10-31-1978 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, October 31, 1978, at 7:30 p.m. in the Council Chambers of the City Hall. `. Present were Chairman Hance, members Eaves, Loberg, Miller, Slaton and Treanor. Also present were City Manager Craig, City Engineer Strojan, Zoning Administrator Kohnen and City Planner Hawks. Item: Approve and sign minutes of regular meeting of September 26, and special meeting of October 16, 1978. Action: Mr. Loberg moved and Mr. Eaves seconded a motion that the minutes of the two meetings be approved and signed. Motion carried. Item: Designation of floodway along Minnehaha Creek as part of Federal Insurance Study. Mr. Steven Prestin of the Department of Natural Resources talked to the Commission and property owners along the creek about the floodway and its effect on the property. The Secretary of the Bellgrove Association stated that the residents of Bellgrove would like the floodway as close to the creek as possible and asked if fences and swimming pools would be considered as structures. � Representatives from Merchants Refrigeration wanted to know where this floodway line would be in regard to their building. If there were definite footages that they could go by. Action: Mr. Eaves moved and Mrs. Treanor seconded a motion to recommend to the Council approval of the floodway as designated by the City Engineer. Motion carried. Case No: 78-37 Hearing on an application by the Hopkins Holding Company for two variances (1) a variance from the allowable building height of 25 feet in the B-4 District to 60 feet for an addition to the motel and (2) a variance from the required parking spaces of 101 spaces for the addition of 90 units. Request is to leave parking area as is, continued from the September 27, 1978 meeting. Mr. Fink of 14th Avenue North read a letter to the commission stating sewer problems that have occurred on 14th Avenue and concerns of the residents if more units are added and no sewer alterations considered. Other residents of the area expressed their concerns also. � Action: Mr. Loberg moved and Mr. Eaves seconded a motion to continue this case to the November 28th meeting being that no representative was present. Motion carried. Case No: 78-38 Hearing on an application by the Hopkins Holding Company for a Conditional Use Permit to remodel and enlarge the building located at 1501 Highway 7 known as the Hopkins House, continued from the September 27, 1978 meeting. Action: Mr. Loberg moved and Mr. Eaves seconded a motion to continue this request to the November 28th meeting for the same reason. Motion carried. Case No; 78-36 Hearing on an application by Knox Lumber for a Conditional Use Permit to construct an assembly warehouse, office and retail sales building at the southwest corner of County Road 3 and 5th Avenue South, continued from the October 16, 1978 meeting. Mr. Gary Anderson, Vice President of Knox reviewed with the commission the items that were to be completed. He gave the commission a letter of ...- intent regarding the drainage of the property. Action: Mr. Miller moved and Mr. Loberg seconded a motion to recommend to the Council approval of the Conditional Use Permit with the following exceptions: (1) Landscape north of the fence to midpoint of the store Planning Commission minutes of October 31, 1978 continued. (2) drainage to be approved by the City Engineer before going to the Council. Motion carried. ` Case No: 78-39 Hearing on an application by Paul Steiner for two variances (1) to reduce the front yard setback requirement of 20 feet to 18 feet 8 inches and (2) to reduce the west side yard requirement of 20 feet to 10 feet for con- struction of an office-warehouse at the southeast corner of 15th Avenue and Fifth Street South. Mr. Steiner explained the plan and requests for variances to the commission. Action: Mr. Eaves moved and Mr. Miller seconded a motion to recommend to the City Council denial of variance number one; approval of variance number two on the west side due to the floodway and approval of a variance on the south side of the building for setback of building due to the uniqueness of one driveway and loading dock for this building. Mr. McDonald of 229 Campbell Drive, spoke of the open meeting law and the legality of action taken on the third variance for the south side of the building. Mr. Eaves moved to amend the motion by striking the third variance, �� seconded by Mr. Miller. Mr. Eaves and Mr. Miller withdrew their motion and second on the proposed amendment. Mr. Eaves moved and Mr. Miller seconded a motion to withdraw their original motion. Mr. Eaves moved and Dr. Slaton seconded a motion to continue this case to the November 28 meeting. Motion carried. Case No: 78-40 Hearing on an application by Paul Steiner for a Conditional Use Permit to construct an office-warehouse building located at the southeast corner of 15th Avenue & Fifth Street South. Mr. Eaves moved and Mrs. Treanor seconded a motion to continue this case to the November 28th Meeting in view of the above action. Motion carried. Item: Preliminary review of plans for the South Junior High School building. ` Mr. Henry Hyatt of TACH and Mr. Bill Hennemuth of RCM presented the plans to the commission for 64 units in the present building and 36 new townhouse units. Mr. McDonald of 229 Campbell Drive wanted the commission to understand that this is a private enterprise and not public, that he also thought that Community Development and the Park & Recreation Commission should be involved in the preliminary discussions. This will be a cost and resource burden to the City. Action: Mr. Loberg moved and Mrs. Treanor seconded a motion to approve the pre- liminary concept stating that it was a unique plan. Motion carried. Item: Discussion of proposed amendment to the Zoning Ordinance continued to the next meeting. Case No: 78-25 Hearing on an application by Metro Contracting for a Conditional Use Permit to construct a proposed one story warehouse building and contractors equipment lot continued from September. � Action: Mr. Eaves moved and Mr. Loberg seconded a motion to table this item indefinately. Motion carried. Item: Request by Elmo Ginkel for waiver of platting requirements to allow division of the old annex property into two parcels at 1510 Excelsior Avenue West. Planning Commission minutes of October 31, 1978 continued. Mr. Allan Christy appeared in behalf of Mr. Ginkel and explained the ` request. Action: Mr. Eaves moved and Mr. Miller seconded a motion to recommend to the Council denial of the request. Motion carried. Action: Mr. Eaves moved and Mr. Loberg seconded a motion that the meeting be adjourned. Motion carried.
