ZONING AND PLANNING COMMISSION MINUTES
September 27, 1994
A regular meeting of the Zoning and Planning Commission was held on Tuesday, September 27,
1994 at 6:30 p.m. in the Council Chambers of Hopkins City Hall.
Present were Commission members Racek, Day, Johnson, Hutchison, Schumacher, Kinnich.
Also present was staff member Nancy Anderson.
CALL TO ORDER
Chairperson, Dan Johnson welcomed Kate Kinnich to the Commission.
APPROVAL OF MINUTES
Mr. Day moved and Mr. Schumacher seconded a motion to approve the minutes of the August
30, 1994 meeting. The motion carried unanimously.

CASE NO. WVR94-3 WAIVER OF PLAT- 1023 MAINSTREET
Staff recommended that this item is continued to the October 25, 1994 meeting as the subdivision
moratorium is still in effect. Mr. Racek moved and Mr. Day seconded a motion to continue
WVR94-3 to the October 25, 1994 meeting.
CASE NO. ZCR94-3 CONCEPT REVIEW - WENDY'S
Staff reviewed the applicants request. Representatives from Wendy's appeared before the
Commission. They explained that Wendy's does not offer breakfast and that the Tim Horton
restaurant would compliment the Wendy's restaurant. Both restaurants would operate under one
management.
Various aspects of the site plan were discussed such the exterior of the building access to the site,
and landscaping.
Bob Baldwin representing the applicant stated that they had tried to get another restaurant on the
site and that none were interested.
Ms. Kinnich asked the applicant what type of food the Tim Horton restaurant served. The
applicant stated that they have fresh baked goods such as cakes, rolls, donuts, and pies. They also
— served such food as croissant sandwiches and soups.

Mr. Shumacher did not feel a fast food was the best use for the site. We want to develop a night
life and this use would not do that.
Mr. Hutichson had no objection conceptually to the proposed use. Would like to look harder at
the access from 8th and 9th
Jim Justus, the owner of Justus Lumber appeared before the Commission. Mr. Justus did not feel
that a Wendy's was the best use for the site.
ITEM: REVIEW DUFFS AUTO SALES CONDITIONAL USE PERMIT
Staff is recommending that this item is continued to the May meeting as Mr. Hanson has stated
that he will be moving his business in May. Mr. Hutchison moved and Mr. Johnson seconded a
motion to continue this item to the May meeting.
ITEM: REVIEW VARIOUS ZONING AMENDMENTS
Mr. Day moved and Ms. Kinnich seconded a motion to set a public hearing for the various
zoning amendments for October 25, 1994
Mr. Hutchison moved and Mr. Racek seconded a motion to adjourn the meeting, The meeting
