Proposed Aetion. .
Staff recommends the following motion: The request for a seven (7 )
foot sideyard variance is denied .
Adoption of this motion will not allow the applicants to construct
another garage .
The Zoning and Planning Commission unanimously denied the request by
Dale Ruha for a 7 foot sideyard variance .
OvervieW.
The applicant is proposing to construct an addition to the front of
the existing tuck-under garage . This attached garage will have a 3
foot southerly sideyard setback . The ordinance requires 10 foot
sideyard setbacks . The proposed garage will be 24 'x2�1 ' .
Dale and Patricia Ruha appeared before the Commission . They explained
that they needed more storage space. The Commission noted that there
was no hardship to grant a variance. There was discussion on how the
applicants could construct an addition but still meet the ordinance
requirements . If the garage is constructed longer, towards Monroe
�— Place , no varianee would be required . The appalicants seemed
satisfied with this solution . .
There was no one in the audience that spoke to this matter.

The property is surrounded by residential area on all sides . The
adjacent home to the proposed garage is approximately 10 feet from the
applicants property line .
The applicant has contacted many neighbors , including the abutting
lot , none of which object to the proposed garage .
The Housing Inspector has reviewed the proposed plan . The Building
Code requires at least a three foot setback.
Analysis .
The applicant has stated that additional room is needed for storage
�— and the second car. The applicants situation is not unique . There
are many homes located in Hopkins with only a one car garage and most
would require a variance if they Wanted to expand to a two car garage .
The applicant has reasonable use of the property without the variance .
The applicant does not posses a unique circumstance or hardship to
warrant granting the variance.
. Alternatives.
1 . Grant a seven foot variance. Should you choose this
option , you will have to identify Findings of Fact which
support granting the variance.
2. Deny the variance . By denying the variance the applicant
will not be able to construct the proposed garage.
3 • Continue for further information. If the Commission
feels more information is needed , the item should be
continued .

RESOLUTION MAKING FINDINGS OF FACT AND DENYING
APPLICATION FOR VARIANCE VN88-3
WHEREAS, an application for a Variance entitled
VN88-3 has been made by Dale & Patricia Ruha , �1 � Monroe
Place , to construct a garage at less than the minimum
sideyard setback .
WHEREAS , the procedural history of the application
is as follows :
1 . That an application for Varianee VN88-3 was
filed with the City of Hopkins on April 1 ,
1988 .
2 . That the Hopkins Planning Commission reviewed
such application on April 26 , 1988 .
3 . That the Hopkins Planning Commission , pursuant
to mailed notices , held a public hearing on
April 26 , 1988 ; all persons present at the
hearing were given an opportunity to be heard.
� 4 . That the written comments and analysis of the
City staff and the Planning Commission were
considered .
NOW THEREFORE , BE IT RESOLVED , that the Hopkins
City Council makes the following Findings of Faet in respect
to vN88-3 :
