05-30-1978 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday,

May 30, 1978, at 7:30 p.m. in the Council Chambers of the City Hall.
Present were Chairman Hance, members Eaves, Loberg, Marker and Slaton. Also present
were City Manager Craig, City Engineer Strojan, Zoning Administrator Kohnen and City
Planner Hawks.
Item: The commission discussed the capital improvement program as presented by
City Manager Bill Craig.
Item: Mr. Marker moved and Dr. Slaton seconded a motion that the minutes of the
April 25, 1978 meeting be approved and signed. Motion carried.
Case No: 78-06 Hearing on an application by Mr. Anthony R. Tempesta for a Conditional
Use Permit to construct eight - 4 plex's at the southwest corner of 7th Street
and 9th Avenue South continued from the April 25, 1978 meeting.
Action: Mr. Marker moved and Mr. Eaves seconded a motion to continue this case to
June 27, 1978 meeting due to a request from the applicant and his not reaeiving
a report from the Nine Mile Creek Watershed District. Motion carried.
Case No: 78-10 Hearing on an application by Gregory R. Rusch for variances to construct

a building at 1842 Excelsior Avenue West, continued from the April 25, 1978
meeting to find a better plan for the property.
Action: Dr. Slaton moved and Mr. Loberg seconded a motion that the case be continued
to the June 27, 1978 meeting as per request from the applicant. Motion carried.
Case No: 78-15 Hearing on an application for a Conditional Use Permit to construct a
two story warehouse addition at 21 Harrison Avenue North.
Mr. Finke of Advance Packaging and Mr. Rutledge of Rutledge Construction
Company presented the proposed plans.
Action: Mr. Loberg moved and Dr. Slaton seconded a motion to continue this case to
June 27, 1978 to have staff study the project with the applicant in regard
to parking. Motion carried.
Item: Appearance by Mr. Rogers of the Minnetonka State Bank regarding a Drive-in
facility at 8th & Excelsior Avenue.
Mr. Richard Lundahl, architect representing Mr. Rogers, presented the concept.
� Action: Mr. Marker moved and Mr. Loberg seconded a motion approving the concept of a
drive-in facility at 8th & Excelsior Avenue. Motion carried.
Case No: 78-12 Hearing on an application by Mr. G. L. Tweed for a variance from the
allowable garage size in the R-2 District of 528 square feet per dwelling unit
to 896 square feet.
Action: Mr. Loberg moved and Mr. Marker seconded a motion to recommend to the Council
denial of the request on the basis that there appears to be no justification
for granting a variance. Motion carried.
Case No: 78-14 Hearing on an application by Guy Speaker for a variance or conditional
use permit from Zoning Ordinance No. 427.06 to permit repair and remodeling
of a single family dwelling that has been ordered by the City of Hopkins to
be demolished. Said property is located at 1513 Excelsior Avenue West.
Action: Dr. Slaton moved and Mr. Eaves seconded a motion that this case be continued
to the June 27, 1978 meeting due to a request from the applicant. Motion
carried.
Case No: 78-13 Hearing on an application by Mr. R. H. Gardner for two variances to
� construct a single family dwelling in the R-1-C District at 201 west Park Road.
Mr. Gardner presented his plans to the commission.
Planning Commission minutes of May 30, 1978 continued.
� Mr. Vassar, adjoining property owner, expressed concern over the building
being too close to an easement and placement of the pool.
Action: Dr. Slaton moved and Mr. Eaves seconded a motion recommending approval of
the request with the following conditions: (1) that the building be moved
10 feet north of the original proposal and (2) that applicant will not
obstruct storm water drainage by filling or grading along the east lot line.
Motion carried.
Item: Concept review for a proposed apartment to be located on the old Hopkins High
School site between 15th & 16th Avenue on Excelsior Avenue.
Mr. Elmo Ginkel and Mr. Woody Ginkel presented plans for a four story, 112
unit apartment with underground parking.
The commission stated concern with the exterior appearance of the building.
Action: Mr. Loberg moved and Mr. Marker seconded a motion approving the concept for
that property.
Case No: 78-16 Hearing on an application for a Conditional Use Permit by Super Valu to

construct a freezer building.
Mr. Azziai presented the plans to the commission.
Action: Mr. Loberg moved and Mr. Eaves seconded a motion recommding to the council
approval of the Conditional Use Permit for a freezer building at Super Valu.
Motion carried.
Action: Mr. Loberg moved and Mr. Marker seconded a motion that the meeting be adjourned.
Motion carried.
