Mr. Hance moved and Mr. Loberg seconded a motion recommending to the City
Council approval of the Registered Land Survey. Motion carried.
Mr. Hance moved and Mr. Marker seconded a motion that the meeting be adjourned.
Motion carried.
