RZ97-04 CITY OF HOPKINS ^ Hennepin County, Minnesota RESOLUTION NO: RZ97-4 RESOLUTION MAKING FINDINGS OF FACT AND RECOMNIENDING APPROVAL OF A CONDITIONAL USE PERMIT TO CONSTRUCT BUILDINGS ON THE NORTHEAST CORNER OF MAINSTREET AND 8TH AVENUE WHEREAS, an application for Conditional Use Permit CUP97-3 has been made by Jeff Kakach, and; WHEREAS, the procedural history of the application is as follows: 1. That an application for Conditional Use Pernvt CUP97-3 was made by Jeff Kakach, on February 21, 1997; 2. That the Hopkins Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on March 25, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of the City staff were considered; and --� 4. A legal description of the subject property is as follows: Lots 10, 11, 12 , 13, 14, and the south 10 feet of Lot 15 Block 66, WEST MINNEAPOLIS SECOND DIVISION, Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED that application for Conditional Use Permit CUP97-3 is hereby recommended for approval, based on the following Findings of Fact: 1. That the proposed development meets the requirements for a conditional use permit. 2. That the proposed development meets the zoning requirements. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP97-3 is hereby recommended for approval based on the following conditions: 1. That if the alley vacation is not approved, the applicant will submit a revised site plan. 2. That Nine Mile Watershed District approves the proposed development. 3. That the preliminary/final plat is approved. 4. That the Public Works department approves the final grading and drainage plan. 5 That the landscaped plan is revised to reflect compliance with the ordinance. �--� Adopted this 2 th d�f March, 1997. � t Bill Schumach r, Chair
