11-28-1978 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday,
November 28, 1978, at 7:30 p.m. in the Council Chambers of the City Hall.
Present were members Eaves, Loberg, Marker, riiller and Treanor. Also present were
� City Manager Craig, City Engineer Strojan and Zoning Administrator Kohnen.
In the absence of Chairman James Hance, Mr. Eaves chaired the meeting.
Action: Mr. Miller moved and Mrs. Treanor seconded a motion that the minutes of the
October 31, 1978 meeting be approved and signed. Motion carried.
Item: Discussion on proposed amendments to Zoning Ordinance.
Action: Mr. Miller moved and Mr. Loberg seconded a motion that this item be continued
to the December 26th meeting. Motion carried.
Case No:
78-37 Hearing on an application by the Hopkins Holding Company for two variances
(1) a variance from the allowable building height of 25 feet in the B-4
District to 60 feet for an addition to the motel and (2) a variance from
the required parking spaces of 101 spaces for the addition of 90 units.
Request is to leave parking area as is, continued from the October 31, 1978
meeting.
� A representative from the Hopkins Holding Company stated that the owners will
complete purchase of the property north of the station and will pave and stripe
the lot. They will also provide legal covenants on the shared parking with
the shopping center.
The sewage problem on 14th Avenue was discussed and the engineer stated that
the line was adequate to handle the increased flow from the proposed addition.
Action: Mr. Marker moved and Mr. Miller seconded a motion to have the City Attorney
give an opinion as to whether the question of uniqueness of the structure
would be sufficient reason for granting a variance and an opinion as to
whether or not 427.49(8) can be amended to include B-4 without extending the
right to build eleven stories to other similar zoning districts. Motion
carried.

78-38 Hearing on an application by the Hopkins Holding Company for a Conditional
Use Permit to remodel and enlarge the building located at 1501 Highway 7
known as the Hopkins House, continued from the October 31, 1978 meeting.
Action: Mr. Miller moved and Mr. Marker seconded a motion to continue this case to
� the December 26th, 1978 meeting. Motion carried.

78-25 Hearing on an application by Metro Contracting for a Conditional Use Permit
to construct a proposed one story warehouse building and contractors equipment
storage lot, continued from October 31, 1978 meeting.
Action: Mr. Loberg moved and Mrs. Treanor seconded a motion to continue this case to
the December 26th meeting due to lack of a drainage and landscape plan.
Motion carried.
Case No:
78-39 Hearing on an application by Paul Steiner for two variances (1) to reduce
the west side yard requirement of 20 feet to 10 feet for construction of an
office-warehouse and (2) rear yard variance requirement of 20 feet to 14 feet

Action: Mr. Loberg moved and Mr. Miller seconded a motion to recommend to the Council
approval of the two variances due to the flood plain and the uniqueness of
the rear yard. Motion carried.

� 78-40 Hearing on an application by Paul Steiner for a Conditional Use Permit to
construct an office-warehouse building located at the southeast corner of
15th Avenue & Fifth Street South, continued from October 31, 1978 meeting.
Planning Commission minutes of November 28, 1978, continued.
Action: Mr. Loberg moved and Mrs. Treanor seconded a motion recommending to the
� Council approval of the Conditional Use Permit. Motion carried.
Case No:
78-42 Hearing on an application by National Housing Partnership for the following
items:
l. Rezoning of the property from R-1-A (One and two family high density) and
B-3 (General Business) to R-3 (Medium Density Multiple Family) or R-4
(Medium High Density Multiple Family.
Action: Mr. Miller moved and Mr. Loberg seconded a motion for preliminary approval of
the zone change from R-1-A and B-3 to R-3. Motion carried.
2. An amendment or variance to allow townhouse style apartments in the R-4
District.
Action: In view of the above action to approve zoning change to R-3, the applicant
withdrew the request.
3. If the property is zoned R-3 a parking variance will be necessary. 100 units
� in the R-3 District requires 200 parking spaces, 150 spaces are shown on
the site plan.
Action: Mr. Loberg moved and Mr. Marker seconded a motion for preliminary approval of
the parking variance from 200 to 151 spaces or 1.5 per unit due to the unique-
ness of the project. Motion carried. Mr. Miller voting no.
4. A Conditional Use Permit for a Planned Unit Development and Building Permit.
Action: Mr. Miller moved and Mrs. Treanor seconded a motion to continue this item to
the December 26, 1978 meeting. Motion carried.
5. Certain variances from setback requirements are needed as follows:
a. On the north side of the property, the buidlings will be about 15 feet
from the property line. Since this is a through lot, front yard setback
requirements apply at the north end of the property. The requirements
for a front yard setback are 35 feet. The buildings on this side of the
development will be approximately 15 feet from the property line; a
variance of 20 feet is therefore required.
� Action: Mr. Marker moved and Mr. Miller seconded a motion for preliminary approval of
the front yard setback variance of 20 feet subject to submission and approval
of a plan for wooden fence and shrubs on the north property line. Motion
carried.
b. The ordinance provides that no building shall be nearer to another
building than 1/2 the sum of their heights. The townhouse buildings
will be about 20 feet high, thus requiring a distance between them of
20 feet. In certain spots, the buildings will only be 15 feet apart.
Action: Mr. Marker moved and Mr. Loberg seconded a motion for preliminary approval of
the variance of five feet between certain buildings. Motion carried.
Mr. Miller voting no.
c. In the northwest corner of the site, there are a few parking spaces
which would be located within the front yard setback requirement. This
normally would be prohibited by the ordinance. A variance to allow these
parking spaces to be within the front yard setback distance is required.
Action: Mr. Marker moved and Mr. Loberg seconded a motion for preliminary approval of
the variance on the northwest corner subject to approval of screening plan on
� the north property line. Motion carried.
Action: Mr. Marker moved and Mr. Loberg seconded a motion to continue the above items
for final approval to the December 26, 1978 meeting. Motion carried.

Case No:
� 78-47 Hearing on an application by the City of Hopkins for a Conditional Use Permit
and two variances to construct a public parking lot on the northwest corner
of First Street and Tenth Avenue North.
Action: Mr. Marker moved and Mrs. Treanor seconded a motion to recommend approval to
the City Council of the two variances for front yard setback and depth re-
quirement and a Conditional Use Permit based on plan approval for traffic
flow with buffer and screening included. Motion carried.
Item: Concept review of Marvys Advertising Studio by Mr. Dahlberg.
Mr. Earl Dahlberg and Mr. Paul Katz, architect, explained the plans for
enlargement of the studio with a proposed office building of three to four
stories and a parking variance would be required.
The commission discouraged any variance for parking in the area and suggested
that Mr. Katz and Mr. Dahlberg work with Mr. Marvy on some temporary plan that
would take care of the parking problem. The applicant is to come back with
other plans.
Action: Mr. Marker moved and Mrs. Treanor seconded a motion that the meeting be
adjourned. Motion carried.
