08-29-1978 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, August 29, 1978, in the Council Chambers of the City Hall. �. Present were members Eaves, Loberg, Miller, Slaton and Treanor. Also present were City Manager Craig, City Engineer Strojan, Zoning Administrator Kohnen and City Planner Hawks. In the absence of Mr. Hance, Dr. Slaton chaired the meeting. Action: Mr. Eaves moved and Mr. Loberg seconded a motion approving the minutes of the July 25, 1978 meeting. Motion carried. Case No: 78-10 Hearing on an application by Gregory R. Rusch for variances to construct a building at 1842 Excelsior Avenue West, continued from the July 25, 1978 meeting to find a better plan for the property. Mr. Dennis Kuhr representing Mr. Rusch presented plans for the proposed building. Mr. Eaves moved and Mr. Miller seconded a motion to continue this case to the September 26, 1978 meeting for further study of the proposal. Motion carried. ,� Item: Concept review for remodeling of the Dahlberg building at llth & Excelsior Avenue for offices in the front and warehouse in the back, continued from the July 25, 1978 meeting. Mr. Bob Mason presented the plans for the remodeling, a loading zone and discussed the one foot setback according to the ordinance. Action: The commission instructed Mr. Mason to apply for a Conditional Use Permit for the remodeling to be heard at the September 26, 1978 meeting. Case No: 78-25 Hearing on an application by R. H. Gardner of Metro Contracting Inc. for a Conditional Use Permit to construct a proposed one story warehouse building and contractors equipment storage lot on Lot 6, Auditor's Subdivision No. 195 also known as 1102 Fifth Street South, continued from the July 25, 1978 meeting. Action: Mr. Eaves moved and Mr. Miller seconded a motion to continue this case to the September 26, 1978 meeting. Motion carried. Item: Hearing on proposed improvement of County Road 3 (Excelsior Boulevard) from ' 2000 feet east of County Road 20 (Blake Road) to 400 feet west of Louisiana, continued from July 25, 1978 meeting. Mr. Hawks brought the commission up to date regarding the upgrading. Mr. Dennis Hanson of Hennepin County presented Proposal 9B with sidewalk from Powell Road into St. Louis Park on the north side, sidewalk from Hawthorne to Meadowbrook on the south side, future bus bays at Meadowbrook and Louisiana. Residents from the area expressed concern over the speed of cars on Excelsior Boulevard and stated they still desire that all the necessary land for the improvement be taken from the north side. Ms. Dreher of S & L and Dick Wylan of Pick-Wick expressed their concern over the safety of employees making the left turn, hanicapped employees trying to cross Excelsior for buses and the number of rear-end accidents. Action: Mr. Loberg moved and Mr. Eaves seconded a motion to have staff initiate action to ex�lo�re possible donation of property on the north side without using the eight feet on the south side. Motion carried. Planning Commi�sion mim:tes of August 29, 1978 continued. Case No: 78-29 etc. � Hearing on an application by Mr. G. E. Nadler for the following: A. A Conditional Use Permit to construct an Arby's Restaurant B. Change of zoning from I-1 to B-4 C. Subdivide the property into two parcels for separate uses on part of Lot 90, Auditor's Subdivision No. 239 (Blake Road North) . Mr. George Nadler and Mr. Chuck Nadler explained the proposal to the commission. Action: Mr. Miller moved to recommend to the Council approval of the zone change, the Conditional Use Permit and division of the property. Motion died for lack of a second. Mr. Loberg moved and Mr. Eaves seconded a motion recommending denial of the zoning reauest. Motion carried. Mr. Miller voting no and. Mrs. Treanor not voting. Mr. Eaves moved and Mr. Lobera seconded a motion recommending to the Council approval of a Conditional Use Permit to build a restaurant. Motion carried. �„ Mr. Loberg moved and Mr. Eaves seconded a motion recommending approval of the preliminary plat to the Council. Motion carried. Case No: 78-30 Hearing on an application by Dorothy & William Jeske, Edith and Ralph Ortiz and Edna and Nicholas Goebel to vacate 17th Avenue South abutting Lots 23 thru 21, to vacate 6th Street South abutting Lots 12 and 13; to vacate the north-south alley abutting Lots 4 thru 12 and Lots 13 thru 21, all in Block 4, L.P. Creviers First Addition to West Minneapolis. Mr. Jeske explained the request to the commission. Mr. Craig asked that this be continued so that he have time to check the former action vacating the northerly portion of 17th Avenue and the alley. Action: Mr. Loberg moved and Mr. Miller seconded a motion that this case be continued to the September 26, 1978 meeting. Motion carried. Case No: 78-33 Hearing on an application by Burger King for a Conditional Use Permit to add a pickup window to their present restaurant at 401 Excelsior Avenue. Mr. Jim Nunn presented the plans for Burger King. Action: Mrs. Treanor moved and Mr. Eaves seconded a motion recommending to the Council approval of the Conditional Use Permit in view of it being a permitted use in the zoning district and the future traffic on Excelsior Avenue. Motion carried. Item: Resolution of Planning Commission of the City of Hopkins approving amendment to the Hopkins Redevelopment Program for the Central Business District by adding certain territory thereto for public parking and related purposes. Mr. Craig explained the proposal to the commission Action: Mr. Eaves moved and Mr. Loberg seconded a motion recommending to the City Council approval of the Resolution. Motion carried. Case No: 78-26 Hearing on an application by Pako for a Conditional Use Permit to construct a photo drive-in pick-up building at 18 Shady Oak Road, continued from the July 25, 1978 meeting. � Action: Mr. Miller moved and Mr. Loberg seconded a motion to table this item until further communication from the applicant.
