RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR VARIANCE VN85-48
WHEREAS, an application for Variance entitled VN85-48 has been made by
Naegele Outdoor Advertising , to erect a billboard which exceeds the height
limit by 15 feet , on railroad right-of-way south of Excelsior Boulevard and
East of County Road 18.
WHEREAS , the procedural history of the application is as follows :
l. That an application for Variance VN85-48 was filed with the City
of Nopkins on August 16, 1985.
2. That the Hopkins Planning Commission reviewed such application on
September 24, 1985.
3. That the Hopkins Planning Commission, pursuant to mailed noticed ,
held a public hearing on December 30, 1985; all persons present
were given an opportunity to be heard.
4. The written comments and analysis of the City Staff and the Planning
Corrmission were considered.
�-- NOW, THEREFORE, BE IT RESOLVED that the Hopkins City Council makes the
following Findings of Fact in respect to VN85-48:
1. A unique circumstance is present due to the height of the overpass.
2. A hardship exists due to the height of the overpass which dictates
the height a billboard to be visible from Highway 18.
BE IT FURTHER RESOLVED, that application for Variance VN85-48 is hereby
approved subject to the following conditions :
1. As proposed by the applicant, advertising on the billboard will not
include liquor or cigarettes.
2. Naegele will meet with the City Staff in designing a sign identifying
Hopkins below the main sign.
3. The City will be able to use two faces of the sign for one month or
one face of the sign for two months during each year, without cost.

Request: Variance to erect Billboard
STAFF FINDINGS & COMMENTS: Anderson
1. The subject sign is to be located 15 feet north of track farthest to north,
20 feet from County Road 18 overpass, south of Excelsior Boulevard, south
of Hopkins depot. The sign will face north and south and will be located
on the railroad right-of-way.
2. The sign as proposed would be a two faced advertising sign 10'x25' . The
advertising space would be changeable.
3. 427.42( 14) limits the height of a sign to 35 feet. The applicant is request-
ing a height variance of 15 feet. The reason for this request is that Highway
18 is elevated in this area and the additional height is required in order to
�-- provide adequate visibility of the sign from 18.
4. The proposed sign meets the distance requirements for billbaords as detailed
in 427.42(21) .
5. 427.42(18) (6) allows 4 square feet per front foot of lot plus one square foot
of side yard abutting a public right-of-way of 50 feet or more. Least width
of frontage shall be considered front yard. Since the sign is not located on
a lot it is impossible to determine how much square footage is allowed. The
Ordinance does not take into consideration signs that are located on a rail -
road right-of-way. The Commission may want to refer this item to the City
Attorney to determine if a billboard may be allowed on a railroad right-of-way.
