04-25-1978 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday,
� April 25, 1978, at 7:30 p.m. , in the Council Chambers of the City Hall.
Present were Chairman Hance, members Eaves, Marker, Slaton and Treanor. Also present
were City Manager Craig, City Engineer 5trojan, Zoning Administrator Kohnen and City
Planner Hawks.
Case No: 78-05 & 05
Hearing on an application by Mr. Anthony R. Tempesta for a Conditional Use
Permit to construct eight - 4 plex's and a front yard variance from 35 feet
to 25 feet for the project to be located at the southwest corner of 7th
Street and 9th Avenue South, continued from the March 28, 1978 meeting.
Mr. Tempesta reviewed the request with the commission and the letter that
was received from the Watershed District.
Action: Dr. Slaton moved and Mr. Marker seconded a motion to recommend to the Council
approval of the variance for the front yard but to continue the Conditional
Use Permit to the next meeting so that the outside architecture can be
varied on the eight buildings and the commission can review the plan and
final grading approved by the Watershed District. Motion carried.
� Case No: 78-07
Hearing on an application by b4r. Hammerlund for a variance to construct an
eight foot security fence around Lots 19, 7_0 and 21, Block 2, West D4inneapolis
also known as 58 6th Avenue South.
Mr. Hammerlund presented his request to the commission.
Mr. Duda, resident adjoining the Hammerlund property, wanted to be sure that
work would not be done outside in the fenced area due to a noise problem.
Mr. Robbins of Robbins Auto Cleaners stated that he was not opposed to
the fence.
Action: Mr. Marker moved and Mrs. Treanor seconded a motion recommending to the
Council approval of the variance to construct the security fence. Mr. Eaves
and Dr. Slaton voting no. Mr. Hance broke the tie voting no. Recommendation
to the Council would be to deny the request for the variance.
Item: Concept review of Perkin�s to be located at Highway No. 7 and Shady Oak Road.
Mr. John Solar of Perkins presented the proposed plan to the commission.

Mr. John Stech of 226 West Park Road stated that 21 residents in the area
were very much opposed to that type of business. They prefer to keep it
residential.
Action: Dr. Slaton moved and Mr. Eaves seconded a motion to recommend to the Council
that the commission was not in favor of that type use in the area.
Item: Appearance by Mr. Jim Howe concerning a possible restaurant in one of the
old Moline buildings.
Mr. Howe explained to the commission the type of restaurant he was interested
in building and wanted the feelings of the commission before he went further
with his plans.
The commission viewed his ideas favorably.
Case No: 78-09
Hearing on an application by D4r. Curt Reinhold to consider Waiving of
Platting requirements to allow division of a property into two parcels at
228 Tyler Avenue North.

Action: Mr. Marker moved and Dr. Slaton seconded a motion recommending to the Council
approval of the waiver subject to publication of the amendments to the Zoning
Ordinance and a 25 foot right-of-way easement across the back of the property.
Motion carried.

Case No: 78-10
Hearing on an application by Gregory R. Rusch for side yard, rear yard and
parking variances to construct a building at 1842. Excelsior Avenue West.
Mr. Rusch presented his plans to the commission.
Action: Dr. Slaton moved and Mr. Eaves seconded a motion to continue this case to
the next meeting so that Mr. Rusch can work with staff to come up with a
new plan which would fit the property better. Motion carried.
Item: Concept review for expansion of the First National Bank Drive-In facility
at First Street North and llth Avenue.
Mr. Maser presented the plans to the cor.imission.
Concern was expressed about traffic problems on First Street North.
Mr. Feyereisen suggested possible four-way stop at llth Avenue if it
were necessary.
Action: Mr. Marker moved and P�r. Eaves seconded a motion recommending to the Council
` approval of the concept. Motion carried.
Case No: 78-11
Hearing to consider an application by Douglas Dahlberg for Waiver of the
Platting requirements to allow division of the property at 313 East Farmdale
Road.
Mr. Dahlberg explained the reason for the request to the commission.
Mr. Schreier of Madison Avenue spoke against cor.unercial development in the
area.
Mr. Schatz wanted the commission to take a look at the area very closely.
Action: Mr. Marker moved and Mr. Eaves seconded a motion recommending to the Q�.ouncil
denial of the request for waiver of the platting requirements. Motion
carried.
Item: Appearance by Mr. Gary Mammen of Cricket Photo regarding a booth by the
Hopkins House.
�. Action: The commission discussed the location of the proposed photo booth and
recommended to the applicant that they consider a different location on
the Hopkins House property.
Action: Dr. Slaton moved and Mr. Eaves seconded a motion that the meeting be
adjourned. Motion carried.
