RESOLUTION MAKING FINDINGS OF FACT AND RECOIVIlVIENDING
APPROVAL OF AN APPLICATION FOR A WAVIER OF PLAT AT
103 AND 105 MINNETONKA MILLS ROAD
WHEREAS, an application for WVR96-1 that was filed with the City of Hopkins to change the
property line between 103 and 105 Minnetonka Mills Road is recommended for approval.
WHEREAS, the procedural history of the application is as follows:
1. That an application for Waiver of Plat WVR96-1 was filed with the City of Hopkins on
October 11, 1996.
2. That the Hopkins Planning Commission, pursuant to mailed notices, held a meeting on the
application and reviewed such application on November 26, 1996.
�` 3. That the written comments and analysis of the City staff and the Planning Commission
were considered.
4. Legal descriptions of the new properties are as follows:
105 Minnetonka Mills Road
That part of the Southeast Quarter of the Northeast Quarter of Section 24, Township 117 North, Range
22 Hennepin County, Minnesota, described as commencing at a point on the south line of said Southeast
Quarter of the Northeast Quarter a distance of 940 feet east of the southwest corner thereof; thence
northerly along a line hereinafter referred to as Line "C," said line being parallel with the west line of said
Southeast Quarter of the Northeast Quarter, a distance of 303.01 feet to the southerly line of Minnetonka
Mills Road; thence southeasterly along said southerly line of Minnetonka Mills Road a distance of 150
feet; thence southerly a distance of 42.24 feet along a line which if extended would intersect said south
line of the Southeast Quarter of the Northeast Quarter at a point 1052 feet east of said southwest corner
thereof; thence northeasterly, turning an angle to the right of 16 degrees 29 minutes 16 seconds, a
distance of 39.96 feet to said southerly line of Minnetonka Mills Road and the point of beginning of the
property to be described; thence southwesterly along last described line and its southwesterly extension a
distance of 124.09 feet to the north line of the south 120.00 feet of said Southeast Quarter of the
Northeast Quarter; thence westerly along last described parallel line a distance of 120.07 feet to said Line
"C"; thence northerly along said Line "C" a distance of 183.02 feet to said southerly line of Minnetonka
Mills Road; thence southeasterly along said southerly line of Minnetonka Mills Road a distance of 162.00

Hennepin County, Minnesota, described as commencing at a point on the south line of said Southeast
Quarter of the Northeast Quarter a distance of 940 feet east of the southwest corner thereof; thence
northerly parallel with the west line of said Southeast Quarter of the Northeast Quarter a distance of
303.01 feet to the southerly line of Minnetonka Mills Road; thence southeasterly along said southerly line
of Minnetonka Mills Road a distance of 240 feet to the point of beginning of the property to be
described; thence northwesterly along said southerly line of Minnetonka Mills Road a distance of 90.00
feet to a point hereinafter refened to as Point "B"; thence southerly a distance of 42.24 feet along a line
which if extended would intersect said south line of the Southeast Quarter of the Northeast Quarter at a
point 1052 feet east of said southwest corner thereof, said line hereinafter referred to as Line "A"; thence
southwesterly, deflecting to the right of 16 degrees 29 minutes 16 seconds, a distance of 84.13 to the
north line of the south 120.00 feet of said Southeast Quarter of the Northeast Quarter; thence easterly
along last described parallel line a distance of 24.00 feet to said Line "A"; thence southerly along said
Line "A" a distance of 1.22 feet to a point 121.70 feet southerly of said Line "B"; as measured along said
Line "A"; thence southeasterly to a point 103.5 feet southerly from the point of beginning and on a line
drawn from the point of beginning to a point on said south line of the Southeast Quarter of the Northeast
Quarter distance 112 feet east of said southwest corner thereof; thence northerly along said line a
distance of 103.5 to the point of beginning.
Except that part described as beginning at said Point "B"; thence southerly along said Line "A" a distance
of 42.24 feet; thence northeasterly, turning an angle to the right of 16 degrees 29 minutes 16 seconds a

southerly line of Minnetonka Mills Road a distance of 12.00 to the point of beginning.
NOW, THEREFORE, BE IT RESOLVED that the application for Waiver of Plat WVR96-1 is
hereby recommended for approval based on the following Findings of Fact:
1. That the proposed lots meet the setbacks for the R-1-C zoning district.
