ZONING AND PLANNING COMMISSION MINUTES
October 29, 1996
A regular meeting of the Zoning and Planning Commission was held on Tuesday, October 29, 1996, at 6:30
p.m. in the Council Chambers of Hopkins City Hall.
Present were Commission members Sid Blair, Rick Brausen, Bill Schumacher, Dorothy Boen, Randy Engel,
Roger Gross, and Pat Gleeson.
Also present were City Planner Nancy Anderson and City Attorney Jerre Miller.
CALL TO ORDER
Mr. Schumacher called the meeting to order.
APPROVAL OF MINUTES
Mr. Brausen moved and Mr. Engel seconded a motion to approve the minutes of the September 24, 1996,
meeting. The motion carried unanimously.
CASE NO: CUP96-5 CONDITIONAL USE PERMIT--ARTS FACILITY
_ Ms. Anderson reviewed the proposed arts facility with the Commission. Dan O'Brien, the architect, appeared
before the Commission. Mr. O'Brien reviewed the site plan with the Commission. The Commission discussed
the lighting, drainage, location of trash receptacles, fire protection, sidewalk, and the exterior.
The public hearing was opened at 6:56 p.m. No one in the audience spoke on this issue. Mr. Blair moved and
Mr. Gleeson seconded a motion to close the public hearing at 6:57 p.m. The motion was approved
unanimously. Mr. Blair moved and Mr. Engel seconded a motion to approve Resolution RZ96-17,
recommending approval of the conditional use permit to construct the arts facility. The motion carried
unanimously.
CASE NO: VN96-2 VARIANCE--ARTS FACILITY
Ms. Anderson reviewed the need for the variances for the construction of the arts facility with the Commission.
Mr. Brausen moved and Mr. Blair seconded a motion to approve Resolution RZ96-18, recommending
approval of variances to construct the arts facility. The motion carried unanimously.
ITEM: REVIEW BUSINES5 PARK ORDINANCE
Ms. Anderson reviewed the proposed business park ordinance. Ms. Anderson noted that this zoning will be
proposed for the Hennepin County site, but could be used for other areas in the City. The Commission
discussed the percentage of office space that is allowed, and the setbacks. The HBCA Board made their
^ recommendation to the Commission. Sterling Patterson, representing HBCA, appeared before the
Commission. The Commission discussed the various recommendations from HBCA. The Commission asked
the staff to have examples of the setbacks and the size of other developments in the City to get a feel of the
setbacks and lot sizes. Staff will provide the Commission with examples of the proposed setback areas and
-- sizes of existing buildings at the November meeting.
ITEM: REVIEW AUTO SALES LOT--2021 MAINSTREET
Ms. Anderson explained to the Commission that the conditional use permit required a review in 12 months. A
new tenant has leased the property and is in the process of making the required improvements. As of the date
of the meeting, the landscaping and fence had been completed. Staff checked the site on the meeting day and
found more cars than allowed on the site. John Walsh, the new tenant of the site, appeared before the site. Mr.
Walsh stated that there were cars on the site for individuals working on the building. Mr. Walsh stated that he
knows about the limit on the number of cars on the site. The staff will monitor the site during November, and if
the number of cars continues to be a problem, Mr. Walsh will appear before the Commission at the November
meeting.
ITEM: REVIEW AUTO STORAGE LOT--1304 2ND STREET SOUTH
Nancy Anderson explained that the storage lot is used for towed cars in snow emergency situations. The
conditional use permit requires a review after 12 months. Last year the storage lot presented no problems to
the staffs knowledge.
ITEM: COMMUNICATION TOWERS
There has been a concern regarding the number of communication towers appearing in the Twin Cities area.
� Several years ago the City adopted zoning regulations for communication towers and antennas. The City
Attorney has reviewed the City's ordinance and has found it comparable with the model ordinances that were
supplied by the League of Minnesota Cities.

Mr. Blair moved and Mr. Gleeson seconded a motion to adjourn at 7:40 p.m. The motion carried
unanimously.
