COMMISSION ACTION: � � � � G/AGENDA --- A regular meeting of the Zoning and Planning Commission was held on Tuesday, October 26, 1993 at 6: 30 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission members Reuter, Hutchison, Winship, Racek, Day, and Gullickson. Also present were staff inembers Nancy Anderson, Lee Gustafson, Jim Kerrigan, City Attorney Jerre Miller, and Council Representative Anderson. Absent was Commission member Johnson. CALL TO ORDER The meeting was called to order at 6:40 by Chairperson Reuter. APPROVAL OF MINUTES Mr. Winship moved and Mr. Racek seconded the motion to approve the minutes of the September 28, 1993 meeting. The motion carried unanimously. ITEM: � CUP93-7 CONDITIONAL USE PERMIT - BIG WHEEL ROSSI Public hearing to consider an application by Richard Shaller to construct a 10 bay auto repair center at 302 Blake Road. Staff reviewed the application with the Commission. Noise studies were conducted by Orfield Associates Inc. for the applicant and David Brasslau for the neighboring property owners. The recommendations of both of these studies were incorporated in the staff report presented to the Commission. Applicant Steve Shaller, Officer and Owner of Big Wheel Rossi, gave a brief overview of the business. Rick Pierson of Orfield Associates Inc. , explained the noise study, and Mike Munson described the exterior building materials. There was discussion on these items. The public hearing was opened at 7: 10 p.m. Woody Ginkel, owner of the Knollwood Towers East, voiced his concern about the potential noise from the proposed project. He presented recommendations made by David Braslau of David Braslau Associates, a firm he engaged to do a noise study. Dan and Maurice Goldman of the Hopkins Arches appeared and ^ suggested eliminating the north doors on the service bays and enclosing the site with a fence 14 feet high or as high as the service bay doors. Zoning and Planning Commission Minutes � October 26, 1993 There was lengthy discussion on the position of the building on the lot, the type of noise which would be generated from the building, the height of the fence, keeping the bay doors closed, berming, noise levels of the traffic on Blake Road, and placing a business on this piece of property. The public hearing was closed at 8 : 10 p.m. Mr. Winship moved and Mr. Day seconded the motion to approve Resolution RZ93-18 approving a conditional use permit to construct a 10 bay auto service facility. The vote was as follows: Mr. Winship Aye; Mr. Racek Aye; Mr. Day Aye; Mr. Gullickson Nay; Mr. Hutchison Nay; Ms. Reuter Nay. The vote was tied 3-3 . Mr. Hutchison moved and Mr. Gullickson seconded a motion to refer the item to City Council with no action. This motion was approved unanimously. Commission adjourned for a five minute break. Commission reconvened at 8:40 p.m. � ITEM: CUP93-8 CONDITIONAL USE PERMIT - RENTAL SERVICE Public hearing to consider an application by J.D. Lindstrom for a conditional use permit to operate a rental service at 404 Mainstreet. Staff recommended this item be tabled as the applicant has not submitted any plans to date. The public hearing was opened at 8 : 41. No one appeared in regards to this issue. The public hearing was closed at 8 :42 . Mr. Hutchison moved and Mr. Racek seconded the motion to table this item. The motion carried unanimously. ITEM: CUP 93-9 OPEN CIRCLE DAY CARE CENTER Public hearing to consider an application by Open Circle Adult Day Care Center for a conditional use permit to operate an adult day care at 34 Tenth Avenue South. Staff reviewed the applicant's request with the Commission. The entrance to the building requires some work to make it handicap � accessible. Zoning and Planning Commission Minutes _ October 26, 1993 Carl Bennet and Pam Blixt, representing Open Circle Adult Day Care Center, appeared before the Commission. The Commission discussed with the applicants the access into the building and the loading/unloading area. The public hearing was opened at 8: 50. No one appeared in regards to this issue. The public hearing was closed at 8: 51. Mr. Hutchison moved and Mr. Winship seconded the motion to approve Resolution RZ93-20 approving the conditional use permit at 34 Tenth Avenue South, adding a condition for a loading zone in front of the building. The motion passed unanimously. ITEM: CUP93-10 CONDITIONAL USE PERMIT - THERMOTECH CORPORATION Public hearing to consider an application for a conditional use permit by Thermotech to construct a 68, 000 square foot addition to the existing building at 1320 Fifth Street South. Staff reviewed the proposed development with the Commission. Thermotech is required to provide a replacement wetland for the wetlands on the site which will be filled. There was lengthy ^ discussion on the wetlands. Alan Kimpell and Tom Lundgren, representing Thermotech, appeared before the Commission. The Commission discussed various issues in regards to the proposed building. The public hearing was opened at 9:25 p.m. No one appeared regarding the proposed addition. The public hearing was closed at 9: 26 p.m. Mr. Gullickson moved and Mr. Racek seconded the motion to approve Resolution RZ93-21 approving the conditional use permit for an addition to the existing building at 1320 Fifth Street South. The motion passed unanimously. ITEM: VAC93-1 VACATION - THERMOTECH CORPORATION Public hearing to consider an application by Thermotech for vacation of 14th Avenue abutting their property. Staff reviewed the applicant's request with the Commission. There was little discussion on this item. � The public hearing was opened at 9: 58. No one appeared in regards to this issue. Zoning and Planning Commission Minutes ^ October 26, 1993 The public hearing was closed at 9 : 59 p.m. Mr. Hutchison moved and Mr. Gullickson seconded the motion to approve Resolution RZ93-22 recommending approval of a vacation of the east half of 14th Avenue. The motion passed unanimously. ITEM: CUP93-11 CONDITIONAL USE PERMIT - HOLIDAY COMPANIES Public hearing to consider an application by Holiday Companies to amend their conditional use permit to allow the access on lith Avenue to remain open. Staff reviewed the applicant' s request with the Commission. Mark Nelson, representing Holiday Companies, appeared before the Commission. Mr. Nelson stated that closing the access would have a negative affect on the business. Traffic consultant Mike Gorman of Barton-Ashman appeared before the Commission. Mr. Gorman was hired by Holiday to review the access. Mr. Gorman stated that the data does not indicate that the access should be closed. The Commission discussed the information presented. There also was discussion on the possibility of a right turn only for the access. Lee Gustafson, City Engineer, stated it would be possible but not practical. —� The public hearing was opened at 10: 16 p.m. No one appeared in regards to this item. The public hearing was closed at 10: 17 p.m. Mr. Winship moved and Mr. Gullickson seconded the motion to approve Resolution RZ93-23 recommending denial of an amendment to a conditional use permit to close the northerly access on llth Avenue. The motion passed unanimously. ITEM: VN93-6 VARIANCE - 510 SWEETBRIAR Consider an application for a variance for a 5 foot sideyard setback to construct an addition to the garage. Staff reviewed the applicant' s request with the Commission. The applicant, Mr. Story, appeared before the Commission. He stated that no one in the neighborhood was opposed to the variance. A neighbor, Matt Waters of 401 Wayside, appeared and stated he had no objection to the variance. There was little discussion on this item. Mr. Day moved and Mr. Gullickson seconded the motion to approve Resolution RZ93-24 approving a 5 foot side yard variance at 510 ^ Sweetbriar. The motion carried unanimously.
