RZ95-24 CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: RZ95-24 RESOLUTION MAKING FINDINGS OF FACT AND RECONIlVIENDING APPROVAL OF A CONDITIONAL USE PERNIIT TO CONSTRUCT ADDITIONS TO THE EXISTING TAIT'S SUPERVALU BUII.,DING WHEREAS, an application for Conditional Use Permit CUP95-5 has been made by Mike Tait; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a Conditional Use Permit, CUP95-5, was made by Mike Tait on October 24, 1995; 2. That the Hopkins Planning Commission, pursuant to mailed and published a notice, held a public hearing on the application and reviewed such application on September 26, 1995, and October 31, 1995: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the property is as follows: � The Southerly 24 feet of Lot 3, the Westerly 69.84 feet of Lots 4 and 5, the Westerly 69.84 feet of the Northerly 33 feet of Lot 6, the Northerly 33 feet of Lot 19, all of lots 20 and 21, and the southerly 24 feet of Lot 22, all in Block 69, West Minneapolis Second Division, together with that part of the vacated North-South alley in said Block 69 abutting upon said Lots or parts thereof. NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUP95-5 is hereby recommended for approval based on the following Findings of Fact: 1. A grocery store is pernutted in the B-2 zoning district. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP95-5 is hereby recommended for approval based on the following conditions: 1. That the applicant is deeded or leased the additonal property needed for the additions to meet zoning setback requirements. 2.
