, A regular meeting of the Zoning and Planning Commission was held on
Tuesday, June 30, 1992 at 7: 30 p.m. in the Council Chambers of Hopkins
City Hall.
Present were Chairman Pavelka, members Hutchison, Winship, Racek, Day,
Reuter and Redeppenning.
Absent was Commissionmember Chapman.
Also present were staff inembers Nancy Anderson and Lee Gustafson, and
City Attorney Jerre Miller.
CALL TO ORDER
Chairman Pavelka called the meeting to order at 7 : 30 p.m.
ITEM:
Commissionmember Winship moved and Commissionmember Reuter seconded
the motion to approve the minutes of the May 26, 1992 meeting. The
motion carried unanimously.

Public hearing to consider placing more than 400 cubic yards of fill
at 236 Tyler Avenue.
This item was withdrawn from the agenda as Mr. Pobuda had removed the
excess fill from the lot and his Engineer has provided staff with the
information they need.

Public hearing to consider a final plat for the shopping center at the
northwest corner of Blake Road and County Road 3 .
Staff inember Anderson reviewed the request with the Commission. The
applicant has withdrawn the request to vacate Pierce Avenue because of
opposition from neighboring landowners. The size of the addition
would be restricted without the vacation, therefore the applicant said
he may decide not to build.
The public hearing was opened at 7:40 p.m. No one appeared in regards
— to the issue. The public hearing was closed at 7: 41 p.m.
— After discussion, Commissionmember Winship moved to approve RZ92-16 to
approve the final plat for the shopping center at the northwest corner
of Blake Road and County Road 3 .

Public hearing to consider a rezoning of part of the shopping center

Commissionmember Racek moved to continue this item to the July 28
meeting.
Motion was seconded by Hutchison. Motion passed unanimously.
CASE NO:
SUBD 92-3 PRELIMINARY/FINAL PLAT - 333 SECOND STREET N.E.
Public hearing to consider a preliminary/final plat at 333 Second
Street N.E.
Ryan Johnson, Super Valu spokesperson, reviewed the request with the
� Commission. He stated that they no longer use the meat processing
plant and would like to sell the portion of the land upon which the
warehouse and parking lot are located. They wish to retain the
remaining parcel for snow storage.
The public hearing was opened at 7: 44 p.m.
Residents from the area expressed concern that the property is
unsightly after the snow melts. Debris is carried in with the snow
and needs to be cleaned up. There are also fallen trees along the
creek which need to be taken care of. Lee Gustafson stated it is the
City's responsibility to see that the drainage ditch is kept open.
It was verified that the part of the property in question is zoned
residential and therefore only automobiles can be parked there, semis
are not allowed.
It was suggested that the application be approved with a written
statement from the applicant stating that they will clean up the
debris.
An additional suggestion was that a walking path be maintained. The
plat does not include any of the railroad right-of-way that will be
used for the walking path.
The public hearing was closed at 8: 01.
After discussion Commissionmember Hutchison moved to approve RZ92-17
for a preliminary/final plat.

CASE NO:
VN 92-3 VARIANCE - ZION LUTHERAN CHURCH.
Hearing to consider a variance to allow a sign closer to the property
line than allowed.
Staff inember Anderson reviewed the request with the Commission. Zion
Lutheran Church wants to construct a new sign, located where the
existing sign is located. The larger size proposed would bring the
sign closer to the property line than allowed. Staff recommended
denial of the application because there was not a hardship.
Russell Koppelman appeared on behalf of Zion Lutheran Church. He
stated that the church wishes to use existing electrical and masonry
and therefore the sign would remain in its current location.
Commissionmember Racek expressed concern in regards to the size of the
sign.
After discussion Commissionmember Reuter moved to approve the variance
requested by Zion Lutheran Church.
The motion was seconded by Winship.
A poll of the vote was as follows; Commissionmember Pavelka, Aye;
Commissionmember Winship, Aye; Commissionmember Day, Aye;
Commissionmember Reuter, Aye; Commissionmember Hutchison, Nay;

conditional use permit.

An additional condition was that the base is blocked with matching
brick or compatible stone or beveled flagstone.

CASE NO:
WVR 92-1 WAIVER OF PLAT - 244 17TH AVENUE NORTH.
Hearing to consider a waiver of plat at 244 - 17th Avenue North.
This property was originally platted as three lots. The existing home
is constructed on Lot 1 and part of Lot 2 . There is 65 feet of vacant
land to the south of the existing home. The applicant is proposing to
' divide Lot 2 and combine it with Lot 3 to make a larger lot. Hennepin
County must approve this proposal.
� Mary Tesarek, owner of the property in question, stated that she
wanted to sell the existing home on the property and perhaps build a
home for herself on the balance of the property.
Commissionmember Day moved to approve Resolution RZ92-13 for a waiver
of plat.
The motion was seconded by Hutchison.
The motion passed unanimously. •
CASE NO:
WVR 92-2 WAIVER OF PLAT - 105 - 16th AVENUE NORTH.
Hearing to consider a waiver of plat at 105 - 16th Avenue North.
The waiver of plat involves three lots. 105 - 16th Avenue consists of
two 50 foot lots and 113 - 16th Avenue is one 50 foot lot. The middle
lot is vacant. The applicant proposes to divide the vacant middle lot
and join each half with the abutting properties, which are properties
with homes.
� Commissionmember Hutchison moved to approve Resolution RZ92-12 for a
waiver of plat.

VN 92-2 SIGN VARIANCE.
Hearing to consider a variance to allow a sign that is larger, lower
in height and extending into the right-of-way farther than allowed by
the Zoning Ordinance.
Staff inember Anderson reviewed the request with the Commission. She
stated that larger signs had been allowed in the past, but that an
Ordinance was then created to allow signs no larger than 3 square
feet.
Applicant Jean Mason stated she is the owner of a multi tenant
building and she is having a difficult time renting to tenants because
they cannot hang a perpendicular sign. The building to the east has a
mansard roof that extends 2 feet and covers their sign. It was
recommended that this item be referred to the Business Council for
their review.

CIP
A draft of the CIP five year plan was discussed.
OTHER ISSUES
Don Roesner, a resident of Hopkins, stated some concerns about the
number of multiple dwelling units in the City and the City should be
doing something to stop the construction of additional multiple family
dwelling units. Several Commissionmembers told Mr. Roesner that the
City is concerned about the number of multiple units in the City and
will be looking into this concern in the future. He also stated his
dissatisfaction with the quality of work being done on the streets and
sidewalks in the City. He said he felt the residents aren't being
heard but that business people are.
Hutchison moved and Racek seconded the motion to adjourn the meeting
� at 10: 05 p.m. The meeting adjourned by unanimous consent.
