Hearing ITEM: Discussion of inemo from staff re referral from City Council, Zoning Ordinance amendment establishing CUP process for expansion of institutional uses in residential districts. CASE NO. ZCR99-4 CONCEPT REVIEW—ST. THERESE Consideration of a concept review to add an assisted living addition at St. Therese. ITEM: REVIEW AND APPROVE BYLAWS COMIVIISSION ACTION: / / / / �`" ADJOURNMENT ` ZONING AND PLANNING COMMISSION MINUTES November 30, 1999 A regular meeting of the Zoning and Planning Commission was held on Tuesday, November 30, 1999, at 6:30 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission Members Dorothy Boen, Randy Engel, Roger Grross, Eric Rudolph, John Szuba, Ross Bartz, and Maura Swanson. Also present were City Planner Nancy Anderson, Director of Planning and Economic Development Jim Kerrigan, and City Attorney 7ene Miller. CALL TO ORDER Ms. Boen called the meeting to order at 6:30 p.m. APPROVAL OF MINUTES Ms. Swanson and Mr. Gross seconded a motion to approve the minutes of the October 26, 1999, regular meeting. The motion carried unanimously. ITEM: COMPREHENSIVE PLAN Ms. Anderson reviewed the new sections of the Comprehensive Plan for Planning Commission. Comprehensive Plan is nearing completion. A public hearing is required to be held. No one appeared before the Commission at the public hearing regarding the Comprehensive Plan. Mr. Gross moved and Ms. Swanson seconded a motion to approve the Comprehensive Plan and forward it to the City Council. The motion carried unanimously. ITEM: SINGLE FAMILY ORDINANCE AMENDMENTS This item was referred back to the Commission from the City Council. Ms. Anderson reviewed the history of the ordinance amendments and why this item was referred back to the City Council. Mark Koegler appeared before the Commission. Mr. Engel was concerned about putting institutional uses in an exclusive district because of the concerns that some buildings may become non-conforming. Mr. Koegler stated that with the combined approach the City would have the most control. Mr. Kerrigan discussed the goals and objectives of the study, the impact on rezoning institutional uses, and the impact on future expansions for institutional uses. � Mr. Gross stated that at first he was in favor of the combined approach, but became reasonably comfortable with the way the CUP ordinance was drafted. NIINUTES OF TI�ZONING AND PLANNING MEETING Page 2 ` Ms. Swanson stated that rezoning could be more discriminating. Mr. Rudolph stated that he liked the way the CUP ordinance was written and was ambiguous enough to have some subjectivity that will allow some discretion. Mr. Engel and Ms. Swanson stated they were in favor of Option B, the conditional use permit approach. The Commission directed staff to draft an ordinance that will put institutional uses in an institutional zone. The Commission will then review the draft ordinance. CASE NO. ZCR99-4 CONCEPT REVIEW—ST. THERESE Ms. Anderson reviewed the proposed St. Therese proposed development. Paul Madson, Mike Pagh and Mary Beth Davis, representing St. Therese, appeared before the Commission. Don Taragos, a resident from Westbrooke Patio Homes, appeared before the Commission. Mr. Taragos was concerned with the expansion of St. Therese and that the parking does not expand into the marshland. Tony Gannon a resident from Westbrooke Patio Homes, appeared before the Commission. Mr. Gannon was concerned with the preservation of the marshland. `� Mr. Madson presented the site plans to the Commission. The plans do not show the addition being expanded in to the marshland. There are no plans to for more additions after this addition. The addition will be one and two bedrooms and a 14-unit memory loss area. The units will be from 500 — 900 square feet with a lot of common areas. ITEM: BYLAW S The bylaws need to be amended because the Council liaison position has been eliminated. Also the 60-day time limit for action by the City was also included in the bylaws. The Commission asked other changes to the bylaws. The bylaws will be brought back to the Commission at the December meeting.
